36.2 Unless the Chief Executive directs an employee to report for duty earlier, the employee must have a continuous period of eight hours off duty between ceasing overtime duty following normal duty one day, and commencing normal daily hours of work the following day.
36.3 An employee is entitled to be absent from duty, without loss of salary, until the employee has been off duty for a continuous period of eight hours. For this purpose, an employee is considered to be on duty while travelling to and from the workplace.
36.4 If an employee is required by the Chief Executive to return to duty without having had eight consecutive hours off duty, plus reasonable travelling time, the employee must:
(a) be paid at 200% of the ordinary hourly rate of pay until the employee is released from duty for that period; and
(b) the employee will then be entitled to be absent until the employee has had eight consecutive hours off duty plus reasonable travelling time, without loss of pay for any ordinary working time occurring during that absence.
36.5 The provisions of clauses 36.1 to 36.4 do not apply to overtime worked in the circumstances covered by Xxxxxx 41 Emergency Duty unless the actual time worked (excluding travelling time) is at least three hours on each call.

(2) This clause applies if an employee performs overtime that would result in the employee not having at least 8 consecutive hours off duty (plus reasonable travelling time to and from work):
(a) between the end of the ordinary duty on any day or shift, and the start of the employee’s ordinary hours of work on the next day or shift; or
(b) on a Saturday, Sunday or a public holiday (unless the day is an ordinary working day for the employee) or on a rostered day off, in the 24 hours preceding the time when the employee will next ordinarily begin duty.
(3) The employee:
(a) may be absent from work, after performing the overtime, for 8 consecutive hours (plus reasonable travelling time); and
(b) is entitled to payment for any period of ordinary working time occurring in the employee’s absence.
(4) However, if the employee is not able to be absent from work because the employee is required to continue or resume work, the employee is entitled to be paid at the rate of double time until the employee has at least 8 consecutive hours off duty (plus reasonable travelling time).
Rest Relief after Overtime. Employees are entitled to a break of at least eight consecutive hours, plus reasonable travelling time, between the time they finished duty (including overtime worked after a period of ordinary duty) and the time they are next required to commence ordinary duty, without loss of pay. Where this break is not possible due to business needs, the employee will be paid at double ordinary time rates for any period of work until an eight-hour break occurs.

Rest Relief after Overtime. An employee who works so much overtime between the termination of their ordinary duty on one day and the commencement of their ordinary duty on the next day that the employee has not had at least eight consecutive hours off duty between those times, will, subject to this clause, be released after completion of such overtime until the employee has had eight consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. Reasonable travelling time, in addition to the eight hours off duty, will be allowed to cover time taken in travelling from and to the employee’s place of employment.
Rest Relief after Overtime. Where an employee has worked overtime and has not had a break of at least eight hours, plus reasonable travelling time between home and the workplace:
a. between the end of normal duty on any day or shift and the beginning of normal duty on the next day or shift; or
b. on a Saturday, Sunday or a public holiday (not being a normal working day or on a rostered day off), in the 24 hours preceding normal starting time on the employee’s next ordinary day or shift; the employee must have a break, following overtime, of at least eight hours, plus reasonable travelling time between home and the workplace, and will suffer no loss of pay for normal working time that occurs during the employee’s absence.

Rest Relief after Overtime. An employee who works so much overtime that the employee has not had at least eight (8) consecutive hours off duty, plus reasonable travelling time:
a) between the termination of the employee’s ordinary duty on any day or shift, and the commencement of the employee’s ordinary work on the next day or shift; or
b) on a Saturday, Sunday or a public holiday not being an ordinary working day, or on a rostered day off, in the twenty-four hours preceding the employee’s ordinary commencing time on the employee’s next ordinary day or shift; will be granted time off under clause 2.15.15.
Rest Relief after Overtime. 2.5.1 An employee who works so much overtime between the termination of their ordinary duty on one day and the commencement of their ordinary duty on the next day that the employee has not had at least eight consecutive hours off duty between those times, will, subject to this clause, be released after completion of such overtime until the employee has had eight consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. Reasonable travelling time, in addition to the eight hours off duty, will be allowed to cover time taken in travelling from and to the employee’s place of employment.
2.5.2 Provided that if such an employee is required to resume or continue work without having had eight consecutive hours off duty plus reasonable travelling time, the employee will be paid at double rate until the employee is released from duty for such period and the employee will then be entitled to be absent until the employee has had eight consecutive hours off duty plus reasonable travelling time, without loss of pay for ordinary working time occurring during that absence.
2.5.3 The provisions of clause 2.5.3 will not apply to overtime worked in the circumstances covered by clause 56 (Emergency Duty) unless the actual time worked (excluding travelling time) is at least three hours on each call.
2.5.4 The provisions of this clause will apply only to employees who are eligible for overtime payment pursuant to clauses 55.4 and clauses 64 (Overtime day worker) or 70 (Overtime shiftworker).
2.5.5 Provided that in lieu of clause 56 (Emergency Duty) the provisions of this clause will apply.
