Work Site Conditions. A. In compliance with and pursuant to Government Code Section 4215, AGENCY shall assume the responsibility, as between the parties to this AGREEMENT, for the timely removal, relocation, or protection of existing main- or trunk-line utility facilities located on the site of any construction project that is a subject of this AGREEMENT, if such utilities are not identified by AGENCY in the plans and specifications made a part of the invitation for bids. The Contract Documents shall include provisions to compensate CONTRACTOR for the costs of locating, repairing damage not due to the failure of CONTRACTOR to exercise reasonable care, and removing or relocating such utility facilities not indicated in the plans and specifications with reasonable accuracy, and for equipment on the project necessarily idled during such work. CONTRACTOR shall not be assessed liquidated damages for delay in completion of the project, when such delay was caused by the failure of AGENCY or the owner of a utility to provide for removal or relocation of such utility facilities.
B. To the extent that the work requires trenches in excess of five feet (5’) and is estimated to cost more than $25,000, prior to any excavation, CONTRACTOR must provide the AGENCY, or a registered civil or structural engineer employed by the AGENCY to whom authority has been delegated to accept such plans, a detailed plan showing the design of shoring, bracing, sloping, or other provisions to be made for worker protection from the hazard of caving ground during the excavation of such trench or trenches. If such plan varies from the shoring system standards, the plan shall be prepared by a registered civil or structural engineer. Nothing in this section shall be deemed to allow the use of a shoring, sloping, or protective system less effective than that required by the Construction Safety Orders.
C. This AGREEMENT is further subject to Public Contract Code Section 7104 with regard to any trenches deeper than four feet (4’) involved in the proposed work as follows: CONTRACTOR shall promptly, and before the following conditions are disturbed, notify AGENCY, in writing, of any:
(1) Material that CONTRACTOR believes may be hazardous waste, as defined in Section 25117 of the Health and Safety Code, which is required to be removed to a Class I, Class II, or Class III disposal site in accordance with existing law.

Work Site Conditions a. If asbestos, or material containing asbestos, or any other hazardous or toxic materials are discovered during work pursuant to this FSA, Frontier will suspend its work for a reasonable period of time to permit Customer to engage a qualified firm to remove and dispose of the asbestos or other toxic or hazardous materials from the site. Such suspension may result in an equitable adjustment to the charges identified in the related Schedule, based on any increase in costs incurred by Frontier.
b. Customer agrees to release, indemnify, defend and hold harmless Frontier from and against any damages, losses, claims, demands or lawsuits arising out of or relating to the presence, removal or disposal of asbestos or any other hazardous or toxic material from the Customer’s premises or location where Services or Equipment will be installed.
Work Site Conditions. The Contractor shall at all times keep the work area, including storage areas, free from accumulations of waste materials except as required to maintain the proper pace and flow of the demolition process. Prior to demobilization, Contractor shall remove from the work and premises all rubbish, tools, scaffolding, equipment, and materials that are not the property of the Government. Upon work completion, the Contractor shall leave the work area in a clean, neat, and orderly condition satisfactory to the KO.

b. Customer agrees to release, indemnify, defend and hold harmless Ziply Fiber from and against any damages, losses, claims, demands or lawsuits arising out of or relating to the presence, removal or disposal of asbestos or any other hazardous or toxic material from the Customer’s premises or location where Services or Equipment will be installed.
Work Site Conditions. Contractor shall confine equipment, storage of materials, and operation of Work to those limits indicated by the Project Specifications, Contract Documents, law, ordinances, permits or directions of the County.
Work Site Conditions. Section a. Vehicles will be maintained in a roadworthy condition with all safety equipment in good operating condition.
Section b. Employees will be provided with clean and sanitary toilet facilities which are readily accessible and which are separate from those used by inmates. Specific toilet facilities for taking of inmate urinalysis testing will be negotiated locally.
1. all toilet facilities will be capable of being locked by the employee while the employee is utilizing them;
2. employees who are assigned to perimeter patrols will be provided access to toilet facilities. Recognizing that institutions vary in size and layout, relief will be provided in an expedient manner. Normally, this will take place within ten (10) minutes; and
3. all toilet facilities will be equipped with a toilet and sink.
Section c. The Employer agrees to provide, at a minimum, all permanent, active institution towers with the following items:
1. suitable armchairs for observation;
2. heaters/air conditioning;
3. permanent type toilet;
4. sink; and
5. other items may be negotiated locally. Provisions for those towers constructed temporarily for construction supervision, recreation supervision, etc. will be negotiated locally.
Section d. Shelter for outside posts for use of employees during inclement weather will be negotiated locally.
Section e. The Employer agrees to provide, maintain, or repair all equipment for staff to fulfill their duties.
Work Site Conditions. Bargaining unit members will be supplied with reasonable amounts of materials to run a successful program. Supplies listed in Appendix #1 will be available in the building principal's office and shall be offered to the staff on a free for the asking basis with the exception of folders and index cards which shall be available in reasonable amounts. Supplies not normally considered as teaching supplies must be requested through normal budget procedures. In the event a teacher needs an emergency copy(s) he/she shall have the right to send a student to the office with a note to have the secretary promptly supply such copies. Each classroom will contain a teacher's desk, chair, two drawer file, storage space and sufficient student seating.

Work Site Conditions. Supplier shall keep the work site clean and free from unreasonable accumulation of excess dirt, materials or waste caused by Supplier. Supplier shall dispose of all materials and debris accumulated in conjunction with completing this work off campus daily. Supplier shall not use Participating Agency refuse containers, unless authorized by designated Participating Agency representative. Supplier will be required to coordinate reclamation/disposal of all materials. Supplier shall provide Participating Agency with proof of reclamation. Where required, Participating Agency will be responsible for removal and/or abatement of existing hazardous flooring materials prior to scheduled installation of new flooring. Where required, Participating Agency will be responsible for replacement of dry rot and other necessary structural repairs identified prior to flooring installation or discovered during the course of the work.
