Benefits While on Unpaid Leave. 362. As set forth in Administrative Code Section 16.701(b), covered employees who are not in active service for more than twelve (12) weeks, shall be required to pay the Health Service System for the full premium cost of membership in the Health Service System, unless the employee shall be on sick leave, workers’ compensation, mandatory administrative leave, approved personal leave following family care leave, disciplinary suspensions or on a layoff holdover list where the employee verifies they have no alternative coverage.
Benefits While on Unpaid Leave. 240. The Court will cease payment of any and all contributions for employee health and dental benefits for those employees who remain on unpaid status in excess of twelve (12) continuous weeks, with the exception of approved sick leave, and any leaves protected by federal, state, or local law, such as workers’ compensation leave, family care (including qualifying exigency leave for an active duty military family member) or bonding leave, pregnancy disability leave, or mandatory administrative leave. For mandatory administrative leave, the Court will cease payment of any and all contributions for employee health, dental and other insurance benefits for those employees who remain on unpaid status in excess of thirty-six (36) months.

Following expiration of the employee’s family care leave, the employee may request personal leave due to hardship (pursuant to the procedures of the Department of Human Resources). Paid benefits shall continue during this approved personal leave. In addition, the City will continue payment of all regular contributions for employee health and dental benefits for an employee on a holdover list during the time period that the employee verifies that the employee does not have alternative health care coverage. The verification process shall be established by the Department of Human Resources and the Union.

While an employee is on an unpaid leave unless the leave is designated as family medical leave as defined in Article X, all fringe benefits may be continued at group rates if the employee wishes to pay full premiums and if there is no additional cost to the Board and/or Board’s employees, provided the Board’s insurance carrier permits this coverage.
Benefits While on Unpaid Leave. The Employer will continue to pay its share of the applicable health and welfare premiums for a maximum of twenty (20) work shifts in any calendar year. This article does not apply to a general leave under Clause 21.4. For any leave of absence or accumulation of leaves of absence in excess of twenty (20) work shifts in any calendar year, benefit coverage may be continued by the employee, provided the employee pays, in advance, the monthly cost of all the benefit premiums in accordance with the procedures established by the Employer.

An employee on approved leave without pay may continue to be eligible for the benefits of the State group insurance program and may continue to participate in the State Universities Retirement System, subject to the laws, rules, regulations, policies, and procedures governing the administration of such insurance programs or the State Universities Retirement System.

Except as otherwise provided in Article VII(B) Family and Medical Leave, while a bargaining unit member is on an unpaid leave of absence, insurance benefits may be continued at group rates if the bargaining unit member pays the entire premium in the manner required by the Treasurer, if there is no additional cost to the Board and if the Board's insurance carrier permits this coverage.
