Council Security. A. To assure that teachers covered by this Agreement are adequately represented by the Council, the District shall deduct from the pay of each teacher who was a member of the Council on March 14, 1974, and from the pay of each teacher who was and shall be thereafter hired by the District for the first time, a fair share fee, whether said newly hired teacher is or becomes a member of the Council or not. The amount of such fee shall be the amount of the dues in the United Teaching Profession (Southern Oregon Bargaining Council, Oregon Education Association and National Education Association). The District shall deduct one-tenth (1/10) of such fair share each month from the pay of each teacher who is not a member of the Council, beginning with the paycheck for the month of October. B. Any teacher, subject to paragraph A above, who has not requested payroll deductions of the fair share fee or who has not certified to the District that he/she has paid his/her dues directly to the Council, shall be subject to the payroll deduction herein provided. Such request for payroll deduction or certification of direct payment of dues shall be made by the fifteenth (15) day of October. C. The Council certifies that this agreement is formally executed pursuant to the approval of a majority of all teachers in the bargaining unit. D. Employees have the right to join the Council, but membership in the Council shall not be required as a condition of employment. The District will advise all newly employed personnel at the time of their employment of the identity of the exclusive bargaining representative of the teachers.

Council Security. A. In consideration of the service rendered by the CBC on behalf of all, such employees shall be required to pay to the CBC either: 1. Regular monthly CBC dues in the case of employees who are or become members of the CBC, or 2. An amount of money equivalent to regular monthly CBC dues in the case of employees who are not members of the CBC as a service charge to the CBC for negotiating and administering the contract. 3. Notwithstanding subparagraph 1 and 2, any employee who objects to making payments to the CBC based upon bona fide religious tenets or teachings of a church or religious body of which such employee is a member shall pay an amount of money equivalent to regular union dues and initiation fees and assessments, if any, to a nonreligious charity or to another charitable organization mutually agreed upon by the employee affected and the CBC. The employee shall furnish written proof to the District that this has been done. B. Employees who are now members of the CBC and employees hereafter hired who become members of the CBC shall have the right to terminate such membership by sending a withdrawal statement in writing to the CBC, with a copy to the District, within the thirty (30) day period preceding the next ending of this Agreement. C. All regular monthly CBC membership dues or equivalent charges shall be deducted as provided in ORS 292.055. The CBC will indemnify, defend, and hold the District harmless against any claims made and against any suit instituted against the District on account of any action taken under the provision of this Article.
Council Security. 8.01 The Employer shall as a condition of employment, deduct monthly an amount equivalent to regular membership dues, in a fixed amount, established by each of the Council affiliates according to each of their constitutional provisions, exclusive of any separate deduction for initiation fees, pension deductions, special assessments or arrears which may exist on the date this agreement comes into effect, from the pay of all employees of the bargaining unit. 8.02 The Council shall inform the Employer in writing of the authorized monthly deduction to be checked off for each employee defined in clause 8.01. 8.03 For the purpose of applying clause 8.01, deductions from pay for each employee in respect of each month will start with the first full calendar month of employment to the extent that earnings are available. When an employee does not have sufficient earnings in respect of any calendar month to permit deductions, the Employer shall not be obligated to make such deductions from subsequent salary. 8.04 As soon as practicable after the signing of this Agreement, the Employer will provide the Council with an up-to-date list of all employees in the Ship Repair bargaining unit and will provide appropriate lists semi-annually (April 1st and October 1st) of all employees who have been assigned to or have left the bargaining unit during the period. 8.05 An employee who satisfies the employer to the extent that he or she declares in an affidavit that he or she is a member of a religious organization whose doctrine prevents him or her as a matter of conscience from making financial contributions to an employee organization and that he or she will make contributions to a charitable organization registered pursuant to the Income Tax Act, equal to dues, shall not be subject to this article, provided that the affidavit submitted by the employee is countersigned by an official representative of the religious organization involved. 8.06 From the date of signing and for the duration of this Agreement, no employee organization, as defined in Section 2 of the Public Service Staff Relations Act, other than the Council, shall be permitted to have membership dues and/or other monies deducted by the Employer from the pay of employees in the bargaining unit. 8.07 The amounts deducted in accordance with clause 8.01 shall be remitted by cheques to the person designated by the Council within fifteen (15) working days of the date on which the deduction is made.
