Step 2 - Written Grievance. 6.3.2.1 In the event the matter is not resolved at Step 1, the grievance (stated in writing on the form provided for such purpose) shall be submitted to the Executive Director of Human Resources or designee within ten (10) workdays following the date on which the Union received written response from Step 1.
6.3.2.2 Within ten (10) workdays after receiving the written grievance, the Executive Director of Human Resources or designee shall meet with the grievant and the Union representative in an effort to resolve the grievance. The Executive Director of Human Resources or designee shall indicate his/her disposition of the grievance in writing within ten (10) workdays after such meeting and shall furnish a copy of his/her decision to the Union representative and the grievant.
Step 2 - Written Grievance. The employee(s) and/or Union representative shall file a written grievance to the appropriate Administrator/Xxxx, Department Head (or designee) within five (5) working days of the meeting with the immediate supervisor electronically via email. The appropriate area Administrator/Xxxx, Department Head (or designee) shall meet with the employee and the union representative(s) within ten (10) working days from the date notice was received from the Union that the grievance was not resolved at Step 1. This meeting can be in person or via teleconference. If the Union designee is a Staff Representative, the Union shall notify the Office of Labor Relations of this fact prior to the meeting with the appropriate area Administrator/Xxxx/ Department Head (or designee). The parties shall attempt to resolve the grievance during this meeting. The Administrator/Xxxx/Department Head (or designee) shall render a written decision, via email within five (5) working days from the date of the meeting, copies of which will be provided to the grievant, the grievant's representative(s) and the Labor Relations Department who shall send a copy to the union office via email to an email address provided by the union. If the employee and/or employee's union representative(s) wishes to carry the grievance to the next level, a letter so stating with a copy of the grievance must be submitted to the Office Of Labor Relations either in person or electronically via email within five (5) working days of the grievance answer being provided. If the grievance is unanswered at the expiration of five (5) working days, the complaint shall be referred automatically to Step 3.
Step 2 - Written Grievance a. In the event the employee believes the grievance has not been satisfactorily resolved, the employee shall submit the grievance in writing to the supervisor within ten (10) calendar days after the receipt of the immediate supervisor's verbal response. The employee shall file one (1) copy with the Human Resources Department and with the Union.
b. In larger departments, it may be necessary to involve the division or section head in the processing of the grievance at this level. In such departments, it shall be the responsibility of the employee to file one copy of his/her grievance with said division or section head at the initiation of Step 2. It shall be the responsibility of the supervisor to consult and involve the division head in any or all grievance meetings and in arriving at a written response to the aggrieved employee.
c. Within ten (10) calendar days of receipt of the grievance, the immediate supervisor shall schedule a meeting with the employee to discuss the grievance. Within ten (10) calendar days of the grievance meeting, the immediate supervisor shall deliver his/her written decision to the grievant and his/her representative. Should the written decision of the supervisor propose a solution to the grievance, it shall be reviewed and approved by the department head prior to delivery to the employee.
Step 2 - Written Grievance. If there is no timely response or satisfaction at Step One, then within ten (10) working days after receipt of the response, or expiration of the time for response, the employee and/or the Guild representative shall reduce to writing a statement of the grievance or complaint which shall contain the following: (a) the facts upon which the grievance is based; (b) reference to the section or sections of the Agreement alleged to have been violated; and (c) the remedy sought. The written grievance shall be filed with the Director. The Director shall conduct an investigation, and shall notify the aggrieved employee and the Guild in writing of the decision, and the reasons therefore within ten (10) working days after receipt of the written grievance.
Step 2 - Written Grievance a. In the event the employee believes the grievance has not been satisfactorily resolved, the employee shall submit the grievance in writing to the supervisor (except as indicated in Paragraph D, below) within seven (7) working days after the receipt of the immediate supervisor's verbal response. The grievant shall file one (1) copy with the Human Resources Department.
b. In larger departments, it may be necessary to involve the division or section head in the processing of the grievance at this level. In such departments, it shall be the responsibility of the employee to file one copy of his/her grievance with said division or section head at the initiation of Step 2. (a) the facts upon which the grievance is based; (b) reference to the section or sections of the agreement alleged to have been violated; and (c) the remedy sought. The written grievance shall be filed with:
Step 2 - Written Grievance. 20.8.1 Subject to the time its in 10.3, employees may present a grievance at this level by:
20.8.1.1 recording this grievance on the appropriate grievance form, setting out the nature of the grievance and the circumstances from which it arose;
20.8.1.2 stating the Article or Articles of the Agreement infringed upon or alleged to have been violated and the remedy or correction required, and where applicable, the reasons why just cause does not exist; and
20.8.1.3 transmitting this grievance to the designated local supervisor through the Union xxxxxxx.
20.8.2 The local supervisor shall:
20.8.2.1 forward the grievance to the representative of the Employer authorized to deal with grievances at Step 2; and
20.8.2.2 provide the employee with a receipt stating the date on which the grievance was received.
Step 2 - Written Grievance. 12 If the grievance is not resolved to the employee’s satisfaction in accordance with the preceding 13 subsection, the employee shall reduce to writing a statement of the grievance containing the 14 following:
Step 2 - Written Grievance a. If the grievant or the Union is dissatisfied with the written decision at Step 1, the Union may file a written appeal within fifteen (15) days of issuance of the Step 1 written decision and submit it to the School’s Xxxx. If the grievance is commencing at Step 2, the grievance shall be filed as follows:
(i) within thirty (30) days following the act or omission known to an Adjunct Faculty Member giving rise to the grievance, or DocuSign Envelope ID: 20B0C477-AC9E-4254-865F-EAFAF08C4D22 (ii) within thirty (30) days after the date on which an aggrieved Adjunct Faculty member reasonably should have known of such act or omission if such action was not known at the time. The above deadlines do not apply to a course assignment grievance, which shall be presented within fourteen (14) days following the issuance of a Class Contract for the course in dispute.
b. The written grievance will include the name of the grievant, the date on which the incident or alleged wrong occurred, a description of the incident or alleged wrong giving rise to the grievance, the contract section or right alleged to have been violated and the relief and/or remedy sought.
c. The Xxxx (or assigned representative) shall meet at the same time with the grievant and a Union representative within ten (10) days of receipt of the Step 2 appeal to discuss the grievance and the relief and/or remedy sought.
d. If the grievance is not resolved at this meeting, within ten (10) days after the Step 2 meeting the Xxxx (or assigned representative) shall write an answer addressing the grievance to approve or deny the relief and/or remedy sought.
Step 2 - Written Grievance. If no settlement is reached in the Step 1 proceeding within two (2) working days (exclusive of Saturday, Sunday, Holidays and the employee’s days off) after the immediate supervisor has been presented the oral grievance, the grievance may be reduced to writing on forms furnished by the Company signed by the aggrieved employee, Xxxxxxx, or Union representative, and must specify the factual basis for the grievance and the clauses of the contract claimed to have been violated. This writing shall be delivered to the Superintendent within five (5) working days (exclusive of Saturday, Sunday and holidays) from the date the oral grievance was first presented to the immediate supervisor. When the written grievance is initiated by the Union itself, it shall be submitted to the Human Resources Department within the time limits as set forth in Step 1 of this procedure. If the written grievance is not delivered within the time limits as set forth herein, it shall be treated by the Company as settled on the basis of the supervisor’s decision or, if no decision, as having been denied.
