Capacity Tests. (1) A “Capacity Test” is a one-hour performance test of the RMR Unit by Participant. The capacity as shown by a Capacity Test is called “Tested Capacity” and is determined by the applicable net meter readings during the Capacity Test.

Capacity Tests. Prior to the Commercial Operation Date, Seller shall schedule and complete a Commercial Operation Capacity Test, which Capacity Test shall be used to determine the initial Installed Capacity and initial Efficiency Rate, all in accordance with Exhibit O. Thereafter, Seller shall have the right to run (and Buyer the right to require Seller to perform) additional Capacity Tests in accordance with Exhibit O.
Capacity Tests. (a) The Buyer shall have the option, exercisable on no more than one (1) occasion per Season, during the Season to require the Supplier, within ten (10) Business Days after written notice has been delivered to the Supplier, provided it is not during an Outage, to conduct a test, at the Supplier’s sole cost and expense, to confirm the Project’s ability to deliver the Contracted Demand Reduction for the Season (the “Capacity Test”). For certainty, the Buyer shall only exercise this option if (i) the Supplier failed to curtail the amount of Electricity specified in any Operational Directive, (ii) if no Operational Directive has been issued during the preceding Season, or (iii) in accordance with Section 4.2(c). Each Capacity Test shall consist of the Project curtailing Electricity demand in response to Operational Directives for six (6) continuous hours during a period designated by the Supplier in advance as a test period (but which hours shall be during Callable Hours) subject to coordination and approval of the York Region DR Manager. If the Control Equipment includes Behind the Meter Generation, then the Contracted Demand Reduction shall be evaluated based on the meter data in relation to the generator. The Supplier acknowledges and agrees that the Contracted Demand Reduction and the meter data, as measured by the Capacity Test, shall not be adjusted for ambient, weather, or other conditions whatsoever. If (i) the Capacity Test is interrupted by an event of Force Majeure or (ii) the Control Equipment includes Behind the Meter Generation and at any point during the Capacity Test the air temperature, as reported at the Environment Canada weather station that is physically nearest to the Project (or in the case of a Project that is comprised of two or more generating facilities that are aggregated, the weather station that is physically nearest to one of the generating facilities so aggregated that has been selected by the Supplier), exceeded 30.0 degrees Celsius, then the Supplier may, at the Supplier’s sole cost and expense, re-perform the Capacity Test within ten (10) Business Days after the receipt by York Region DR Contract Released November 30, 2005 the Supplier of the Verification Certificate relating to such Capacity Test from the Buyer. Capacity Tests. SELLER shall conduct Initial Acceptance Tests for Phase 1 and Phase 2 and any subsequent Capacity Tests (subject to inspection by HELCO) in accordance with the testing procedures set forth in "Attachment L" to determine when Capacity Charge payments should begin or be adjusted in accordance with Section 5.1B.
Capacity Tests. Two Capacity Tests will be conducted without Power Augmentation (Capacity Test 1) and with Power Augmentation (Capacity Test 2) to determine the maximum Net Plant Output for the purposes of establishing the Contract Capacity for the Plant and the Power Augmentation Capacity (PAC) of each Combustion Turbine as outlined in Sections 4.2 and 4.3 of the Agreement. Capacity Tests. SELLER shall conduct capacity tests twice a year, once during the summer (June through August) and once during the winter (December through February) periods, in accordance with procedures specified by PECO. The procedures shall be based on and consistent with the GREEN BOOK. PECO shall have the right to require additional tests to meet specific PECO needs that are not required by the GREEN BOOK. PECO shall pay all costs incurred by the SELLER for such additional tests. PECO shall be the sole judge of the tests required.
