HIRING, VACANCIES, PROMOTIONS AND TRANSFERS. A. The Board recognizes that it is desirable in making assignments to consider the interest and aspirations of its teachers and in the best interest of students. Requests by a teacher for a transfer to a different class or position shall be made in writing one copy of which shall be filed with the superintendent and one copy shall be filed with the Association. The application shall set forth the reasons for the transfer, the grade or position sought and the applicant’s academic qualifications. Such request shall be renewed once each year to assure active consideration by the Board.

Transfers shall be defined as either a voluntary or involuntary move from one position to another within the bargaining unit, including grade/level and subject area moves as well as changes in buildings. Transfers to vacancies shall be governed by the language pertaining to vacancies. B. A vacancy is a position that remains unfilled after all assignments are made. On vacant teaching and/or Schedule B positions, notices of such vacancies shall be posted electronically at least five working days prior to any external advertising of the vacancy. Employees may sign a written request at the central office each contract year to receive a copy placed in their school mailbox during the school year and mailed to their last address on file during the summer. Said notification may be simultaneously sent to the Association President, staff members certified for the vacancy and to the public when the vacancy occurs after July 15th of any year. 1. Employees notified as designated in paragraph B shall have the responsibility of contacting the Superintendent, indicating their interest in the said position, within five calendar days of such notification. Such position may not be filled in less than five (5) calendar days of the postmarked date by other than certified district employees.

In filling available positions, vacancies and transfers, the Employer will consider professional qualifications, background and experience, instructional and accrediting requirements, the No Child Left Behind Act of 2001, as amended, service to the school district, professional preference of teachers, the best interests of pupils and the school district, and other relevant factors as they relate to all applicants from within the school district and outside the school district. All things being equal, the preference will go to the internal candidate with the greatest length of service to the District.

The Superintendent shall notify the affected teacher(s) in writing of reason(s) for the transfer with a copy to the Association.

Long-Term Vacancies – those vacancies that occur after the start of the school year, and it is known that they will last until the end of the school year. Long-term vacancies shall be filled by laid-off members of the bargaining unit based on their certification, seniority, and experience. a. In the event that the lay-off list fails to yield a teacher with the proper certification to fill a vacancy, then an involuntary transfer of a certified teacher to fill the vacancy may be made for the balance of the school year. 1. If two (2) or more teachers desire the transfer, then the most senior teacher shall be assigned to the position. 2. If no teacher desires to make the transfer, then the least senior teacher shall be transferred. 3. In the event the vacancy cannot be filled from the lay-off list or by involuntary transfer, it shall be filled at the discretion of the Board.

The term “days” as used herein shall mean days in which school is in session, except during summer break when “days” shall refer to the actual days of the week, excluding legal holidays.
HIRING, VACANCIES, PROMOTIONS AND TRANSFERS. A vacancy shall be defined for the purpose of this contract as a position newly created by the Board that is covered by this Agreement, or a position that has been declared vacant, when the District has made all assignments needed to fill the academic need of the District with incumbent teachers who are certified and qualified for the assignments and who are able to perform the work at the start of the assignment, and there are still more assignments open than teachers to do the work.
