Discussion Items. 1. City agrees to continue the Labor-Management Committee as needed, to review and consider issues of mutual concern, including but not limited to funding of future salary and benefit costs, and contracting out of City jobs.
2. City invites and encourages CCEA members to suggest work or work process changes to their own respective jobs which could reduce City costs and assist the City in making funds available for other purposes. Suggestions should be submitted to/through the respective employees’ departmental channels, with a copy to the City Manager or Human Resources Director.

The Parties agree to establish non-binding Committee(s) to meet in good faith, after ratification of this Memorandum of Agreement, to discuss: • Non- cash compensation (including employee wellness programs, for example employee fitness pass) • Conversions • Employee acting opportunities for development and succession planning • Hours of work and schedules • Leaves (family responsibility, compassionate, other use of sick, etc.). Should the parties come to an agreement on the issues they shall agree to both present them to the next round of collective bargaining or create a Letter of Understanding if agreeable terms can be reached on the applicable topic.

Upon ratification of this Memorandum of Agreement, the parties agree to establish a non-binding committee (the “Committee”) to discuss issues of mutual interest related to Hours of Work such as scheduling and the Earned Day Off program. Within 30 calendar days of ratification, the parties will meet to begin to develop the Terms of Reference for the Committee. The Committee’s function extends only to making recommendations to Collective Agreement language or practices by mutual agreement through either letters of understanding or the collective bargaining process. The Committee will not have any powers or authority beyond the scope as contained herein. This Committee will cease to exist at the expiration of the current Collective Agreement.

(G) Selling or conveying the Project or any portion thereof or any interest therein other than sales of residential land, units or commercial condominium units in accordance with an Annual Plan or the Development Plan;
(H) Causing or permitting the Company to extend credit to or to make any loans or become a surety, guarantor, endorser or accommodation endorser for any person, firm or corporation;
(I) Confessing a judgment against the Company, submitting a Company claim to litigation or arbitration, or settling any litigation or arbitration;
(J) Entering into any lease or other occupancy arrangement not in accordance with leasing guidelines set forth in an Annual Plan or the Development Plan;
(K) Admitting a new Member to the Company;
(L) Entering into, modifying, terminating or waiving any breach of or default under the Development Management Agreement or any other agreement with any Affiliate of any Member;
(M) Except as provided in an Annual Plan or the Development Plan and with respect to trade payables and other borrowings in the ordinary course of the Company’s business, entering into any third party loan or other borrowing, or modifying, prepaying or extending the term of any third party loan or other borrowing;
