Vacancies and New Jobs. A vacancy is defined as a job opening in any existing job classification in the Bargaining Unit, whereas, Employee’s employment relationship in the job for the Employer is terminated for any reasons whatsoever. A new job is a job opening resulting from the creation of a new workstation within the Bargaining Unit. The decision of whether or not to fill a vacancy shall be at the sole discretion of the Employer.
Vacancies and New Jobs. All vacancies and new jobs, which are filled, shall be posted by the Employer for five (5) working days in a conspicuous place. All Employees desiring to bid for such job shall notify the Administrative Office, in writing, of their interest in the job, during normal working hours (9:00 AM to 4:30 PM) and a receipt shall be given. The Employer shall award the job in accordance with the physical fitness, ability, and efficiency of the Employee to perform the job, it being understood that seniority shall be the governing factor when qualification, experience, physical fitness, ability, and efficiency of the Employee to perform the job are relatively equal. All jobs posted shall be filled within (15) working days from the date of posting, when feasible, and not to exceed a total of forty-five (45) days.

If any vacancy or new job is created, such vacancy or new job must be posted on all bulletin boards for a minimum of five (5) working days and may be concurrently advertised outside, where it is unlikely there would be a qualified internal applicant. If the hours of work for an existing position are increased by two (2) hours per day (or ten (10) hours per week) or more, such a position will be treated as a new job and will be posted in accordance with the above. 36.2 When circumstances cause the Employer to use a supervisor to drive a truck, he must be accompanied by a top rated union employee.

A permanent vacancy is defined as a vacancy with a duration of more than four (4) calendar months. The notice of vacancy will include a summary of the duties, commencement date, required qualifications, classification, approximate hours per week, and current hours of work. Hours of work are subject to change in accordance with operational requirements. Employees who have applied in writing for a posted position shall be given consideration prior to hiring a new employee. Applicants must be available to work in accordance with the work schedule associated with the vacant position. The Employer may fill the vacancy on a temporary basis pending the completion of the posting and selection process.
