If pursuant to the side letter the parties proceed to arbitration, then Arbitrator Xxxxx Xxxxxxxxx, shall be retained by the parties for that arbitration proceeding.

SUBSTANCE ABUSE PREVENTION POLICY. Section 1. The City of Sioux Falls (the City) is committed to developing an organizational culture of employee well-being and safety. The City’s well-being vision is to “Create an organizational culture that inspires employee health, safety, and happiness in everyday decisions.” Section 2. The City encourages early diagnosis and sound treatment for drug- and alcohol- related conditions and supports and encourages employees to voluntarily and confidentially seek help. Section 3. The City’s Substance Abuse Prevention Policy does not create a binding employment contract. The City of Sioux Falls reserves the right to interpret, change, or rescind this policy in whole or in part, with or without notice, subject to any state and federal laws and relevant collective bargaining agreements. In addition, changes to applicable federal or state laws or regulations may require the City to modify or supplement this policy. Such changes will be made in accordance with any obligation pursuant to an existing collective bargaining agreement. Section 4. For purposes of the application of the City’s Substance Abuse Prevention Policy, employees who are designated as “safety-sensitive employees” will be subject to all drug and alcohol testing requirements applicable to safety-sensitive employees.

Attached hereto as Appendix C, is the City's current Substance Abuse Prevention Policy; this policy shall remain in effect until the City implements the Substance Abuse Prevention Policy set forth in Appendix D. SUBSTANCE ABUSE PREVENTION POLICY. The parties recognize the problems which drug and alcohol abuse have created in the construction industry and the need to develop drug and alcohol abuse prevention programs. Accordingly, the parties agree that in order to enhance the safety of the workplace and to maintain a drug and alcohol free work environment, individual employers may require applicants or employees to undergo drug and alcohol screening. The parties agree that if a screening program is implemented by an individual employer, the following items have been agreed upon by labor and management: 1) It is understood that the use, possession, transfer, or sale of illegal drugs, narcotics, or other unlawful substances is absolutely prohibited while employees are on the employer’s job premises or while working on any site in connection with work performed under the agreement. 2) All applicants or newly hired employees will undergo a drug test at the direction of the Employer, but not less than five (5) days after commencement of work, at a facility agreed upon by the Employer and the Union. The cutoff levels for both the initial test and the confirmation test will be established by the Federal Department of Health and Human Services. The facility where the sample is tested will be approved by The Federal Department of Health and Human Services. The Employer agrees to pay each applicant or employee who takes and passes the drug test for all the time it takes to undergo the drug test up to a maximum of two (2) hours travel time plus lab time. If an employee fails any drug test and has time coming to him or her, the employer may withhold the cost of the drug test from the final check. Employers may use an oral fluid test or urine screen, solely as a type of pre-employment screening process. Testing procedures shall be conducted in a manner consistent with the productsmanufacturing specifications (“Avitar ORAL screen” or Xxxxxx Medical Corp. “Oratect”). Any “non- negative” test results shall be designated as inconclusive. Employers may seek a urine test at a certified laboratory in accordance with the drug testing procedure set forth in this collective bargaining agreement to confirm results. 3) Applicants not passing the drug and alcohol screen will not be placed on the employer’s payroll or receive any compensation. Employees not passing the drug and alcohol screen will be removed from the employer’s payroll. The employer agrees to pay the cost for administering the drug and alcohol screen. 4) T...

SUBSTANCE ABUSE PREVENTION POLICY. Alcohol and drug use may adversely affect the quality of care provided to patients, pose safety and health risks to the user and others, have a negative impact on work efficiency and result in danger to person or loss of equipment and property. In order to provide the highest quality of patient care, and a safe, healthful and efficient work environment, the Employer requires its employees to report for work able to perform their jobs. All employees will abide by the AMR Substance Abuse Prevention Policy as defined in the Employer’s Safety and Risk Policy Manual and made part of this Agreement by reference. The Employer agrees to have a Union KMFFA representative present at any time that a search of an employee or an employee's personal effects is to take place. In the event a public or private entity requires that a random drug testing policy be implemented as a contractual obligation between the customer and the Employer, the Employer agrees it shall provide verification to the Union KMFFA from the agency or customer requiring such testing. Further more, the Employer agrees it shall meet and negotiate with the Union KMFFA over the implementation, testing process, impact, and specific requirements of the program ninety (90) days prior to the implementation of such program. 1619 1620
