Operations and Maintenance Procedures. Without in any way limiting Seller’s obligations pursuant to this Section 4.2, Seller shall perform all operations and maintenance work in accordance with the provisions of Schedule 4.2 attached hereto.
Operations and Maintenance Procedures a. Contractor shall be responsible for establishing operations and maintenance procedures for the EHDMS. Contractor shall provide the necessary documentation and procedures to support HCA's operations of the EHDMS on a 24/7 basis. Contractor shall perform the following:
1) Maintain the EHDMS program code to provide the functionality defined in functional requirements.
2) Distribute any software upgrades or version replacements to which HCA is entitled under the software license along with updated user and operational documentation and assist in its installation in the test environment and migration to production.
3) Maintain comprehensive change control procedures to control software versions and releases; HCA should be notified formally of any intended changes.
4) Develop procedures for software distribution to HCA and its business partners who may be users of the system including any application server software and any client software (if needed).
5) Correct any errors in functionality that are reported by HCA or business partners that are identified by Contractor within a reasonable period, depending upon the severity of the error.
b. Contractor shall utilize the following Severity Index for categorizing and prioritizing application errors. Severity 1 - Application errors that cause: Problems in completing less than 10% of system processes. Problems having an immediate adverse impact to performing inventory processes. Disruption in service resulting in system unavailable for one (1) hour. Disruptions affecting HCA staff and our business partners. Severity 2 - Application errors that cause: Major operational impact, even if workarounds are available. Problems having an adverse impact to business within 24 hours. Problems affecting business partners from logging into the system.
1) For a Severity 1 problem, Contractor must acknowledge receipt of the problem report within one (1) hour, must be working on the problem within four (4) hours of initial report, and must fix the problem within twenty four (24) hours of initial report. Periodic status reports are required during this period.
2) For a Severity 2 problem, Contractor must acknowledge receipt of the problem report within one (1) hour, must be working on the problem by the next working day, and must have the problem corrected on a schedule to be negotiated with HCA. Periodic status reports are required during this period.

Operations and Maintenance Procedures. 4.1. The Customer shall promptly notify MCI-WorldCom in writing of the details of any third party with whom with the Customer has entered into an agreement for the grant of rights to any Unit of Capacity provided hereunder. Such details are to include:
4.1.1. identification of the relevant Unit of Capacity;
4.1.2. the address, telephone number and fax number of the third party's local network operations centre or equivalent; and
4.1.3. the name, title, address, telephone number and fax number of the appropriate contact person at that network operations centre or equivalent. MCI-WorldCom shall have no obligation to comply with the Operations and Maintenance Procedures in respect of the performance of Scheduled Maintenance and Emergency Works and the reporting and rectification of Faults in respect of such third party unless and until MCI-WorldCom has received written notification of the third party details in accordance with this Clause 4.1.
4.2. Subject to Clause 4.1, the parties shall comply, and the Customer shall procure the compliance of the EquiTel Customers, with the Operations and Maintenance Procedures in respect of the performance of Scheduled Maintenance and Emergency Works and the reporting and rectification of Faults.
4.3. MCI-WorldCom shall furnish the Capacity and shall cause the Capacity to be maintained in accordance with the terms of the C&MA.
Operations and Maintenance Procedures. (a) Activities in the vicinity of ACM or PACM which are unlikely to involve direct disturbance of ACM or PACM such as wiping, dusting or sweeping. Wet methods or wetting agents shall be used. HEPA vacuums should be used to sweep up any dust or debris.
(b) Where the disturbance involves drilling, cutting, abrading, sanding, chipping, breaking or sawing ACM or PACM, impermeable drop cloths and isolation methods such as mini-enclosures or glove bag systems must be used. The work area must be contained using a critical barrier or the operation must be isolated using a control system such as a negative pressure enclosure or glove bag. Provide appropriate respirators and protective clothing at no cost to employees to use while working in the areas of potential over exposure. Respirators must be equipped with HEPA filters.
(c) Asbestos Fiber Release Episodes (Involving more than three square or linear feet of ACM or PACM): Notification of asbestos program manager as soon as possible Isolation of the area by closing doors and/or erecting temporary barriers. Signs shall be posted immediately outside the fiber release site to prevent persons not involved in the clean up from entering. If necessary, the HVAC system shall be modified or shut down and sealed off. Thorough clean up procedures, careful visual inspection and final clearance air monitoring to verify satisfactory clean up. Documentation of how episode occurred, measurements taken and final verification of satisfactory clean-up shall be done.
Operations and Maintenance Procedures. JCC staff shall not perform operations and maintenance (O&M) procedures and work practices involving asbestos without the required asbestos training and written authorization from the Risk Management/Environmental Health and Safety Unit. Contract personnel engaged to perform O&M procedures and work practices are required to follow the elements of this section, as applicable, in addition to all applicable federal, state, and local regulations, standards, and codes governing asbestos management. Before performing work in a judicial branch facility of any age, materials must be tested for asbestos by a certified asbestos consultant. Otherwise, materials can be assumed to contain asbestos and handled in accordance with the appropriate work practices below.
Operations and Maintenance Procedures. Ongoing maintenance: The client will be not be required to perform any maintenance of the solution. We offer continuous support services to the client. These services include a Level 2 support desk, ongoing training as necessary, development of client specific documentation, monitoring and reporting, audit reports on quality of NCMS submissions, impact analysis and comparative trends. Additionally, to ensure successful expansion after deployment we provide continued education, workflow analysis, and workflow redesign.
