Discrimination and Harassment Prohibited. 13.1 The University and the Union are committed to the principle of equal employment and educational opportunity as expressed in various state and federal laws and in University policies, including, without limitation, laws and policies on prohibiting illegal discrimination, sexual and other harassment, and bullying. See relevant policies: “Ensuring Equal Opportunity and Prohibiting Discrimination and Retaliation” (POL- U1600.02); “Accommodating Persons with Disabilities” (POL-U1600.03); “Preventing and Responding to Sex Discrimination, Including Sexual Misconduct” (POL-U1600.04): “Implementing Affirmative Action Program” (POL-U1600.05): and “Prohibiting Intimate Personal Relationships Between Supervisors and Supervisees” (POL-U1600.06). See also Appendix D – Code of Faculty Ethics. University policies on these subjects are published on the university website. The University agrees to give the Union at least 30 days’ notice of changes and/or additions to these policies and/or the additions of new policies and the opportunity to bargain over these changes and/or additional new policies.
13.2 Faculty who violate policies and laws referenced in Section 13.1 are subject to discipline as described in Section 19 and have rights to Union representation and grievance procedures as described in Sections 19 and 20.

The University agrees to give the Union at least 30 days’ notice of changes in these policies.
13.2 For the purposes of this Section, sexual harassment is defined as unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature when:
13.2.1 Submission to such conduct or activity is made either explicitly or implicitly a term or condition of an individual’s employment or academic progress.
13.2.2 Submission to or rejection of such conduct or activity is used as the basis for employment or evaluation.
13.2.3 Such conduct or activity interferes with an individual’s employment or educational advancement.
13.2.4 Such conduct or activity creates an intimidating, hostile or offensive environment.
13.3 Faculty shall not participate in conduct which violates this Section. Faculty who violate this Section or University policies on this topic shall be subject to a range of sanctions, including discharge.

The Company and the Union agree that discrimination and/or harassment of any employee, supervisor or manager because of sex, colour, national origin, religion, age, marital status, sexual orientation or disability is strictly prohibited. Every employee, supervisor and manager has the right to work in an environment of mutual respect, free from discrimination and harassment based on any of the above categories. Actions contravening this Article may constitute grounds for discipline.

EFF’s policy regarding discrimination, harassment, and retaliation, and the procedures for making a complaint regarding any such conduct, are set forth in the organization’s Employee Handbook.
C. The Union is committed to upholding the equal opportunity requirements and undertakings set forth in this Article and will cooperate with EFF in the administration and enforcement of these nondiscrimination policies and CBA provisions.

The Association and City agree that there shall be no discrimination of any kind by them against any employee on account of race, color, religion, age (to the extent prohibited by applicable state and federal law), sex or national origin. Complaints based on this Section 26 (No Discrimination), subsection A, shall be handled through the City’s harassment/discrimination/retaliation complaint procedure and shall not be subject to the City’s grievance procedure.
B. Neither the City nor the Association shall interfere with, intimidate, restrain, coerce or discriminate against employees covered by this Agreement because of the exercise of rights to engage in or not engage in Association activity.
