MANAGEMENT’S FUNCTIONS. 5.1 The Union recognizes the right of the Employer to manage its operation and to direct its work force, including the right to hire, classify, promote, transfer, demote and lay-off employees and to suspend, discharge or otherwise discipline employees for just cause subject to the right of any employee to lodge a grievance in the manner and to the extent as herein provided. 5.2 The Union further recognizes the right of the Employer to operate and manage its business in all respects and to make and alter from time to time rules and regulations to be observed by employees, which rules and regulations shall be neither unreasonable nor inconsistent with the provisions of this Agreement.

MANAGEMENT’S FUNCTIONS. 3.01 The Employer shall be entitled to exer- cise all of the customary rights of management and without limiting the generality of the fore- going, management functions shall include: (a) the right to maintain order, discipline, and efficiency and in connection therewith to make, alter and enforce from time to time rules and regulations, policies and practices to be observed by its employees; (b) the right to discipline or discharge employ- ees for just cause provided that a claim for unjust discipline or discharge may be the subject matter of a grievance and dealt with as hereinafter provided; (c) the right to select, hire, transfer, assign to shifts, promote, demote, classify, lay-off, recall employees, and select employees for positions excluded from the bargaining unit; (d) the right to determine the locations of op- erations and their expansion or their cur- tailment; (e) the right to direct working forces, to sub- contract work, to schedule operations, the number of shifts, the methods, processes and means of production, to determine job content, quality and quantity standards; (f) the right to use improved methods, machin- ery and equipment; (g) the right to decide on the number of em- ployees needed by the Employer at any time, the number of hours to be worked, starting and quitting times; (h) the right to determine financial policies, in- cluding general accounting procedures and customer relations; and (i) the sole and exclusive jurisdiction over all operations, buildings, machinery, equip- ment and employees. 3.02 The Employer agrees that it will not exercise its functions in a manner inconsistent with the provisions of this Agreement.

MANAGEMENT’S FUNCTIONS. The management of the operations of the Employer and the direction of its employees shall continue to be vested in the Employer including, without limiting the generality of the foregoing, the right to hire, discharge, transfer, promote, demote and discipline employees, subject to the terms of this Agreement and the right of the Union and/or the employee concerned to lodge a grievance in the manner herein provided.
MANAGEMENT’S FUNCTIONS. 4.01 The Union recognizes and acknowledges that the Management of the Store and direction of the working force are fixed exclusively in the Employer and, without restricting the generality of the foregoing, the Union acknowledges that it is the exclusive function of the Employer to: a) maintain order and efficiency; b) hire, promote, demote, classify, transfer, layoff and retire employees; c) discharge, suspend, or otherwise discipline employees, provided that employees shall only be discharged, suspended or otherwise disciplined for just cause. The standard of just cause for discharge of a probationary employee is limited to whether the Company's decision was arbitrary, in bad faith or for discriminatory reasons; d) make, enforce and alter from time to time, reasonable rules and regulations to be observed by the employees; e) determine the nature and kinds of business to be conducted by the Company, the products to be sold, the kinds and locations of equipment and supplies to be used and the methods and techniques of work to be used; f) extend, limit, curtail or cessate operations or any part thereof; g) develop and implement job evaluations systems and performance rating systems; h) determine the number of employees to be employed, the hours to be scheduled, starting and stopping times, and when overtime is required; i) determine all methods of selling, marketing, distributing, merchandising and advertising of products, including pricing of products.

(b) the right to select, hire, transfer, assign to shifts, promote, demote, classify, lay-off, recall employees and select employees for positions excluded from the bargaining unit. (c) the right to determine the location of operations and their expansion or their curtailment, the direction of working forces, the schedules of operations, the number of shifts, the methods, processes and means of production, job content, quality and quantity of standards, the right to use improved methods, machinery and equipment, the right to decide on the number of employees needed by the Employer at any time, the number of hours to be worked, starting and quitting times, the determination of financial policies including general accounting procedures and customer relations, are solely and exclusively the responsibility of the Employer. (d) the sole and exclusive jurisdiction over all operations, buildings, machinery, equipment and employees shall be vested in the Employer. (e) the Employer agrees that it will not exercise its functions in a manner inconsistent with the provisions of this agreement. 3.02 The exercise of any of the above rights may be the subject matter of a grievance and/or arbitration as provided in this Agreement.

  • MANAGEMENT FUNCTIONS B.1 The Association recognizes that the management of the Hospital and the direction of working forces are fixed exclusively in the Hospital and shall remain solely with the Hospital except as specifically limited by the provisions of this Agreement and, without restricting the generality of the foregoing, the Association acknowledges that it is the exclusive function of the Hospital to: (a) maintain order, discipline and efficiency; (b) hire, assign, retire, discharge, direct, promote, demote, classify, transfer, lay- off, recall, and suspend or otherwise discipline nurses, provided that a claim of discharge or discipline without just cause may be the subject of a grievance and dealt with as hereinafter provided; (c) determine, in the interest of efficient operation and high standards of service, job rating and classification, the hours of work, work assignments, methods of doing the work, and the working establishment for the service; (d) generally to manage the operation that the Hospital is engaged in and, without restricting the generality of the foregoing, to determine the number of personnel required, methods, procedures, and equipment in connection therewith; (e) make, enforce, and alter from time to time reasonable rules and regulations to be observed by the nurses which are not inconsistent with the provisions of this Agreement. B.2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.

  • MIXED FUNCTIONS An employee engaged for more than two hours during one day or shift on duties carrying a higher rate than his or her ordinary classification shall be paid the higher rate for such day or shift. If for two hours or less during one day or shift he or she shall be paid the higher rate for the time so worked.

  • CUSTOMER SERVICE FUNCTIONS The Servicer shall handle all Customer inquiries and other Customer service matters according to the same procedures it uses to service Customers with respect to its own charges.

  • LABOUR MANAGEMENT RELATIONS 9:01 No employee or group of employees shall undertake to represent the Union at meetings with the Employer without the proper authorization of the Union. The Employer shall not meet with any employee or group of employees undertaking to represent the Union without the proper authorization of the Union. In representing an employee or group of employees, a representative of the Union shall be the spokesperson. In order that this may be carried out, the Union shall supply the Employer with the names of its Officers and representatives. Likewise the Employer shall supply the Union with a list of its Designated Authorities and Chairs where the Chair is not the Designated Authority. Neither the Union nor the Employer shall be required to recognize such representatives until written notification has been received. 9:02 The Union and the Employer acknowledge the mutual benefit of joint consultation and agree, therefore, that there shall be a joint labour/management committee consisting of three (3) representatives from and selected by each party. There shall be one (1) regularly scheduled Labour/Management Committee meeting in each four (4) month term or semester (January to April, May to August, September to December). In addition, meetings shall be arranged at the request of either party through the Labour Relations Department, by submitting in writing the topics to be discussed. Such meetings shall take place, at a mutually-agreeable time, within ten (10) working days of the receipt of the request for the meeting. Meetings shall not be used to discuss matters which are the subject of a grievance nor to discuss any matters which are, at the time, the subject of collective bargaining. The committee shall function in an advisory capacity only, making recommendations to the Union and/or the Employer with respect to its discussions and conclusions, and shall not have the power to add to or modify the terms of this agreement. A representative of each party shall be designated Co-Chairperson, and the two persons so designated shall alternate in presiding over meetings.

  • FUNCTIONS OF MANAGEMENT 4.01 The Union agrees that the Employer has the exclusive right and power to manage its business to direct the working forces and to suspend, discharge or discipline employees for just and sufficient cause, to hire, promote, demote, transfer or lay-off employees, to establish and maintain reasonable rules and regulations covering the operation of the stores, provided however, that any exercise of these rights and powers in conflict with any of the provisions of this Agreement shall be subject to the provisions of the Grievance Procedure as set out herein. 4.02 It is agreed that the direction of the working force shall be at the discretion of the Employer within the terms of this Agreement.
