Eligibility and Availability. 2.1 To be eligible to participate in the Program and prior to Xcel Energy undertaking any Xcel Energy responsibility set forth in Section 4, Customer must provide documentation acceptable to Xcel Energy evidencing that Customer meets all the following requirements (the “Customer Requirements”): 2.1.1 Qualify as a non-residential electric customer of Xcel Energy in Colorado; 2.1.2 Own or lease the Customer Location, or be Xcel Energy’s customer of record associated with the premise’s electric service meter at the Customer Location; 2.1.3 Provide express written consent, in a form acceptable to Xcel Energy in its sole discretion, from the owner of the Customer Location to grant Xcel Energy the appropriate real property rights and continuous access to EV Supply Infrastructure and Optional Charging Equipment, as applicable, installed, owned, and maintained by Xcel Energy, including an easement signed by the owner of the Customer Location, in the form attached hereto as Exhibit A; 2.1.4 Customer must own, lease or operate EV charging or shared electric mobility charging (e.g. e-bikes or scooters) at the Customer Location; 2.1.5 Commit to installing a minimum of four (4) charging ports per Customer Location or, in cases with fewer than four ports, a minimum of 50 kW of charging capacity; 2.1.6 During the Term, agree to take electric service to the Charging Equipment on one of Xcel Energy’s published Commercial rates for which Customer is eligible; 2.1.7 All Charging Equipment electric load will be separately metered from any other load served at the Customer Location; 2.1.8 Provide proof, acceptable to Xcel Energy in its sole determination, that Customer has purchased, or will purchase as required by this Agreement and has the ability, financial, technical, or otherwise, to install Charging Equipment from Xcel Energy’s pre-qualified Charging Equipment list The Charging Equipment on this list meets Xcel Energy’s technical and safety standards, demonstrate interoperability, cyber security, and smart charging capabilities that enable Customer to participate in managed charging rates or programs; 2.1.9 Provide proof, acceptable to Xcel Energy in its sole determination, that Customer can provide demonstrated support of its ability to utilize the EV Supply Infrastructure within six (6) months of its In-Service Date; and 2.1.10 Acknowledgement that Customer may be required to take electric service to the Charging Equipment through a specified rate schedule (e.g., a tim...

Eligibility and Availability. 1.1. To be eligible for the EV Accelerate At Home Program Rate Codes A79, A80, you, must: Agree to the terms and conditions of this Services Agreement; have an active Xcel Energy residential electric service account in Xcel Energy’s Minnesota regulated electric service territory with no past due bills; Rent or own the Site, provided that if you rent the Site, you must have a separately metered service, pay for any necessary Premises Wiring, and have the Site owner’s written consent to participate in the EV Accelerate At Home Program; Represent that the Site is owned or rented by the Customer, is located within Xcel Energy’s Minnesota regulated electrical service territory, and corresponds with a Xcel Energy residential electrical account on which the Charger will be installed; Have an approved Charger installed by Xcel Energy, or an authorized third-party independent contractor on Xcel Energy’s behalf, or be inspected and confirmed as eligible by an Xcel Energy contracted electrician, for the exclusive use of tracking the electricity used to charge your Electric Vehicle; Have wireless internet (“Wi-Fi”) service at Site; Not be on current Xcel Energy Residential EV Service Rate (RATE CODE A08). If you are already enrolled on Rate Code A08, you must unenroll for the duration of your participation on the EV Accelerate At Home Program; Not participate in Xcel Energy’s Time of Use Rate Design Pilot Program. If you are already enrolled in the Time of Use Rate Design Pilot Program, you must unenroll for the duration of your participation in the EV Accelerate At Home Program ; and Not participate in Xcel Energy’s Net Metering tariffs.
Eligibility and Availability. The CSUB Fab Lab is open to all members of the community who comply with the rules of the CSUB Fab Lab, and who sign the CSUB Fab Lab User Agreement and Release of Liability Agreement. Failure to abide by CSUB Fab Lab rules may result in termination of user access to the CSUB Fab Lab or the user being held responsible for damages to CSUB property. Use of the CSUB Fab Lab facilities and equipment is free. The CSUB Fab Lab generally does not provide materials (including metal, fabric, wood, or other such items), and does not guarantee the availability of such materials. The CSUB Fab Lab may, however, provide scrap materials for use when available. Availability of equipment is not guaranteed. Use of CSUB Fab Lab equipment is on a first- come/first-served basis. The CSUB Fab Lab makes no representations as to the availability of equipment or materials in the CSUB Fab Lab. Individual reservations for equipment will not be accepted. Class requests may be made in advance by contacting CSUB Fab Lab staff at xxxxxx@xxxx.xxx or calling 000-000-0000. Classes receive priority access to all equipment. Individuals that are not CSUB students, faculty or staff members may only use the CSUB Fab Lab during designated open hours. The purpose of the CSUB Fab Lab is to encourage research and development. Abuse of resources which significantly reduces the ability of others to use CSUB Fab Lab equipment and facilities is not permitted. While commercial items may be prototyped and incubated in the CSUB Fab Lab, such activities must not conflict with other uses. Equipment must be returned in the same condition in which it was received. Upon return of the equipment, users must alert CSUB Fab Lab staff about any damage or issues related to the operation or condition of the equipment. Use of personal equipment is only allowed with prior approval of CSUB Fab Lab staff. Any personal equipment must be labeled with user’s name, phone and email address. No personal equipment may be stored in the CSUB Fab Lab. CSUB is not responsible for lost, stolen, or damaged equipment or materials. CSUB makes no representations or warranties of any kind concerning CSUB Fab Lab facilities and equipment or their availability, and hereby disclaims all representations or warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non- infringement of intellectual property rights, and the absence of latent or other defects, whether or not discoverable.
Eligibility and Availability. To be eligible to participate in the United-EV Charging-as-a-Service Program (“Program”), Participant must: 2.1. be a member in good standing of the Cooperative; 2.2. live in a single-family home, defined as a detached single family home, townhome/row house, or duplex/paired home with a fully-enclosed garage; 2.3. represent that the Site on which the EV Charger will be installed is owned by Participant, is located within the Cooperative’s electrical service territory, and corresponds with an electrical account with the Cooperative; 2.4. have Make-ready Wiring to support installation of an EV Charger and, if applicable, purchase any necessary adapters (as an example, the J-1772 adapter for charging Tesla vehicles)—no other up-front investment is required by Participant; 2.5. have wireless internet (“Wi-Fi”) service at Site with sufficient signal strength and network configuration for the EV Charger to reliably connect to the Internet; and 2.6. agree to allow the Cooperative to manage the scheduled charging of Participant’s EV according to the charging schedule specified in the Program Enrollment Form by providing the Cooperative with access to the EV Charger software.
Eligibility and Availability. 2.1 The Promotion is available to Eligible Residents and is available during the Promotion Period only. Applications for the Promotion from anyone other than Eligible Residents or which are received by Good Energy after the end of the Application Period will not be eligible. Good Energy reserves the right to decline any application for the Promotion for any reason and to close the Promotion to new applicants at any time and for any reason. 2.2 Without limiting the foregoing and subject to clause 2.3, the Promotion is only available to Eligible Residents who for the Promotion Period: a. have moved to a new home and require a domestic supply of gas/and or electricity; b. have agreed to take and continue to take a domestic supply of gas and/or electricity from Good Energy; c. receive the domestic supply of gas and/or electricity through a singlerate credit meter, an Economy 7 meter or a smart-meter operating in “credit” mode; d. have provided the Promotional Code and any other documents of information that We may reasonably require to verify entitlement to the BT Discount. 2.3 The Promotion is not available to customers: a. who do not meet the requirements of clause 2.2; and/or b. whose metering arrangements involve pre-payment meters, smart meters operating in “prepayment” mode; and/or c. whose meter is de-energised (irrespective of whether the corresponding meter point access number (MPAN) is recorded as energised or de-energised); and/or d. who require a Warm Homes Discount as unfortunately Good Energy is currently unable to offer this; and/or e. who cease to be customers of BT in the two months following the date upon which you move to your new home; and/or f. in conjunction with any other Good Energy offer. 2.4 By applying for the Promotion, You agree that for the duration of the Promotion Period You will: a. establish and maintain a fixed direct debit instruction at Your bank in favour of Good Energy in the amount notified to You by Good Energy (acting reasonably) from time to time; b. promptly register for and maintain an online account with Good Energy with a valid and up to date email address; c. submit accurate meter readings from Your electricity and/or gas meter at least once in each consecutive period of three months from the date on which the Promotion Period starts, either through Your o...

To be eligible to participate in the EV Service Pilot, Participants must: (a) Be a member in good standing of the Cooperative; (b) live in a single-family home, defined as a detached single family home, townhome/row house, or duplex; (c) represent that the Site is owned by Participant, is located within the Cooperative’s electrical service territory, and corresponds with an electrical account with the Cooperative on which the EVSE will be installed; (d) complete documentation approved by the Cooperative verifying possession, through ownership or lease, of an Electric Vehicle; (e) have an approved EVSE installed by the Cooperative, for the exclusive use of tracking the energy used to charge their Electric Vehicle; (f) have wireless internet (“Wi-Fi”) service at Site; (g) No up-front investment is required by participating Consumers for EVSE other than for Premise Wiring. Eligibility and Availability. The Amenities may be rented by HOA Homeowners, or tenants who have completed Tenant Authorization Forms on file. The Amenities shall be utilized solely for the purpose of a private party by personal invitation. This means you may not post to social media sites, newspapers, etc.( INT). Reservations cannot be made unless the Renter’s corresponding property is current on all assessments or dues rendered by the HOA. No one under the age of 21 may request a reservation. The management company will facilitate all requests for reserving Amenities. The Amenities may be reserved for a period of four (4) hours between the hours of 9:00AM and 11:00PM Sunday – Thursday and between the hours of 9:00AM and 12:00AM on Fridays and Saturdays ( INT). No requests may exceed a one day time period. Loading dock reservation times will be between the hours of 8AM and 6PM Monday – Saturday.

  • Eligibility and Allocation The allocations outlined in paragraphs b) and c) above, will be provided on the first day of each school year, subject to the restrictions outlined in d)i-vi below. i. A Teacher is eligible for the full allocation of sick leave and STLDP regardless of start date of employment or date of return to work from any leave other than sick leave, WSIB or LTD. ii. All allocations of sick leave and STLDP shall be pro-rated based on FTE at the start of the school year. Any changes in FTE during a school year shall result in an adjustment to allocations. iii. Where a Teacher is accessing sick leave, STLDP, WSIB or LTD in a school year and the absence due to the same illness or injury continues into the following school year, the Teacher will continue to access any unused sick leave days or STLDP days from the previous school year’s allocation. Access to the new allocation provided as per paragraphs b) and c) for a recurrence of the same illness or injury will not be provided to the Teacher until the Teacher has completed eleven (11) consecutive working days at their full FTE without absence due to illness. iv. Where a Teacher is accessing STLDP, WSIB, or LTD in the current school year as a result of an absence due to the same illness or injury that continued from the previous school year and has returned to work at less than their FTE, the Teacher will continue to access any unused sick leave days or STLDP days from the previous school year’s allocation. In the event that the Teacher exhausts their STLDP allotment and continues to work part-time their salary will be reduced accordingly and a new prorated sick leave and STLDP allocation will be provided. Any absences during the working portion of the day will not result in a loss of salary or further reduction in the previous year’s sick leave allocation, but will instead be deducted from the new allocation once provided. v. A partial sick leave day or short-term disability day will be deducted for an absence of a partial day. vi. Where a permanent Teacher is not receiving benefits from another source and is working less than their full FTE in the course of a graduated return to work as the Teacher recovers from an illness or injury, the Teacher may use any unused sick/short-term disability allocation remaining, if any, for the Teacher’s FTE that the Teacher is unable to work due to illness or injury.

  • Interest Eligibility and Computation If NYSERDA fails to make Prompt Payment, NYSERDA shall pay interest to the Contractor on the Payment when such interest computed as provided herein is equal to or more than ten dollars ($10.00). Interest shall be computed and accrue at the daily rate in effect on the Date of Payment, as set by the New York State Tax Commission for corporate taxes pursuant to Section 1096(e)(1) of the Tax Law. Interest on such a Payment shall be computed for the period beginning on the day after the Payment Due Date and ending on the Date of Payment.

  • High Availability Registry Operator will conduct its operations using network and geographically diverse, redundant servers (including network-­‐level redundancy, end-­‐node level redundancy and the implementation of a load balancing scheme where applicable) to ensure continued operation in the case of technical failure (widespread or local), or an extraordinary occurrence or circumstance beyond the control of the Registry Operator. Registry Operator’s emergency operations department shall be available at all times to respond to extraordinary occurrences.
