Use and Limitations. Lessee shall use the Premises for the purpose of smog (emissions) testing of vehicles only, and for no other use, without Lessor's prior written consent. Lessee agrees that it shall not sell automobiles on the Premises.
Use and Limitations. The LESSEE agrees that he will not use or permit the LEASED PREMISES or any part thereof to be used for any illegal, disorderly, or improper purposes.
Use and Limitations. The assessments provided by 3D are intended for use only by properly trained healthcare professionals. The practice shall not substitute assessment results for their own professional judgment. A lack of information or indications from the assessments should not be construed as an indication or proof that any condition is not present. Further or additional tests, information and investigation may be necessary or advisable to confirm or disaffirm any preliminary information produced by the assessments.
Use and Limitations. 7.1 Contracting Party is entitled to use the Service for its normal business purposes. This Agreement is non-exclusive and non- transferable. Contracting Party is not entitled to assign and/or sub-license any of its rights under this Agreement to any third party without previous written consent of NL-ix.
7.2 NL-ix is not obliged to make or continue the Service if a valid Order Form is not signed by Contracting Party;
7.3 Contracting Party guarantees 24 hours per day reachability and shall provide NL-ix with the necessary contact information.
7.4 NL-ix shall provide all reasonable care to ensure that the Service functions in accordance with the operational and functional specifications as agreed between the parties.
7.5 Contracting Party is solely responsible that use of the Service does not cause or is likely to cause any damage, or is in any other way harmful to the NL-ix Infrastructure, to NL-ix, to other NL-ix customers, or to the normal operation, availability or functionality of the Service and/or the Housing Site or to the traffic exchanged. Contracting Party agrees to implement any reasonable measures that NL-ix may propose to prevent or repair such damage or harm. NL-ix reserves the right to apply port-security and ACL policy where applicable.
7.6 NL-ix is entitled to (a) suspend or (b) discontinue the Service, in whole or in part, and/or (c) to require that certain conditions be met before continuation thereof, if:
1. Contracting Party is infringing article 7.5 and Contracting Party has not, after a written warning from NL-ix, implemented adequate measures to prevent or repair such infringement;
2. Such is necessary for NL-ix to comply with a statutory obligation or a judicial decision;
3. Such is necessary in the view of NL-ix for installation or maintenance of hardware, software or infrastructure that is used or otherwise relevant for the NL- ix Infrastructure;
4. NL-ix has received a claim as referred to in article 7.7;
5. Contracting Party is in breach of one or more obligations under this Agreement;
6. In the view of NL-ix, the Contracting Party is not reacting or taking any appropriate measures against any internet abuse and spam activities, which are provided via Contracting Parties Service(s) and advertised IP prefixes.
7.7 Contracting Party will hold NL-ix harmless from any and all damage they might suffer as a result of a claim of a third party that information exchanged on the NL-ix Infrastructure through the Service of Contracting Part...
Use and Limitations. (A) A Special Appearance Contract may be used to hire individual professional Equity Actor(s) for an individual production.
(B) Its use is solely at the discretion of Actors' Equity Association and Equity reserves the right to deny its use. In order to make such determination AEA may require submission of authentic budgets reflecting earned and unearned income and any other sources of income not reflected in potential box office information.
(C) This type of Agreement may not be used in New York, Chicago, Los Angeles or San Francisco.
(D) No food or drinks may be served in the theatre with the exception of lobby concessions.
(E) The Producer may not schedule special performances for children or school level audiences or present productions which should properly be produced under the terms and conditions of the Agreement and Rules Governing Employment in Theatre for Young Audiences.
(F) Actors may perform only at a single performance location; there shall be no touring.
(G) The maximum number of Equity Actors employed for any production shall not exceed three (3).
(H) Levels shall be determined by seating and earning potential and shall govern minimum salaries and other conditions.
(I) Equity Actors being hired under the Special Appearance Contract must be Members in good standing as determined by Equity. Minimum Weekly Salary: Pension: 8% of contractual salary Maximum 4 performances per week (One additional performance may be added for additional compensation of 1-1/2 times the pro-rata rate. See 3(B).) Maximum 20 hours of work (rehearsal and performance) per week Maximum length of run: 20 performances Maximum seating: 99 seats Maximum Potential box office: $10,000 per week Overtime rate: $8.00 (9/26/16 – 9/29/19) / $8.50 (9/30/19 – 9/26/21) per half-hour or part thereof Minimum Weekly Salary: Pension: 8% of contractual salary. If the Licensee has purchased the SSO Module for the Software, then these explicit terms shall apply to the use of the SSO Module and shall govern over any clickwrap or shrinkwrap end user license terms accompanying the SSO Module. All remaining sections of any such accompanying clickwrap or shrinkwrap end user license terms not explicitly addressed herein shall govern the use of the SSO capability for the Software other than as amended herein for use with the Software. The SecureLogin End User License Agreement terms are hereby amended when used within the SSO Module with the Software as follows: Definitions:
Use and Limitations. 3.1. Customer must use the Ascom Software only in accordance with the intended use and instructions provided in the Documentation, and solely in conjunction with Ascom authorized third-party hardware and/or software.
3.2. Customer may not sell, lease, assign, sublicense, distribute or otherwise encumber by any means the Ascom Software, except Ascom granted Customer such rights (e.g. if Customer is an authorized distributor).
3.3. Customer may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Ascom Software or any services provided by the Ascom Software or any part thereof.
3.4. In order to verify whether Customer is complying with the restrictions contained herein, Customer agrees to submit, upon reasonable request by Ascom, li- cense usage data, without any personal data, using tools provided by Ascom.
Use and Limitations. 13.1. FAIJON may:
13.1.1. Reject or refuse to perform any Services that are not in compliance with its applicable specifications and standards, laws and regulations and/or public interest standards as determined by FAIJON; and
13.1.2. From time to time and without notice, make changes in Services that in its sole judgment will best serve FAIJON’s customers. FAIJON’s partial rejection or refusal of any portion of Services will not release Customer from its obligations with respect to the remaining Services being performed.
13.2. Customer agrees to comply with the FAIJON’s Acceptable Use Policy (located at xxx.xxxxxxxxxxx.xx.xx). Violation of any such rules, regulations and policies, or any attempt to break security or to access an account which does not belong to Customer, shall be considered a material breach of contract, and FAIJON may terminate this Agreement without liability or may suspend or terminate Service to Customer, or suspend or terminate any user ID, electronic mail address, Universal Resource Locator or domain name used by Customer. Upon such termination by FAIJON, Customer shall be liable for any applicable charges, including early termination charges as set forth in Clause 5 of this Agreement. If Customer’s Service is suspended pursuant to this Clause, Customer will still be responsible for charges for the Service incurred during the Period of suspension.
13.3. Nothing contained in this Agreement may be construed to convey to Customer any interest, title, or license in the user ID, electronic mail address or Universal Resource Locator used by Customer in connection with the Service.
13.4. Customer acknowledges and agrees that FAIJON has the right to enforce its policies and guidelines pertaining to Customer’s use of the Service and may be required to take immediate action to protect the integrity, quality, reputation and/or availability of the Service. For violations of policies and/or guidelines that FAIJON believes, in its sole discretion do not warrant immediate suspension or termination of Customer’s Service, FAIJON shall make a reasonable effort to contact Customer in an attempt to remedy the situation prior to suspension or termination of Service.
Use and Limitations. 6.1 Participant is entitled to use the Connection for peering purposes only. This license is non-exclusive and non-transferable. Participant is not entitled to assign and/or sub-license any of its rights under this agreement to any third party without previous written consent of Rheintal IX. Selling of Transit Services using the Connection to the Rheintal IX shared medium is not allowed.
6.2 To actually exchange traffic at the Rheintal IX, bilateral agreements need to be established between participants. The required routing protocol for all Rheintal IX peering relations is BGP4. Internal routing protocols must not be used on nor exported to the shared peering LAN.
6.3 Participant accepts full responsibility for its use of the Connection ac- cording to Article 5, specifically that it does not cause or is likely to cause any damage, or is in any other way harmful, to the Rheintal IX infrastructure or to the normal operation, availability or functionality of the Rheintal IX services or to the traffic exchanged thereon. Participant agrees to implement any reason- able measures that Rheintal IX may propose to prevent or repair such damage or harm. Participant will observe relevant Best Current Practices (BCPs) which are published on the Rheintal IX web page and announced to the operations mailing list.
6.4 Rheintal IX is entitled to (a) suspend or (b) discontinue the Connection, in whole or in part, and/or (c) to require that certain conditions be met before continuation thereof, if:
Use and Limitations. 7.1 Customer is entitled to use the Connection for its normal business purposes. Customer’s rights under the AMS-IX Connection Agreement are non-exclusive. Customer is not entitled to assign and/or sublicense any of its rights under the AMS-IX Connection Agreement, or make the Connection available, to any third party unless it has signed a reseller or reseller plus agreement or other type of contract with AMS-IX B.V. which allows it to do so.
7.2 AMS-IX Company is not obliged to make or keep the Connection available for Customer if:
7.3 Customer agrees to exchange traffic through the AMS-IX Infrastructure only when there is a bilateral agreement to exchange traffic between Customer and the other individual Customers on the AMS-IX Infrastructure.
7.4 AMS-IX Company shall provide all reasonable care, skill and diligence to ensure that the Connection functions in accordance with the operational and functional specifications in the Service Description, available on the website of that Co-location as established and adapted from time-to-time by AMS-IX B.V., provided that Customer warrants a 24 hours per day reachability and has appointed a NOC as set forth in article 4.3 above.
7.5 Customer is solely responsible that its use of the Connection does not cause or is likely to cause any damage, or is in any other way harmful, to the AMS-IX Infrastructure, to AMS-IX Company, to the AMS- IX Association or to the normal operation, availability or functionality of the Connection and/or the Co-location or to the traffic exchanged. Specifically, the Customer will adhere to the restrictions relating to Allowed Traffic (xxxx://xxx.xxx-xx.xxx/allowed-traffic).
7.6 Customer agrees to implement any reasonable measures that AMS- IX Company may propose in order to prevent or repair such damage or harm as described in article 7.5.
7.7 AMS-IX Company is entitled to (a) suspend or (b) discontinue the Connection, in whole or in part, and/or (c) to require that certain conditions be met before continuation thereof, if:
7.8 Customer shall indemnify AMS-IX Company and the AMS-IX Association and hold them harmless from any and all damage and costs they might suffer or incur as a result of a claim of a third party that information, exchanged on the AMS-IX Infrastructure through the Connection of Customer, would be violating Dutch or foreign statutory rules, rules of public order or decency or rights of third parties.
