The parties agree these freight loads and/or LTL freight loads assigned to an LHD will be converted to a scheduled run covered by a Road Driver if the two (2) way movements are sufficient to constitute a full-time job; occur for at least four (4) consecutive weeks; and can meet all customer and service commitments. Road Drivers. Any driver that does not get dispatched dur- ing his/her bid (day or night) can exercise his/her seniority for a load on the other dispatch. Example: A Day Driver does not get out because of a lack of dispatches. He/she can take a spot on the night dispatch, dove- tailing where his/her seniority will put him/her. Once the driver moves, he/she stays on the new shift the rest of the week. The junior driver on the shift he/she goes to is bumped to the other shift the rest of the week. The employee not getting dispatched does not have to exercise this option. He/she can hold his/her position for the next day if business permits.

Road Drivers. (1) Road Drivers guarantees will be protected as long as the Employer utilizes any subcontracting or other modes of transportation during the life of this Agreement. Road drivers will be given a daily guarantee if work in the road classification is not offiered.
(2) Road Drivers daily guarantee will be set at fifty-six (56) miles per hour on an eight (8) hour day times the applicable mileage wage in effect. Such guarantee will be utilized in the Road Driver classification when performing road work. (Shuttle and
(3) drayage work shall not count as road work for the purposes of determining if a road driver has met the guarantee.) Road drivers will be guaranteed and the Company’s obligation to a road driver will be behind the wheel for eight (8) hours or more, such runs may include drop/hooks, fueling, or on property road work (inclusive of the run), once the above has been met the employer’s obligation has been met in this section. No road driver will be obligated to work the dock or jockey positions unless otherwise provided in this Agreement.
(4) The Employer’s current mini-hub operation may continue at ratification. Any future expansion of the Employer’s mini-hub operation must be approved by TNFINC.
Road Drivers. When a death occurs in a regular employee’s immediate family, such employee will be granted upon request, a period of three (3) working days’ time off for bereavement leave to be taken within the period from the date of death to the day after the funeral. Pay for bereavement leave will be 1/20th per day of the wages he has earned during the thirty (30) calendar days immediately preceding the bereavement leave. Immediate family is defined as: The employee’s spouse or common-law partner; the employee’s father and mother and the spouse or common-law partner of the father or mother; the employee’s child(ren) and the child(ren) of the employee’s spouse or common-law partner; the employee’s grandchild(ren); the employee’s brothers and sisters; the grandfather and grandmother of the employee; the father and mother of the spouse or common-law partner of the employee and the spouse or common-law partner of the father or mother; and any relative of the employee who resides permanently with the employee or with whom the employee permanently resides.

Drivers are compensated based on a flat rate for their trips which is calculated as the average drive time for the trip existing calculation multiplied by an applicable hourly rate. Road Drivers. When a branch, terminal, division or operation is closed or partially closed and the work of the branch, terminal, division or operation in whole or in part, an employee at the closed or closed down branch, terminal, division or operation shall have the right to transfer to the branch, division or operation into which the work was transferred if is there available. Such employees will be dove-tailed into the list as of the date they first became employees in their classification. Whenever a man is transferred at the request of the Company, his reasonable moving expenses shall be borne by the Company. For the purpose of this section "expense" is defined to mean the moving expenses of normal household goods and chattels. Road Drivers. All road drivers are allowed to perform all duties as assigned at all terminal and customer locations including Road, Dock, City and Yard work. Road drivers will be paid miles or hours whichever is greater with a minimum guarantee of eight (8) hours once put to work. If a bid road driver is scheduled to work at their home domicile and when they arrive no road, city, dock or yard work is available, they will be paid a six (6) hour show up time and sent home. Once the road driver is given an assignment, they are guaranteed a minimum of eight (8) hours pay. If more than one driver is on the same start time the senior driver will have first choice. The Road driver board will be set Sunday night at 6 pm local time by bid start time. Once a driver is dispatched to another terminal location he becomes an open board driver and will be dispatched on a first in first out basis to any other terminal location, within their available hours of service. If a driver is dispatched back to his home terminal he will realign with his next start time. Sign in and out sheets will be provided at all terminal locations and all drivers must sign in at time of arrival and out when dispatched to determine first in first out. If one or more drivers are rested at that same time or are at the dispatch window at the same time the senior driver will have preference to all available loads within their hours of service. The only exception will be if a home load is available, it will be offered to the home driver first. If the driver has sufficient hours to stay on the open board and passes his home load, he is an open board driver until the end of the work week when the driver will be dispatched to or in the direction of his home terminal. At a foreign terminal a rested road driver who is about to or is in layover may be dispatched ahead of a rested domicile driver with no claim. The provisions in Article 48 will supersede any provision in this CBA to the contrary.

This premium will also apply to all hours worked on Saturday and Sunday. Effective October 25, 2015, this premium shall increase to one dollar ($1.00) per hour. The premium will not be included in the computation of the Location Rotation Amount. Minimum trip pay is thirty dollars ($30.00) inclusive of wait time and additional pay. Return trip or backhaul pay is equal to one (1) hour pay for all trips over fifty (50) km one (1) way. Return pay is payable where the driver takes crew out to a drop point and brings a crew back to the origination point or any point in between. Fifteen (15) minutes is paid as additional pay for all trips over thirty (30) minutes in length each way to complete certain administrative duties including a pre-trip inspection, a post trip fueling and fluid check, a post trip cleaning which includes emptying any garbage left in the van, sweeping of floor mats, spot cleaning any spills, reporting any damage or safety concerns with the vehicle to the location supervisor, and completion of trips sheets and driver logs.
