Formal Level Two. In the event a grievance has not been satisfactorily resolved at Level One, the Association may file a copy of the grievance with the Superintendent within ten (10) days of the administrator’s written response at Level One. Within seven (7) days after such written grievance is filed, the grievant, the Association, and the Superintendent shall meet to consider the grievance. The Superintendent shall respond within ten (10) days of such meeting in writing to the grievant and the Association.

Formal Level Two. If the grievance is not resolved after formal level one, the grievant must, within ten (10) days of the response to formal level one, request formal mediation. Notice that the grievance is being referred to mediation shall be provided to Director, Human Resources/Labor Relations or designee. The mediator shall be from a mutually agreed upon pool of mediators. The mediator shall be assigned based on availability by the Director, Human Resources/Labor Relations and the CSEA Labor Relations Representative, or designees. The mediator shall attempt to resolve the dispute and assist the parties in reducing the resolution to writing. If no resolution is reached within a reasonable time period, the mediator shall issue notice to the parties that level two has been concluded.
Formal Level Two. If the grievance remains unsettled, it shall be presented in writing to the Superintendent of Schools: in the event that the Superintendent is the immediate supervisor of the grievant(s), this step will be waived, and the grievance will proceed to the next step (7.2d below). The Superintendent will date and sign the grievance, and within seven (7) working days render a disposition in writing, a copy of which shall be sent to the grievant, and a copy of which shall be sent to the Union.
Formal Level Two. 6.2.3.1 If the grievance is not settled satisfactorily at Formal Level One, it may be appealed to the Superintendent Chief Learning Officer or designee within ten (10) working days of receipt of the Formal Level One response by the Supervisor. Within five (5) days of receipt of appeal from Formal Level One, the Superintendent Chief Learning Officer or designee shall cause a conference to be held, unless the parties have agreed otherwise. The grievant and the District may have other representatives participate in the conference. It is the intent of the parties to arrive at an equitable settlement of all Formal Level One grievances; therefore, the evidence presented at the Formal Level Two conference will include the complete evidence including all supporting documents of testimony of each party. 6.2.3.2 A written deposition of the grievance shall be given by the Superintendent Chief Learning Officer or designee to the grievant within five (5) working days following the conference, or within ten (10) working days of receipt of the grievance. A copy shall simultaneously be sent to the Association President.
Formal Level Two. If the grievance is not disposed of at Formal Level One, or if no decision is rendered by the principal within ten (10) days after the grievance is presented, the grievance may be submitted in writing to the Superintendent or his designee within seven (7) days after the principal's decision is or should have been communicated to the Union. The Superintendent or his designee shall conduct a formal grievance hearing within ten (10) days from the date the written grievance was presented to the Superintendent or his designee. Within five (5) days after the conclusion of the hearing, a written decision on the grievance will be presented to the parties.
Formal Level Two. Within 10 days of the informal meeting, the employee shall file a grievance form with the Superintendent or designee. The employee shall use the Grievance Form(s) included as Appendix C.
Formal Level Two. If the grievant is not satisfied with the disposition of the grievance at Formal Level One, or if no response has been rendered by the immediate supervisor within the time limits specified for the response at Formal Level One, the grievant has until the earlier of (a) ten (10) days following the last day on which the response at Formal Level One is due, or (b) ten (10) days following the date of the response at Formal Level One, to file the grievance in writing with the appropriate Cabinet level Administrator. The grievance shall specify the Article and Section of the contract allegedly violated, the circumstances involved, the decision rendered at Formal Level One and why it is not satisfactory, and the specific relief sought. If the grievance fails to specify this information, it shall not be entitled to processing at any time, shall not proceed to arbitration, except in accordance with Section 6.8 below, and shall be deemed withdrawn. The Cabinet Level Administrator shall respond in writing within twelve (12) days after receipt of the Formal Level Two Grievance.

Formal Level Two. 1. If the grievant is not satisfied with the disposition of the grievance or if no disposition has been made within seven (7) school days, the grievant shall file the grievance with the superintendent or his/her designee within seven (7) school days after receipt of the disposition at Formal Level One. The grievance form shall be handed to the superintendent or his/her designee in person. 2. Within eight (8) school days after receipt of the grievance form, the superintendent will meet with the grievant in an effort to resolve the alleged grievance. 3. Within seven (7) school days from the meeting with the grievant, the superintendent will render a decision.
Formal Level Two. If the grievant is not satisfied with the decision concerning a grievance at Level One, the grievant may, within five (5) working days after the decision is rendered, refer such grievance in writing on a Level Two grievance form to the Executive Director of Human Resources. The Executive Director of Human Resources will, within five (5) working days from the receipt of the written grievance, schedule a meeting with the grievant for the purpose of resolving the grievance. The Executive Director of Human Resources will, within five (5) working days after the meeting with the grievant, render a decision in writing to the grievant.

The grievance shall contain the following minimum information: b. The bargaining unit member's name. c. The date of the filing. d. The date of the alleged violation. e. The specific article(s) and/or section(s) of the Agreement which are claimed to have been violated. f. Brief synopsis of the informal conference. g. The specific relief requested. 2. Grievances not containing the minimum information shall be rejected as being improperly filed and may be denied. 3. Within ten days of receipt of the grievance by the supervisor or within ten days of a formal conference, if one is requested, a written decision should be issued to the grievant. If a written decision is not issued within the time limit or the grievance is denied, then the grievant may appeal to the next level.
