Higher Duties/Mixed Functions. (a) When a Senior Lifeguard is requested to act, and acts, as an Aquatic Supervisor for a minimum of 4 hours, they will be paid the minimum salary rate for the higher classification for all the time so worked. (b) When an employee is performing Higher Duties in all other situations, they will be paid the minimum salary for the higher classification, when it is deemed the relieving employee is directed to perform the whole or substantially the whole of the position they are relieving. (c) In situations when it is deemed the relieving employee is not performing the whole or substantially the whole of the position they are relieving, a commensurate rate of pay will be negotiated between the employer and the employee. (d) Casual employees required to perform additional responsibilities in a supervisory role shall be paid an 8% loading on their base salary for hours worked. (e) Where an employee acts in a position of higher level for an accumulated period of 6 months within a 12 month period, the period of approved leave taken shall be paid at the higher rate, provided such leave is actually taken within the period of acting up. (f) This clause applies to the performance of duties supplementing those of an employee or employees in a higher paid classification, as well as to duties performed in relieving such a person on sick leave, annual leave, etc. (g) Any dispute as to whether an employee is substantially performing the duties of a higher classification, or whether a wage rate is commensurate with the value of duties performed outside or exceeding those of the classification to which an employee has been appointed, shall be dealt with in the first place through discussion between the Corporation and the Union, and if agreement cannot be reached, then the matter shall be determined in accordance with the Dispute Settlement Procedure.

Higher Duties/Mixed Functions. 36.6.1 Where the team member is required by the Employer to work higher duties within the same department, for two or more hours of one day on duties carrying a higher rate than their ordinary classification must be paid the higher rate for such day. If for less than two hours the Employee must be paid the higher rate for the time so worked. 36.6.2 The provisions of this Clause do not apply to acting management positions, where in such positions the team member is paid the acting management rate of pay set out in Schedule 3.1.2

An employee directed by their employer to perform duties of higher value exceeding the classification grades of the Award but inclusive of grades in this EBA (ie Grades 9 – 14 inclusive) shall be paid in accordance with the Higher Duties conditions of the Award provided that the employee directed to perform such duties will perform them on the first occasion for a continuous period of two working days or more, and on any other occasion, subsequent to having performed those duties for the aforesaid period, for one working day or more, in order to become entitled to higher duties pay as aforesaid. 5.9.2. B.2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.

  • Higher Duties 29.1 Where an Employee on any one day performs two or more classes of work to which different rates of pay are applicable, the Employer shall pay to the Employee the higher hourly rate for the entire day if the Employee is required to work in that class of work for more than 2 hours, and if for less than 2 hours during any one day the Employee will be paid the higher rate for the time so worked.

  • Operations Support Systems Functions 9.1 Effective as of February 8, 2021, notwithstanding any other term or condition of the Amended Agreement or a Verizon tariff or SGAT, and subject to the transitional provisions set forth in Subsection 9.2 below, unbundled access to Operations Support Systems Functions will not be available from Verizon on or after February 8, 2021, except when such functions are used to manage other UNEs that remain available from Verizon, local interconnection, or local number portability. 9.2 Any unbundled access to Operations Support System Functions eliminated pursuant to Section 9.1 above will continue to be provisioned for the period in which unbundled access is available to the UNE managed through the use of such functions, but not after such period.

  • Responsibilities of the Contractor The Contractor shall provide all technical and professional expertise, knowledge, management, and other resources required for accomplishing all aspects of the tasks and associated activities identified in the Scope of Work. In the event that the need arises for the Contractor to perform services beyond those stated in the Scope of Work, the Contractor and the City shall negotiate mutually agreeable terms and compensation for completing the additional services.
