Specifically, these Approved Environments are defined as physical spaces that are monitored and designated for cleaning using industry standard practices for machinery and wet floors, including caution signage and barriers, and while a Robotic Scrubber is in autonomous mode, all drops, stairs, escalators, moving platforms, or cliffs near to the Robotic Scrubber during its operation must be guarded by a physical barrier. The End User and its Permitees, shall use the Autonomy Services only in accordance with the Robotic Scrubber’s user manuals, guides, and instructions provided in the Software (collectively, the “Instructions”). These Instructions may be updated, revised, or otherwise modified by Brain or Tennant. The End User will be responsible for operating, and instructing all operators of, the Robotic Scrubber how to use the Robotic Scrubber and Autonomy Services in accordance with the Instructions.

You, as well as your employees, agents, contractors, and other permitees, shall use the autonomy services in accordance with the training and the robotic scrubber’s user manuals. These manuals may be updated, revised or otherwise modified by Xxxxxxx or Brain from time to time.
Approved Uses. A. Each Data Trust User shall have Data Trust Individual User access policies. Each Data Trust User acknowledges that the access policies will differ among them as a result of differing applicable law and business practices. Each Data Trust User shall be responsible for determining whether and how to access and use the Data Trust based on the application of its access policies to the information from the Data Trust. The Data Trust User agrees that each of its Data Trust Individual Users shall comply with applicable law and this Agreement. It is strictly the Data Trust User’s responsibility to add or remove individual users in Exhibit A, ensure such users have signed their respective Non-Disclosure Agreement, and provide the signed documents to the Trustee.

Without limiting the other Restrictions on Use in this Section 3, the End User and its Permittees shall only use the Robotic Floor Cleaner and Autonomy Services in Approved Environments. “Approved Environments” are indoor industrial/commercial environments typically cleaned by manual floor cleaners of comparable build and design to the Robotic Floor Cleaner, where the approved cleaning area shall not include ramps or inclines. Approved Environments do not include environments requiring failsafe performance, including any application in which the failure of the Robotic Floor Cleaner, Software, and Autonomy Services could be reasonably likely to lead directly to death, personal injury, or severe physical or property damage after employing reasonable measures to secure the location in advance of the use of the Robotic Floor Cleaner. Approved Environments shall be limited to cleaning areas with adequate cellular communication signals permitting cellular data communication with the Robotic Floor Cleaner’s central processing unit to enable periodic safety-related updates not less than monthly and comply with all other requirements listed in the Instructions (as defined below). The End User will monitor and designate Approved Environments for cleaning using Xxxxxxx’x product documentation and industry standard practices for machinery and wet floors, including caution signage and barriers, and while a Robotic Floor Cleaner is in autonomous mode, all drops, stairs, escalators, moving platforms, or cliffs near to the Robotic Floor Cleaner during its operation must be guarded by a physical barrier (such as, for example, safety cones). The End User shall, and shall cause its Permittees to, use the Autonomy Services only in accordance with the Robotic Floor Cleaner’s user manuals, guides, safety sheets, and instructions provided in the Software (collectively, the “Instructions”). These Instructions may be updated, revised, or otherwise modified by Brain or Xxxxxxx from time to time. The End User will be responsible for operating the Robotic Floor Cleaner and Autonomy Services, and instructing all Permittees of the Robotic Floor Cleaner how to use, the Robotic Floor Cleaner and Autonomy Services, in accordance with the Instructions.

It is expressly understood that CDBG funds may only be used for costs included in the CDBG budget and may not be used for the general administration or operation of the Subrecipient, unless expressively authorized by the City, and may not replace non-federal funds in any jointly funded project except as outlined below in paragraph 2 of this Section. During the period of performance, the total budget or any adjustments of funds between individual line items in the Subrecipient’s budget will be accomplished by a written Change Order or Amendment approved by the City. Unexpended funds not subject to a request for payment will be retained by the City.

Notwithstanding the foregoing or any contrary provision contained herein, in connection with: (a) any description by CFFT of its research portfolio and of its industry discovery and development program, or (b) CFFT’s fundraising activities, marketing materials or reporting requirements, CFFT shall be entitled to use or disclose, and PTI hereby pre-approves CFFT’s use or disclosure of: (i) the xxxx “PTI” and PTI’s logo, provided that PTI provides prior written approval of such use, (ii) a general description of PTI, (iii) the existence and a general description of the nature of this Agreement (excluding financial terms), and (iv) a general description of the nature of the Research Program consistent with the confidentiality terms herein; provided, however, CFFT shall properly use any and all PTI trademarks in a manner so as to not diminish its goodwill. Notwithstanding the foregoing or any contrary provision contained herein, in connection with any description by PTI or its Affiliates of its research portfolio and of its industry discovery and development program, PTI shall be entitled to use or disclose, and CFFT hereby pre-approves PTI’s use or disclosure of: (i) the xxxx “CFFT” and CFFT’s logo, provided that CFFT provides prior written approval of such use, (ii) a general description of CFFT, (iii) the existence and a general description of the nature of this Agreement (excluding financial terms), and (iv) a general description of the nature of the Research Program consistent with the confidentiality terms herein. The Parties agree that the uses of the xxxx “PTI” and PTI’s logo by CFFT and the uses of the xxxx “CFFT” and CFFTs logo, in each case, that are set forth on Exhibit B, are hereby approved pursuant to this Section 5.2.5 shall not be subject to the foregoing prior written approval requirements.
Approved Uses. The Capital Project Fund(s) must be used only for infrastructure replacements and enhancements approved by the Board except in the event of a major failure, disaster or force majeure event that necessitates immediate action to restore the Network to operating condition. In such cases, the Executive Director is authorized to expend funds without first obtaining Board approval. The Executive Director will report to the Board at the next Board meeting the funds that were expended for ratification of the expenditure and Special Assessment, if necessary. The Administrative Manager will not expend funds that will cause the Capital Project Fund(s) to be in a deficit position at any time.
