NO-STRIKE NO-LOCKOUT PLEDGE. The Union and the Board subscribe on the principle that any and all differences shall be resolved by peaceful and appropriate means without interruption of the College program. The Union therefore agrees that it will not instigate, engage in, support, encourage, or condone any strike, work stoppage, or other concerted refusal to perform work by the employees covered by this Agreement. The Board agrees that it will not resort to lockouts. Differences between the parties concerning the meaning, interpretation or application of this Agreement shall be resolved by utilization of the arbitration procedure as set forth in Article XIV hereof or by other lawful and peaceful means available under the law of Illinois. If either party violates this Article, the other party is released from all obligations under this Agreement and may resort to whatever remedies are available to it under applicable law without first resorting to arbitration. The Board retains its prerogative under the law to take disciplinary action, including dismissal, against individual employees who violate this Article.

Section 2 - Discipline for Violation of No Strike Pledge: Individual employees or groups of employees who instigate, aid, or engage in a work stoppage, slowdown, strike, or sympathy strike may be disciplined or discharged in the sole discretion of the Employer. It is understood that any question as to whether an employee or employees were, in fact, engaged in such proscribed activity may be resolved through the grievance procedure.

The Association and the District subscribe to the principle that differences shall be resolved by peaceful and appropriate means without interruption of the District operations. The Association, therefore, agrees there shall be no strikes or other concerted refusal to work, nor any instigation thereof, by the employees. The Association further agrees not to honor, or to encourage employees in the bargaining unit to honor any strikes, picket lines, or other concerted work stoppages that may be established by any other District employee organization. NO-STRIKE NO-LOCKOUT PLEDGE. 1. There shall be no strike, stoppage or lockout during the term of this agreement, but work shall proceed in operation pending the determination of any complaint, dispute or grievance as hereinafter provided. This provision, however, shall not apply in cases where wages, earnings, overtime or holiday pay or benefit fund contributions are not paid to workers on their due date, or where a joint decision of the managers of Local 23-25 and/or Local 10 and the Association, respectively, or their deputies, or a decision of the Impartial Chairman, has not been complied with within twenty-four (24) hours after rendition, or where an Employer is deemed to be in non-compliance under the express terms of any other provision of this agreement.
