Operation of Sick Leave Bank. The following conditions shall control the operation of the sick leave bank and the rights of the employees to utilize the bank: After a participant is a member of the sick leave bank for a minimum of sixty (60) calendar days and upon depletion of his/her sick and vacation leave shall be eligible to draw days from the bank with the following stipulations: use of sick leave bank is restricted to those members who have not used the bank for at least three (3) years. use of the sick leave bank will be restricted to no more than thirty (30) work days per school year.

Operation of Sick Leave Bank. The Board shall, within thirty (30) calendar days after the beginning of the school year upon receipt of a properly completed and signed Sick Leave Bank Authorization Form, deduct one (1) day’s sick leave from the authorizing employee’s earned sick leave allotment. Individual participation in the Sick Leave Bank by certified teachers in the bargaining unit shall be voluntary but irrevocable. The Sick Leave Bank shall be for the use of certified teachers in the bargaining unit who have exhausted their sick leave accumulation and whose request has been approved by the Association. The Association shall establish and administer the policies and procedures of the Sick Leave Bank (for the complete set of said policies and procedures, see the Sick Leave Bank Guidelines, available through the Association) subject to the following limitations: A. The Board shall not be obligated for any additional days in the Sick Leave Bank over a maximum of 1,000 days per school year unless otherwise agreed to by the Association and the Board. B. The Association’s decisions in granting, denying, or suspending grants of sick days from the Sick Leave Bank shall be final. C. If the sick leave bank balance falls under 250 days, all Sick Bank members will repay the bank by deducting one (1) day’s sick leave from his/her sick leave allotment.

(Ratified 1/2008) 3. A doctor's statement certifying the illness and necessity for the protracted leave is required, and must be submitted with the Application for Use of the Sick Leave Bank Form. Reapplication to the sick leave bank requires a separate Application for the Use of the Sick Leave Bank Form and must be accompanied by a doctor's certification that the current illness/injury is not the same or related to an illness/injury used for sick leave bank benefits in the past. The member must also complete and submit a “Request/Reason for Absence. (Ratified 12/2009) 4. The employee shall not have to pay back in any manner the number of days used from the bank. (Ratified 1/2008) 5. The use of the bank shall be applicable to the illness, accident or injury of only the eligible employee. A member shall not use days from the pool for maternity/paternity purposes. (Ratified 1/2008)

Repayment will begin on or before September 30 of the next contracted school year. Twenty (20) days is the maximum number of days to be repaid and will be prorated as established in the Association’s Sick Leave Bank Guidelines. If the member does not return the following year, or retires that year, the member must pay back the School Corporation for the number of days owed multiplied by the current substitute teacher rate, and the School Corporation will then credit the Sick Leave Bank one (1) sick leave day for each sick leave bank day repaid.

Related to Operation of Sick Leave Bank

  • Donation of Sick Leave 8.10.1 On a case-by case basis and with mutual agreement between the Association and the District, any bargaining unit member may donate five (5) days (40 hours) of accumulated sick leave to another bargaining unit member who has suffered a long- term, non-industrial related illness or injury and who will exhaust all fully paid leaves. The employee suffering from such illness or designee must request, in writing, donations of sick leave from bargaining unit members only, through the Personnel Office. Requests shall be made prior to the exhaustion of all fully paid leave. Donation of sick leave will not be retroactive. 8.10.2 The Personnel Office will send out the notification of the request for donations of sick leave. The request will be sent for posting on all CUEA bulletin boards and the CUEA President notified of the request. All donations of sick leave will be voluntary with no personal solicitation of donors allowed. The names of any bargaining unit members donating sick leave under this provision will not be made public. 8.10.3 Only bargaining unit members who have a minimum of fifteen (15) days (120 hours) of accumulated sick leave remaining after donating five (5) days (40 hours) of sick leave under this provision will be permitted to participate in this program. Employees eligible to donate sick leave will do so on a District approved form and must submit that form to the Personnel Office. 8.10.4 The maximum amount of sick leave that may be donated to any one person requesting donations under this provision will be equivalent to sixty (60) days. 8.10.5 Donated sick leave will be utilized for the specified employee in the following manner: (A) donated sick leave will be assigned a usage number. The first donated sick leave received by the Personnel Office will be the first sick leave used by the beneficiary. As sick leave is used by the unit member requesting it, the leave time will be charge against the unit member donating the sick leave. (B) if the employee returns to work prior to using all donated days, unused sick leave will be returned to the bargaining unit member donating the sick leave. 8.10.6 Up to an additional twenty (20) days (160 hours) of donated time may be requested in writing to the Assistant Superintendent, Personnel Services by the affected member or his/her immediate family. In this case, Section 8.10.5 procedures will be put into effect. 8.10.7 When all paid leaves of absence have been exhausted, and the unit member is unable to return to work, in lieu of resigning the unit member may elect to do one of the following: take a personal leave without pay pursuant to Section 8.5 or Article VIII for not to exceed the remainder of the school year in which the leave occurs, or retire if eligible pursuant to the provisions of the State retirement system.

  • Verification of Sick Leave The appointing officer or designee to whom application for sick leave is made may make such independent investigation as to the necessity for sick leave as is deemed proper and may require certification for any period of sick leave, provided that the employee has been previously notified in writing that such certification for absence of less than five working days shall be required. The Human Resources Director may at any time make such independent investigation as may be deemed proper regarding the illness of any person on sick leave.

  • Accumulation of Sick Leave The unused portion of an Employee's sick leave shall accrue for her future benefit, up to a maximum of one hundred and thirty (130) days.

  • Sick Leave Bank The school corporation agrees to, and hereby establishes a voluntary sick leave bank to which certificated persons may contribute unused sick leave days, and from which a contributing individual may draw sick leave days when the individual’s annual and accumulated sick leave days are exhausted, in accordance with the following provisions. Please see the definitions of sick leave under Article IV. 1. The sick leave bank shall apply to all persons employed by the school corporation whose employment requires the holding of a license issued by the Indiana Department of Education, whether or not any such person is a member of the bargaining unit to which this contract applies. 2. A “contributing individual” is one who, within the first thirty (30) days of the contract year, signs a contribution form. Such contribution form shall require the assigning of one (1) day of sick leave to the sick leave bank and an individual may contribute up to five (5) total days if so motivated during any enrollment period. 3. A person shall cease to be a contributing individual upon the failure of such individual to sign such contribution form and such individual shall thereafter not be entitled to draw any sick leave days from the sick leave bank until becoming a contributing member the following year. 4. Present and new faculty members who wish to become “contributing individuals” may do so by following the procedure in paragraph two (2). Staff who hire in after the annual enrollment period closes can still enroll under equivalent timelines as original enrollment period. 5. Use of the sick leave bank shall be subject to the following limitations: a. Sick bank leave shall be used on a teacher’s first day receiving no pay as long as the teacher has exhausted all accumulated sick days, as well as all annual sick and personal days. Days may need to be allotted retroactively to allow time for the sick bank committee to meet and review the request. In the event a teacher on sick bank leave returns to work and then finds it necessary on advice of a doctor to take additional leave for the same disability, no additional days shall be deducted subject to the approve of the Sick Bank Review Committee. b. In the even a teacher is disabled as a result of illness or injury of a different nature during the same school year, any additional sick leave bank time granted is subject to approval of the Sick Bank Review Committee. c. Sick bank leave shall be used for the purposes permitted by the Federal Medical Leave Act (FMLA) and must be supported by a written request by the contributing individual and the appropriate FMLA certification specifying the nature of the illness and prognosis report for the teacher’s return to work. d. Days taken from the sick leave bank shall apply only to those days on which a teacher would receive pay if the teacher were not under disability. e. All contractual leave days shall be waived while drawing pay from the sick leave bank so that a teacher in no case will be drawing double pay for any day. f. This sick leave bank section shall not operate in any manner such that any teacher receiving workers compensation benefits receives more than such teacher’s regular pay. g. Paid holidays, if any, shall not be charged against the sick leave bank, but shall be compensated for under the terms of the teacher’s contract. h. Sick leave bank days shall not be used during summer school employment, nor shall such days be used at any other times except the regular school year. i. Leave from the sick leave bank may not be used for maternity or childbirth leave, but may be used for any physical disability arising out of a pregnancy. j. Teachers who, as of the beginning of the school year in which sick leave bank benefits are requested and used, have accumulated the following number of sick leave days under the sick leave section of this contract, shall be eligible to draw up to a maximum number of days from the sick leave bank in any single year as follows: (1) 0-10: Up to 60 days (2) 11-40: Up to 90 days (3) 41 or over: Up to 120 days k. Teachers may be awarded fewer than maximum days (listed in Section j) at the discretion of the Sick Bank Review Committee. 6. Should the sick leave bank fall to a thirty (30) day balance during a school year, an additional contribution will be requested and will count toward the subsequent enrollment period. 7. A Sick Bank Review Committee shall be formed and shall be comprised of three (3) members appointed by the exclusive representative and one (1) individual appointed by the Superintendent. The committee shall consider and review all requests for use of sick bank days to ensure that all applications submitted, and any grants made, are in accordance with the provisions of this contract. 8. The school district shall notify certificated employees of the enrollment period for the sick bank, including required contribution forms and appropriate deadlines, within the first five (5) school days of each school year. 9. If there are seven hundred and fifty (750) days in the bank at the time of open enrollment, no contribution will be necessary unless it falls below the previously described number of thirty (30) days.

  • Extension of Sick Leave Unless an employee otherwise requests in writing, an employee who has used up her sick leave credits shall be granted advanced sick leave with pay for a period up to fifteen (15) days subject to the deduction of such advanced leave from any sick leave credits subsequently earned.

  • Abuse of Sick Leave Misuse of leave, violation of orders, directives, or contractual requirements concerning the use of sick leave and other forms of leave used in lieu of sick leave are cause for disciplinary action.

  • Reporting of Sick Leave The employee will call in sick or returning in accordance with Article 14.05 to the designated employer for purposes of payment. For purposes of notification of absence, the employee will notify the appropriate home in accordance with Article 14.05 of their absence that shift.

  • Vacation, Holidays and Sick Leave During the Term, the Executive shall be entitled to paid vacation, paid holidays and sick leave in accordance with the Company's standard policies for its senior executive officers.

  • Vacation Leave on Retirement ‌ An employee scheduled to retire and to receive pension benefits under the Public Service Pension Plan Rules or who has reached the mandatory retiring age, shall be granted full vacation entitlement for the final calendar year of service.

  • Paid Sick Leave For those jurisdictions that have passed or will pass legislation requiring Paid Sick Leave, Paid Sick Time will be billed back to Client at the straight-time bill rate for all hours taken by any Consultant assigned to Client. This section is not applicable until the effective date of such legislation has been reached.
