Duties of the User. §6.1 Loopholes in the data network or knowledge of spe- cial passwords must not be used to damage the data network, obtain extra resources, or steal resources from other users. §6.4 Users are obligated to understand instructions, do- cumentations etc. in a proper matter in order to reduce the possibility of interruptions in operations, the loss of data, programs or equipment due to lack of knowledge.
§6.5.1 Users must follow ethical guidelines set by Uni- nett for the use of internet.

Duties of the User. 3.1 The User shall monitor the Services in order to detect any Disruption to the Service.
3.2 In the event that:-
3.2.1 The User detects a Disruption and such Disruption continues; and
3.2.2 The User requires EGT to carry out Corrective Maintenance to the Network or Interface Equipments following the detection of a Disruption; the User shall so notify EGT (such notice herein after referred to as a "Fault Notice").
Duties of the User. 4.1. The User undertakes not to violate the law and/or cause damage during or in connection with any pro- gramming activity, nor through and/or within the framework of the User App, nor when using the Getting Started App. In the case of programming User Apps, the User shall moreover not enable the User App to be used to commit violations of the law and/or cause damage and shall take appropriate measures to ensure that the privacy and rights of the persons using the User App are protected. In particular, the User (a) shall not use and/or execute and/or provide for use and/or execution any contents with mal- ware, viruses, Trojans and/or other programs that can damage the software; (b) shall not violate morality with their use behavior, in particular shall not use the SOA dG and/or the Getting Started App and/or the User App for espionage or pornographic purposes or provide such use, directly or indirectly, within the scope of the User App; or (c) shall not violate any intellectual property rights and/or copyrights, personal rights, property rights or other rights of third parties and also shall not enable such violation within the scope of and/or by the User App.
4.2. Moreover, the User shall ensure that they do not realize a patent-protected method (e.g. by carrying out certain method steps or by using certain third-party programs or third-party apps) neither when using the Getting Started App, nor in connection with any programming activity, nor through and/or within the scope of the User App and/or individual functions, program components and/or applications.
4.3. The User shall ensure that no unauthorized persons gain access to the Getting Started App and in particular protect their access data against access by third parties.
4.4. The User shall ensure that in view of the User App, they maintain and/or respect the copyrights and license terms of SOA as well as of any third parties (see Article 3.8) by appropriate measures. For this purpose, the User undertakes to make the use of their User App subject to the approval of at least the terms contained in Annex 2.
4.5. The User acknowledges that they hold the sole liability and responsibility for their activities in connection with the Getting Started App. SOA merely provides the source code; however, does not assume any liability, neither towards the User nor towards third parties, for the actual application/execution and/or functions and/or the security or freedom from errors of the Getting Started App a...
Duties of the User. 6.1 The user avows that the particulars supplied to NEWTRON at the time of the conclusion of the access agreement (§ 2) are relevant and complete. The User is obligated to notify NEWTRON without delay of all future changes to the said particulars over the term of the contract in writing or electronically (fax, email). The foregoing also applies to all particulars which are used by the User to configure co-worker logins referred to in point 6.3 below.
6.2 The user also avows vis-à-vis other users, that the particulars supplied in the context of the exercise of the right of use such as the launch of auctions, the submission or acceptance of offers etc, in particular, are relevant and complete insofar as they are relevant to the contract.
6.3 Using the login with password transmitted via the confirmation of permission (§ 2.2) (hereinafter referred to as “Master Login”), the User has the option and is entitled to grant and configure a customized access authorization to the trading platform for co-workers of the User in order to allow the trading platform to be used in an optimal manner within the company where the User is employed. In addition to personal data of the co-worker, this access authorization for co-workers (hereinafter referred to as “Co-worker Login”) contains a series of authorizations and remits with the scope of the co-worker to use the functionalities and services of the trading platform being determined by the master login. The right to configure co-worker logins may also be conferred by the master login to an existing co-worker login. The User shall ensure and avow vis-à-vis NEWTRON as well as other sub-scribers to the trading platform that the holders of co-worker logins under the User’s master login comply with these General Terms and Conditions as well as other agreements with NEWTRON which are binding for the User. The activities of users of a co-worker login shall be attributed to the User as if they were his/her own personal activities. NEWTRON may and shall essentially not check whether co-workers of the User who appear on the trading platform via a co-worker login assigned by the User have the necessary contractual proxy. In this context, reference is again made for the avoidance of doubt to the above point 4.2 to 4.4 which state that the review of the contractual proxy of other platform subscribers is the sole responsibility of the respective User. Duties of the User. 5.1. Duties set out in these Terms and Conditions cannot be transferred to third parties.
5.2. Any processing of personal data within the meaning of the EU General Data Protection Regulation 2016/679 (GDPR), including disclosure to third parties, which is not related to the use of the CEERIS, is prohibited. This obligation also applies to data generated from the CEERIS, which can be allocated to individual vessels.
5.3. The User shall be responsible for creating the technical prerequisites for the unrestricted use of the CEERIS. The technical requirements include, in particular, the availability of an up-to-date operating system, uninterrupted Internet access, transmission speed, availability and stability of the network connections and accesses, and the installation of an up-to-date Internet browser (including the corresponding encryption protocol). The costs incurred for these technical prerequisites shall be carried by the User.
5.4. The User agrees to provide, orally or in written form, information about the usage of the CEERIS on request of the Operator.
5.5. The User is obliged to notify the Operator immediately of any interruptions, malfunctions, delays, deletions, changes, faulty transmissions or memory failures in connection with the CEERIS, as well as any other defects and problems, and, if necessary, to cooperate appropriately in their rectification.
5.6. The CEERIS is not intended to store data permanently. It is the User's responsibility to store data used in connection with the CEERIS outside the CEERIS in accordance with the User's requirements and any applicable record retention obligations.
5.7. The User shall be responsible for creating the legal conditions for its use of the CEERIS and for complying with all applicable legal provisions (in particular EU data protection and labor law provisions).
5.8. The CEERIS is the intellectual property of the RIS Authorities/Providers of the Czech Republic, Austria, Slovakia, Hungary, Croatia, Serbia, Bulgaria and Romania. The User is obliged to refrain from anything that enables him or third parties to imitate CEERIS. Furthermore, the User undertakes to use the CEERIS only for his own purposes.
Duties of the User. At this point, we would like to draw your attention to some obligations that you must observe when using the WLP services.
9.1 The User has to implement the coaching and instructions in the WLP offers according to the instructions. This applies, in particular, to the physical exercises and recipe instructions of the functions “Coach”, “Activity”, “Loosening up / Releasing tension” and “Nutrition”.
9.2 If the User does not clearly understand any coaching or advice, the User must contact eTherapists GmbH before carrying out the coaching or advice in order to resolve any ambiguities. This contact is free of charge for the User and can be made via the contact options specified in Clause 1.3. In addition, the “Contact health experts” function can be used for questions about the coaching sessions or tips.
9.3 The User’s attention is once again expressly drawn to the observance of the health instructions in Clause 3 of these Terms. Disregarding the health instructions can lead to injury and health risks. This applies, in particular, to previously ill users, pregnant women or users who suffer from food intolerances or allergies.
9.4 The User shall notify eTherapists GmbH without undue delay if he/she suspects that third parties have gained unauthorised access to the User’s account. The same applies if the User becomes aware that the rights of eTherapists GmbH are being infringed by third parties.
9.5 If rights of eTherapists GmbH are violated by third parties, or if unauthorised access to the user account has occurred and if the User can contribute to the defence of these rights or the clarification of the unauthorised access, the User shall support eTherapists GmbH in the defence of its rights. The support concerns, in particular, the provision of relevant information and documents.
9.6 eTherapists GmbH strongly advises users to regularly back up their data stored on the mobile device or the User’s computer, in order to minimise the damage of a possible data loss.
9.7 To use the WLP offers and WLP App, you must be at least 16 years old. If you are at least 16 years old but have not yet reached the age of 18, you may only use the WLP services and WLP App if your parents or legal guardians give their consent.

Duties of the User. (1) The user undertakes to comply with the following duties when using the Library. He may not, in particular: -cause damage to persons, especially minors, or infringe their personal rights; -breach the rules of good conduct by way of his use; -infringe industrial property rights and copyrights or other property rights; -give himself a false identify for the purpose of deceiving others; -transfer content with viruses, so-called Trojan horses, hoax viruses or other programs which can dam- age software; -insert, save or send hyperlinks or content he is not authorised to use, especially if these hyperlinks or content breach confidentiality obligations or are illegal; or -disseminate advertising or unrequested e-mails (spam) or incorrect warnings of viruses, malfunctions and similar or encourage people to participate in games of chance, pyramid sales systems, chain letter, pyramid game and comparable campaigns.
Duties of the User. 5.1 You undertake to keep any passwords received from SENNHEISER for access to the Sennheiser service portal and any later changed passwords as a strict secret, and to inform XXXXXXXXXX immediately as soon as you become aware that such a password has become known to unauthorized third parties.
5.2 You confirm and assure that your personal details stated on concluding the agreement and other data relevant to the contract are complete and correct. You undertake to inform XXXXXXXXXX without delay of any changes to the data by making adjustments within the Sennheiser service portal. You also undertake to confirm that the data are correct and up-to-date at any time, should this by queried by XXXXXXXXXX.
5.3 You confirm and assure that you have been selected by the SENNHEISER's sales partner and are entitled to set up access to the Sennheiser service portal.
5.4 In the event that your employment with the sales partner who has consented to the access authorization should be terminated, you undertake to inform XXXXXXXXXX accordingly. You also undertake not to use the SENNHEISER service portal any longer after termination of your corresponding employment.
5.5 You declare and confirm that you are bound to abide by these conditions of use and to the scope of the license granted with these conditions of use.
5.6 You are aware and herewith confirm that XXXXXXXXXX is entitled at any time to change the contents, alter the access authorizations and to block or limit access to the Sennheiser service portal.

6.2 A&D may deny access to the A&D Web Site at any time, in particular if the user breaches any obligation arising from these Terms of Use.
