A predisciplinary meetings clause establishes a formal process for holding discussions between an employer and an employee before any disciplinary action is taken. Typically, this clause requires that the employee be informed of the concerns or allegations against them and be given an opportunity to respond or present their side of the story in a meeting. The core practical function of this clause is to ensure fairness and transparency in disciplinary procedures, helping to prevent misunderstandings and reduce the risk of unjust or arbitrary disciplinary actions.
Predisciplinary Meetings. Upon completion of an investigation and prior to a predisciplinary meeting with the Chief or his designee, a member will receive a written statement of charges. At the predisciplinary meeting, the charged bargaining unit member or his representative will be allowed to present his defense/response. Predisciplinary meetings will be conducted by the Chief or his representative selected by the Employer. The employee may choose to: A. Appear at the meeting to present oral or written statements in his/her defense; B. Or appear at the meeting and have one (1) chosen representative present oral or written statements in defense of the employee; or C. Elect in writing to waive the opportunity to have a predisciplinary meeting. Failure to elect and pursue one of these three options will be deemed a waiver of the employee's rights to predisciplinary meetings. At the predisciplinary meeting, the Employer representative will ask the employee or his representative to respond to the allegations of misconduct which were outlined to the employee. At the meeting, the employee may present any testimony, witnesses, or documents which explain whether or not the alleged misconduct occurred. The employee shall provide a list of witnesses and the name and occupation of his representative, if any, to the Employer as far in advance as possible, but no later than forty-eight (48) hours prior to the predisciplinary hearing. It is the employee's responsibility to notify his witnesses that he desires their attendance at the hearing. A written report will be prepared by the Employer representative. A copy of the representative's report will be provided to the employee, and the Union representative within five (5) days following its preparation. The Employer will decide what discipline, if any, is appropriate.
Predisciplinary Meetings. 1. Upon completion of an investigation and prior to a predisciplinary hearing with the Director of Public Safety, a member will receive a written statement of charges and specifications. At the hearing, the charged Bargaining Unit member will beallowed to present a rebuttal/defense. 2. A Bargaining Unit member who is charged may make written request to the employer to review their own personnel file. Such request will be granted without unreasonable delay by the employer in the case of a pending predisciplinary hearing. 3. A member who is charged, or the member’s representative, may make a written request for a continuance prior to the meeting. Such request will be granted where practical. The length of such continuance shall be mutually agreed upon. If the parties fail to agree to a new meeting date, the Employer may schedule the new date. 4. The Employer will notify the affected member of any charges or of any decision reached as a result of a predisciplinary hearing prior to any public statement.
Predisciplinary Meetings. 1. Prior to implementation of any disciplinary action, a bargaining unit faculty member will be provided with a predisciplinary meeting. a) The purpose of the predisciplinary meeting is to provide the bargaining unit faculty member an opportunity to respond to the allegations against them. The predisciplinary meeting is not an evidentiary hearing. b) Notice of the allegations against the bargaining unit faculty member will be provided to the bargaining unit faculty member no later than seven (7) calendar days prior to the predisciplinary meeting. Such notice will advise the bargaining unit faculty member of their right to be accompanied by a Union representative during the predisciplinary meeting. In the event of such request, the Employer shall grant the bargaining unit faculty member's request, provided that the unavailability of a Union representative shall not delay the predisciplinary meeting. c) Following the predisciplinary meeting, the bargaining unit faculty member will be given written notice of any disciplinary action to be imposed. A copy of the discipline shall be provided to the Union by U.S. mail and email within seven (7) calendar days of the issuance of the discipline. d) Bargaining unit faculty members may agree to waive this predisciplinary meeting and such waiver must be in writing. 2. In cases involving offenses that endanger the personal health, safety, and/or welfare of members of the university community, the Employer may immediately suspend a bargaining unit faculty member and place them on administrative leave with pay. The cases regarding which the Employer may take such action shall include, but not be limited to: possession of firearms or weapons on university property; the unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance on university property or as part of any university activity; failure to comply with the laws of the Commonwealth of Pennsylvania on the possession and consumption of alcohol; violating while on or in university facilities or vehicles, any municipal, county, state, or federal statute or ordinance; and any violation of the Employer's policies, procedures, and practices related to non-discrimination, equal opportunity, harassment, and/or sexual misconduct or any other relevant university policies.
