Capacity Tests. (1) A “Capacity Test” is a one-hour performance test of the RMR Unit by Participant. The capacity as shown by a Capacity Test is called “Tested Capacity” and is determined by the applicable net meter readings during the Capacity Test. (2) ERCOT may require that a Capacity Test be run at ERCOT’s discretion at any time when the RMR Unit is on line, but ERCOT may not require more than four Capacity Tests in a contract Term. ERCOT must give Participant at least two (2) hours advance notice, after the RMR Unit is on line, of a Capacity Test required by ERCOT, unless Participant agrees to less than two (2) hours. Participant may perform as many Capacity Tests as it desires, but Participant may not perform a Capacity Test without the prior approval of ERCOT, which approval ERCOT may not unreasonably withhold or delay. The Parties will reasonably cooperate to coordinate a Capacity Test. ERCOT has the right to reasonable advance notice of, and to have personnel present during, a Capacity Test.

(2) MISO may require that a Capacity Test be run at MISO’s discretion at any time when the SSR Unit is on-line, but MISO may not require more than four (4) Capacity Tests in a contract year. Capacity Tests. (a) The Buyer shall have the option, exercisable on no more than two (2) occasions per Contract Year, to require the Supplier, within ten (10) Business Days after written notice has been delivered to the Supplier, provided it is not during an Outage, to conduct a test, at the Supplier’s sole cost and expense, to confirm the ability of the Facility to produce the Contract Capacity as described below (the “Capacity Check Test”). Each Capacity Check Test consists of the Facility generating Electricity for eight (8) continuous hours during a period designated by the Supplier in advance as a test period, subject to coordination and approval of the IMO, and shall be evaluated based on calculation of the generator output at the generator terminals net of any Station Service Loads in accordance with the Metering Plan. The Supplier acknowledges and agrees that the Contract Capacity, the Facility output, and the Station Service Loads, as may be measured by the Capacity Check Test, shall not be adjusted for ambient, weather, or other conditions whatsoever. If the Capacity Check Test is interrupted by an event of Force Majeure, or if at any point during the Capacity Check Test, the air temperature, as reported at the Environment Canada weather station that is physically nearest to the Contract Facility (or in the case of a Contract Facility that is comprised of two or more generating facilities that are aggregated, the weather station that is physically nearest to one of the generating facilities so aggregated that has been selected by the Supplier), exceeded 30.0 degrees Celsius, then the Supplier may, at the Supplier’s sole cost and expense, re- perform the Capacity Check Test within ten (10) Business Days after the receipt by the Supplier of the Capacity Confirmation relating to such Capacity Check Test from the Buyer. (b) The Buyer shall provide to the Supplier, within five (5) Business Days after the completion of the Capacity Check Test, written confirmation of the energy output for each hour during the Capacity Check Test (the “Capacity Confirmation”). (c) To pass the Capacity Check Test, the Electricity output (in MWh) for each hour of the Capacity Check Test, divided by one hour, must be equal to or greater than the Contract Capacity. Capacity Tests. SELLER shall conduct capacity tests twice a year, once during the summer (June through August) and once during the winter (December through February) periods, in accordance with procedures specified by PECO. The procedures shall be based on and consistent with the GREEN BOOK. PECO shall have the right to require additional tests to meet specific PECO needs that are not required by the GREEN BOOK. PECO shall pay all costs incurred by the SELLER for such additional tests. PECO shall be the sole judge of the tests required.

Capacity Tests. SELLER shall conduct Initial Acceptance Tests for Phase 1 and Phase 2 and any subsequent Capacity Tests (subject to inspection by HELCO) in accordance with the testing procedures set forth in "Attachment L" to determine when Capacity Charge payments should begin or be adjusted in accordance with Section 5.1B.
Capacity Tests. Prior to the Commercial Operation Date, Seller shall schedule and complete a Commercial Operation Capacity Test in accordance with Exhibit O. Thereafter, Seller and Buyer shall have the right to run additional Capacity Tests in accordance with Exhibit O.
