STANDARD FOR EXCELLENCE. The Parties subscribe to and adopt the United Association’s Standard for Excellence. When Employees are hired on the job, they shall sign, subscribe and adhere to the United Association’s Standard for Excellence (a copy of which is attached hereto as Attachment 9). Employer agrees that it will adhere to all employer and management responsibilities set forth in the Standard for Excellence. It is also agreed that the Employer, Union and Employees will be bound by the procedures in place to effectuate the Standard for Excellence. It is further agreed that the National Pipe Line Agreement (“NPLA”) will take precedence over any term or condition in the Standard for Excellence which is inconsistent with or varies any condition of the NPLA.

STANDARD FOR EXCELLENCE. The Parties to this Collective Agreement embrace the purpose and commit to the intent of the UA “Standard for Excellence” as found in its entirety in Schedule ‘D’. The parties agree that matters related to the UA “Standard for Excellence”, that cannot be resolved on a Local basis, will only be dealt with by the Canadian Joint Conference Board. The Employer and the Union are advised that on any issue relating to the Standard for Excellence, it is understood and agreed that this Standard for Excellence shall not give rise to, or constitute, a violation of this Agreement.

It is also agreed that the Employer will adopt and be bound by the procedures in place to effectuate the Standard For Excellence, if any, as negotiated by the Local Union and the recognized contractor’s group in the area where the Employer’s branch office(s) are located.

STANDARD FOR EXCELLENCE. In support of the industry's efforts to provide the quality service through management and employee skills, the Parties agree that Standards for Excellence criteria as agreed by the Parties will form part of this Agreement and that jointly cost shared monthly meetings may be scheduled by the Employer in support of the provision of quality service to clients. It is recognized that the current Standard for Excellence contains both Employee and Employer responsibilities and as such both parties shall make every reasonable effort to comply with these Standards. Each Party to this Agreement strives to provide the best "value" to the purchaser of its services. Through this approach the continuing prosperity of the Employers and Employees can be developed. Recognition that change is required on an ongoing basis is key to this continued prosperity. A competitive offering to the marketplace is key to survival and growth. Training and the continued adoption of technology will assist in this growth and prosperity. This Agreement shall standardize working conditions of all employees ("Employees") engaged in the repair, service and maintenance of all refrigeration, air conditioning equipment and heat pumps. Establish and maintain fair conditions of labour for all Employees and to provide protection for Employers and Employees in the Industry. It shall also be the purpose of this Agreement to increase the efficiency of workers and to set up a method of settling any differences which may arise between the Parties to this Agreement in a just and equitable manner. Any Employee terminated for just cause shall appear before the UA 516 Standard For Excellence Committee when summoned. The parties agree that it is essential to have employees upgrade their skills with regular formalized training to expand the knowledge base of the employees to help improve performance, efficiency, confidence and satisfaction. Further the parties agree to work together to ensure employees take this training on an annual basis and that the employees take responsibility for and participate in training. Such is the motive of the following clauses of this Agreement.

STANDARD FOR EXCELLENCE. Local 324 and IMIRA Contractors will include Standard for Excellence in their Bylaw Regulations only.
STANDARD FOR EXCELLENCE. The United Association Standard for Excellence is incorporated by reference and adopted by the parties to this agreement. (A) A joint labor and management productivity committee consisting of two members plus one alternate appointed by the business manager of the local union and two members plus one alternate appointed by the Mechanical Contractors Association of Houston, shall be formed to consider any complaint from the union, any employee, applicant, or any signatory employer arising from or relating to the Standard for Excellence. (B) The committee shall have the power to make a final and binding decision on any matter referred to it which shall be complied with by the local union, signatory employers and the Association, as the case may be, and employees covered by the collective bargaining agreement. The committee is not authorized to add to, or subtract from, or modify any of the provisions of the collective bargaining agreement and its decision shall be in accord with the agreement. (C) An applicant who is discharged for cause three times within a twelve month period or who has engaged in egregious conduct in violation of the Standard for Excellence shall be referred to the committee to determine the applicant’s continued eligibility to seek referral or continue to work for a signatory contractor. The committee shall, within five business days, review the qualifications of the applicant, the reason for the discharges or other evidence relating to violation with the Standard for Excellence. (D) The committee may issue a final and binding decision providing (1) that the applicant obtain further training from the JATC, (2) disqualify the applicant for referral or continued employment for any signatory contractor for a period of two weeks, or longer, depending upon the seriousness of the conduct and/or repetitive nature of the conduct, (3) refer the applicant to an employee assistance program, if available, for evaluation, treatment, or recommended action; or (4) declare the applicant eligible for continued referral or employment, pursuant to the collective bargaining agreement, including restoration of the applicant to his/her appropriate place on the referral list. (E) The committee shall have the power to establish rules concerning persons referred to the committee, including the use of transcripts, lawyers, and the like, in keeping with the need to maintain an orderly and efficient process unencumbered by excessive formality and delay.
