Fit for Work. (a) The Employer is responsible for providing a workplace that is safe and without risk to health for Employees, so far as is reasonably practicable.
(b) Each Employee is responsible for ensuring that they are fit to perform their duties without risk to the safety, health and well-being of themselves and others within the workplace. This responsibility includes compliance with reasonable measures put in place by the Employer and any related occupational health and safety requirements.

(c) In the event the Employee’s manager forms a reasonable belief as defined at subclause 63.1(d) below that an Employee may be unfit to perform their duties, the manager will discuss their concerns with the Employee in a timely manner to promote physical, mental and emotional health so that employees can safely undertake and sustain work.
(d) In this clause reasonable belief means a belief based on sufficient evidence that supports a conclusion on the balance of probabilities.
(e) In this clause treating medical practitioner may, where relevant, also include programs such as the Nursing and Midwifery Health Program Victoria, or a psychologist.
(f) The Employer will:
(i) take all reasonable steps to give the Employee an opportunity to answer any concerns;
(ii) recognise the Employee’s right to have a representative, including a Union representative, at any time when meeting with the Employer;
(iii) genuinely consider the Employee’s response with a view to promoting physical, mental and emotional health so that employees can safely undertake and sustain work; and
(iv) take these responses into account in considering whether reasonable adjustments can be made in order that the employee can safely undertake and sustain work.
(g) Where, after discussion with the Employee, the Employer continues to have a reasonable belief that the Employee is unfit to perform the duties, the Employer may request the Employee’s consent to obtain a report from the Employee’s treating medical practitioner regarding the Employee’s fitness for work. The Employee will advise the Employer of the Employee’s treating medical practitioner, and the Employer will provide to the Employee, in writing, the concerns that form the basis of the reasonable belief to assist and a copy of any correspondence to the Employee’s treating medical practitioner.
(h) The Employee will provide a copy of the report to the Employer.
(i) The Employer and Employee will meet to discuss any report.

(b) Each Doctor is responsible for ensuring that they are fit to perform their duties without risk to the safety, health and well-being of themselves and others within the workplace. This responsibility includes compliance with reasonable measures put in place by the Health Service and any related occupational health and safety requirements.
(c) In the event the Doctor’s Employer forms a reasonable belief as defined at subclause (d) below that a Doctor may be unfit to perform their duties, the Health Service will discuss their concerns with the Doctor in a timely manner to promote physical, mental and emotional health so that employees can safely undertake and sustain work.
Fit for Work. 24.1 Epworth is responsible for providing a workplace that is safe and without risk to health for Employees, so far as is reasonably practicable.
24.2 Each Employee is responsible for ensuring that they are fit to perform their duties without risk to the safety, health and well-being of themselves and others within the workplace. This responsibility includes compliance with reasonable measures put in place by Epworth and any related Occupational Health and Safety requirements.
24.3 In the event that Epworth forms a reasonable belief an Employee may be unfit to perform the inherent requirements of their role, the Employee’s manager will discuss their concerns with the Employee in a timely manner to promote physical, mental and emotional health so that Employees can safely undertake and sustain work.
Fit for Work. 7.3.1 The Employer is committed to promoting the safety, health and wellbeing of its employees and it is every employee’s responsibility to be fit for duty.
7.3.2 The Employer has a Fit for Duty procedure which includes effective strategies for the identification and management of factors such as fatigue, fitness for work, drugs and alcohol which will include, without limitation, the use of the Standards Australia approved evaluation methods, including the use of oral swab testing. Consultation with the Health & Safety Committee as to the operation and effectiveness of the Fit for Work procedure may be undertaken during the life of the Agreement. For clarity, any consultation provided for in this clause shall not limit the ability of the Employer to determine its Fitness for Work requirements according to good practice and legal requirements.
7.3.3 Employees will notify their supervisor or manager if they are injured, ill, or are taking prescribed medication that may affect their ability to perform their normal duties (for example, operating plant or machinery, or have a sprain or strain that may be exacerbated performing manual tasks). Such information will be treated confidentially.
7.3.4 Employees will participate in health surveillance, monitoring, and checks as required. These will include immunisations (Hepatitis A, B, tetanus) both pre and during employment, medicals (both pre- employment and periodic), audiometric checks, spirometry checks. Programs will be developed in consultation with workers, and communication will be provided throughout the programs. Results will be treated confidentially.
7.3.5 Employees are required to notify the Employer immediately if they believe they have contracted an illness that may compromise the potable water supply. Examples are: Gastroenteritis, Diarrhoea, Hepatitis
7.3.6 Employees who display such symptoms will be unable to work on projects or tasks that may have a direct impact upon the potable water supply.
7.3.7 If an employee become injured or ill in the workplace (including in transit between jobs), or in transit to or from home to work, they must immediately report this to their supervisor or manager.
7.3.8 Employees must participate in Rehabilitation and Return to Work programs. Such programs will be developed in consultation with the employee, their supervisor or manager, the employee's treating medical professional, and the workplace's Rehabilitation Consultant (qualified)
Fit for Work. 35.1 It is a condition of employment that employees are fit for work when they report for duty and that they comply fully with Pacific National Queensland Coal's policies in this regard. This includes a requirement that employees submit to an assessment of their fitness for work upon request. This may include fatigue, drug and alcohol testing in accordance with policy.
35.2 Pacific National Queensland Coal is committed to providing a safe, healthy and productive work environment for its employees. Pacific National Queensland Coal recognises that the misuse or abuse of alcohol and other drugs, or engaging in any illegal activities in the workplace, can seriously affect workplace safety, work performance and conduct. To achieve the highest safety performance standards Pacific National Queensland Coal requires all employees and contractors to be free from the influence of alcohol and other drugs (as defined below) when presenting themselves for work and while at work.
35.3 Employees must not use, misuse or abuse alcohol or other drugs (legal or illegal) at work, or arrive at or resume work under the influence of such substances. An alcohol and drug testing procedure, including appropriate confidentiality standards, will be implemented by Pacific National Queensland Coal. All employees and contractors must comply with this policy.
35.4 Pacific National Queensland Coal applies a no smoking policy which requires all employees, customers, contractors and visitors not to smoke in any of the Pacific National Queensland Coal's workplaces. Employees who breach this provision will be subject to counselling and/or disciplinary action.

Fit for Work. 7.1. Employees are responsible for ensuring that they are Fit to Work to undertake their duties before commencing, and during, their work each day. This includes having had sufficient sleep and being rested, alert and focused on their duties.
