Variable Shifts. The Medical Center may create and post positions that require the nurse holding such a position to work variable shifts, meaning a position with variable shifts or start times within a shift. When the Medical Center fills such a position, the Medical Center will work with the nurse to minimize the impact of the variable shifts by communicating and collaborating with the nurse in the development of the nurse’s schedule. Unless a nurse is hired into a variable shift position, he or she will not be required to work on variable shifts without the nurse’s consent.
Variable Shifts. There shall be no more than eight (8) full-time and part-time 19 positions consisting of more than one shift at any one time in the bargaining unit. 20 Nurses may be scheduled to work variable shifts with their consent.

When the Hospital fills such a position, the Hospital will work with the nurse to minimize the impact of the variable shifts by communicating and collaborating with the nurse in the development of the nurse’s schedule. Unless a nurse is hired into a variable shift position, he or she will not be required to work on variable shifts without the nurse’s consent. The Medical Center will create no more than one variable shift position for each unit/department, except for those units/departments that have 40 or more nurse positions, in which case the Medical Center may create up to two such positions for each unit/department.
Variable Shifts. (a) Notwithstanding the provisions of this Article for employees working shift work, upon the request of a three-quarter (3/4) majority of the employees affected and with the concurrence of the employer, hours of work may be scheduled that exceed seven and one-half (7 ½) hours per day provided no shift in excess of twelve (12) hours is involved.
(b) The daily hours of work shall be consecutive and exclusive of meal periods. The hours of work shall be scheduled so that an employees normal work week shall average thirty-seven and one-half (37 ½) hours per week over a minimum period of four (4) weeks.
(c) The commencement and/or end of each shift may be varied by fifteen (15) minutes to provide for the continuity of care and/or an appropriate length of the meal period.
Variable Shifts. 13.1 The ordinary hours of work for Variable Shift Workers are:
(i) An average of 36 per week over the period of the shift roster cycle;
(ii) To be worked in accordance with the shift roster issued by the Company from time to time, with RDOs accruing at the rate of 26 RDOs for each 12 months worked.
13.2 For each day of annual leave and sick leave taken, 7.2 hours will be paid to the Employee, and 0.8 of an hour will be accrued towards an RDO.
13.3 Definitions for Variable Shift Workers For the purposes of this clause:
