Program Participation Requirements. 6.1. Vendor shall have a working telephone at each site where child care is provided.
6.2. The Vendor shall comply with all applicable federal and state laws and regulations, including, but not limited to, laws and regulations related to the licensing of or exemptions therefrom of child care providers; state regulations, policies, and guidelines for the Child Care Subsidy Program as set forth by VDSS; state and local health and safety requirements related to child care providers; and Va. Code 63.2-1509 for the reporting of suspected abuse or neglect of a child. The Vendor shall be subject to at least one annual inspection by VDSS to ensure compliance with all such laws, regulations, and policies. Such inspection may be unannounced.
6.3. The Vendor shall keep all records, including but not limited to attendance and payment records, pertaining to the children receiving child care assistance up to date and accessible to VDSS. The Vendor must make payment records available to parents upon their request for payments made on behalf of their children.
6.4. The Vendor agrees to retain all books, records, and other documents relative to this Agreement for five (5) years after final payment for auditing purposes by any local, state or federal government agency. Failure to provide records may subject the Vendor to repayment of all subsidy monies received during the period of time in question. The Vendor agrees that VDSS, its authorized agent, and/or State, Federal and local fraud investigators and auditors shall have full access to and the right to examine and/or remove any said materials during said period. If an audit or investigation is begun before the five-year retention period ends, records must be kept until the completion of the audit. Should an audit by authorized state or federal officials result in disallowance of amounts previously paid to the Vendor, the Vendor shall reimburse the VDSS upon demand.
6.5. The Vendor shall allow parents of the children served unlimited access to their own children while under the Vendor's care.
6.6. The Vendor shall allow staff from VDSS and the local department of social services unlimited access to the children in care when the vendor has a current purchase of service order (POSO) for one or more children who receive child care assistance.
6.7. The Vendor shall notify the VDSS Division of Child Care and Early Childhood Development (CCECD) immediately at (000) 000-0000 if it ceases to operate at its physical address design...
Program Participation Requirements. In addition to work, the Program will include required enrichment and reflection exercises, excursions, field trips, as well as other activities that are germane to the Program. Student must participate in all such activities unless exempted by the Program Director.
Program Participation Requirements. (a) Requirements for use of Your Personal Sites, Your Radical Site URL and Your Radical Site. As an express condition to your participation in the Program, you agree to the following Program Participation Requirements with regard to the use of Your Personal Sites, Your Radical Site URL and Your Radical Site:
(i) You will not display or otherwise use our, or our service providers’, trademarks or logos except as expressly permitted under and in accordance with this Agreement;
(ii) You will use Your Radical Site solely in accordance with the terms of this Agreement and within the express scope of the license granted herein;
(iii) You will not engage in any promotional, marketing, or other advertising activities on behalf of us, or in connection with the Program, that are prohibited under this Agreement;
(iv) You will not use imply another person’s endorsement or sponsorship of, or commercial tie- in or other association with, any Radical Product or service (including by placing unrelated third party materials in close proximity to your Radical Site URL) without that person’s prior written permission;
(v) You will not offer any person or entity any consideration or incentive (including any money, rebate, discount, points, donation to charity or other organization, or other benefit) for using your Radical Site URL (e.g., by implementing any “rewards” or loyalty program that incentivizes persons or entities to visit Your Radical Site);
(vi) You will not make any orders or engage in other transactions of any kind on Your Radical Site on behalf of any other person or entity, or authorize, assist, or encourage any other person or entity to do so;
(vii) You will not take any action that could reasonably cause any Customer confusion as to our relationship with you, or as to the site on which any functions or transactions (e.g., search, browse, or order) are occurring;
(viii) You will not include on Your Personal Sites, display, or otherwise use your Radical Site URL in connection with any spyware, malware, virus, worm, Trojan horse, or other malicious or harmful code, or any software application not expressly and knowingly authorized by users prior to being downloaded or installed on their computer or other electronic device;
(ix) You will not post or serve your Radical Site URL or other content promoting Your Radical Site within any pop-up or pop-under windows, transitional page ads, or layer ads around or in conjunction with the display of any site that is not one ...
Program Participation Requirements. You must comply with the spirit and the letter of this Program as described in this agreement and our Program Policies, including without limitation, the Affiliate Marketing Program Participation Policy. You shall promptly provide us with the information that we request to verify your compliance with the terms of the Program. If you violate this agreement or the terms and conditions of any other agreement that you have with us, then, in addition to any rights and remedies that are available to us, we reserve the right to do any one or a combination of the following without advance notice to you:
a. suspend your participation in this Program;
b. withhold commission payments during your suspension period, whether such commissions were earned before or during your suspension period;
c. require the forfeiture of any commissions that have accrued to you during the period that you were in violation of this agreement, whether or not such commissions have been paid to you and even when the commissions were for sales that did not breach the terms of this agreement; and/or
d. deactivate your Program Account. Your liability for your breach of this agreement is not limited to the forfeiture of your commissions, and we reserve the right to recover the full extent of damages that you have caused to us as a result of your breach of this agreement.

Program Participation Requirements. The Electronic Recording program is defined by the requirements attached to this Agreement. Attachment A defines the technical specifications including format, transmission protocols, and security requirements for recording documents electronically Company agrees to provide the transmission to the Recorder following the specifications outlined in Attachment A. Company understands that the specifications may change from time to time. In the event changes to the specifications are required, the Recorder will provide a written notice to the Company, and Company will comply with new specifications within a reasonable timeframe. Attachment B contains the document and indexing specifications for the Electronic Recording program. For each document, the Recorder specific document code is provided along with the required indexing information. Any Recorder specific editing rules may also be described in this attachment. Attachment C contains the hours of operation for the Electronic Recording program. No party shall be liable for any failure to process transactions and documents pertaining to them when such failure results from any act of nature or extraordinary event beyond the party’s reasonable control (including, without limitation, any mechanical, electronic, or communications failure which prevents the parties from transmitting or receiving the electronic recording transactions). If the system used by the Recorder results in delays or power failures interfere with the normal course of business, the Recorder will notify the Company within a reasonable timeframe with a choice of using a courier service or waiting until the problem has been remedied. Attachment D provides the payment options supported for the Electronic Recording program.
