Evaluator Responsibilities. 1. The evaluator shall schedule an annual goal-setting conference to meet and discuss the employees Professional Reflection Form (Form 1). 2. The evaluator shall schedule a minimum of two (2) Observation Cycles with all employees assigned to the Summative Evaluation Process. 3. The evaluator shall complete a post-conference within five (5) work days of each observation. 4. The evaluator shall complete the Observation Report forms (Form 5) within three (3) work days following each post-conference. 5. Within three (3) days following the observation, the evaluator will hold a post-observation conference with the employee. Within five (5) days following the post-observation conference, the evaluator shall provide a written report to the employee. 5. The evaluator may decide to move the employee to a Long Form Evaluation process, which may include a Plan of Improvement after the employee’s annual growth goals have been established, provided that the decision is made and communicated to the employee in writing, including the reason for the decision, no later than March 1. 6. The evaluator shall submit copies of the annual PGAP Verification Form (Appendix 8l-3) to Human Resources no later than ten (10) days after the close of school.

Evaluator Responsibilities. (a) The Evaluator shall install and operate the Product in accordance with the applicable nCipher specifications and instructions and shall preserve the Product in the same condition as it is received, fair wear and tear excepted. (b) All information relating to the Product, including, but not limited to, object codes, technical manuals and other documentation is confidential and proprietary to nCipher, and Evaluator shall hold the Products, related documentation, evaluation results and all related information strictly confidential. The Evaluator shall not disclose any such confidential information to any person other than its own duly authorised personnel without the prior written approval of an authorised representative of nCipher and shall take all reasonable steps to ensure that such information remains confidential. Evaluator shall use such confidential information only for the Purpose and Evaluator agrees that it shall not use, or exploit the confidential information for its own benefit or for the benefit of another. Evaluator agrees that it will promptly report any actual or suspected violation of the terms of this Agreement to nCipher and that it will take all necessary steps to prevent, control or remedy any and all such violations. These obligations of confidentiality shall continue until such time as the Evaluator has obtained the written consent of an authorised representative of nCipher that these obligations have expired. (c) The Evaluator agrees that it shall be responsible for all loss of or damage to the Product while it is in the Evaluator’s custody, excluding only losses or damage caused by the acts or omissions of nCipher or its agents and contractors. (d) The Evaluator agrees that it shall be responsible for all local duties and taxes in connection with the Evaluation Equipment. (e) Within ten (10) days of expiration or termination of this Agreement, whichever is the earlier, Evaluator shall: (i) return the Product and all associated items, (including, but not limited to software), to nCipher; and (ii) delete all electronic copies of the Product and associated items. Evaluator shall be solely responsible for the cost of shipping and appropriate insurance for the return of the Product and associated items.

The pre-conference shall be no less than prior notification and clarification about the focus of the observation. The post-conference shall be no less than an opportunity to provide feedback about the focus of the observation. When the observation occurred in a group setting the reasonable interval of time is recognized to be more flexible.
