Exhaustion of Leave. Upon termination of the industrial accident or illness leave, the employee shall be entitled to the benefits provided in the Education Code, and for the purposes of each of these sections, his/her absence shall be deemed to have commenced on the date of termination of the industrial accident or illness leave, provided that if the employee continues to receive temporary disability indemnity, he/she may elect to take as much of his/her accumulated sick leave, which, when added to his/her temporary disability indemnity, will result in a payment to her/him of not more than his/her full salary.
Exhaustion of Leave. Upon termination of the industrial accident or illness leave, the faculty member shall be entitled to the benefits provided in the Education Code. For purposes of each of these sections, the faculty member’s absence shall be deemed to have commenced on the termination date of the industrial accident or illness leave. If the faculty member continues to receive temporary disability indemnity, the faculty member shall elect to take as much accumulated sick leave, which will not exceed the faculty member’s full salary when added to the faculty member’s temporary disability indemnity.
Exhaustion of Leave. 12.6.4.1 When entitlement to industrial accident or illness leave has been exhausted, entitlement to other sick leave, as defined by this Agreement and Education Code, will then be used.
12.6.4.2 If a unit member continues to receive temporary disability indemnity, the unit member shall be entitled to use only such of the unit member’s accumulated sick leave, or other available leave that when added to the temporary disability indemnity award will result in no more than the unit member’s full salary.
12.6.4.3 Compensation for such leaves shall be paid in conformance with the Education Code.
Exhaustion of Leave. If a worker exhausts all available leave benefits and unpaid leave options but remains unable to return to work, such worker shall be placed on a reemployment list for a period of 39 months and paid any unused vacation. When available and able to provide a medical release, during the 39-month period, the person shall be employed in a vacant position in the class of the person’s previous assignment over all other available candidates except for a reemployment list established because of lack of work or lack of funds, in which case the person shall be listed in accordance with appropriate seniority regulations. Eligible workers may retire if they so desire. The District will provide reasonable accommodation in compliance with the Americans with Disabilities Act, if applicable.
Exhaustion of Leave. If an individual's sick leave has expired and that individual is ill or injured and under a medical doctor's care, then the individual shall have deducted from his/her regular salary the amount of the substitute's pay, up to a maximum of ten (10) days, and after the extended ten (10) days, then 1/190 of the individual's pay shall be withheld. If illness/injury absences occur other than District approved, 1/190 of the individual's pay shall be withheld up to, but not beyond, the end of the current school year.
Exhaustion of Leave. Disability Leave or Separation. If illness or disability continues beyond the time covered by earned sick leave, the employee may be granted a disability leave or a personal leave in accordance with the appropriate sections of this Agreement.
Exhaustion of Leave a. An employee who is absent from duty because of sickness or administratively approved emergency leave, and who has exhausted all leave entitlement and is still unable to return to duty, may use vacation, comp time or other available paid leave until it has been exhausted.
b. When all such entitlement has been exhausted, the employee shall be continued for twenty-two
Exhaustion of Leave. In the event that the SUPERINTENDENT suffers an illness or disability which requires her absence for a period of sixty (60) work (non-weekend) days beyond all vested and accumulated leave rights (vacation, sick leave and personal days) then, either party shall send notice that this contract may be terminated effective immediately. In that event, neither party shall be obligated to fulfill any of the provisions of this contract.
Exhaustion of Leave. Any eligible employee in the Division absent from duty by reason of illness or injury who has exhausted all of his/her accrued sick leave, compensatory time, vacation leave including current accrual, personal leave days, advanced sick leave, when applicable, and for sick leave bank days when applicable, and who thereafter does not return to duty, will receive no further compensation. · Racial Justice The parties will meet and discuss policies to promote racial justice. These discussions may include, but not be limited to, recruitment, training – including implicit bias training -- promotion, and maintaining a workplace where racial justice is encouraged. These discussions shall not be deemed collective bargaining, nor shall they be used with respect to any argument or in any proceeding concerning what is or isn’t a mandatory subject of bargaining. · Counter to Union Proposal 4: Add to Article 31 In any office with three (3) or more inspectors, one of those positions will be allocated as a supervisory inspector position. For purposes of this provision only, within the Chief States Attorney’s Office, an “office” shall be any bureau or unit, or set of bureaus or units, which is under the direction of a specific supervisory assistant state’s attorney.
Exhaustion of Leave. A person absent because of illness or accident shall for a period of five (5) months receive not less than the difference between his regular salary and the amount paid his substitute. The amount paid the substitute shall in all cases be less than the regular employee's salary. All sick leave, industrial leave, compensatory time, accrued vacation or other available leave that is due to the employee shall be used first.
