Use of the Sick Leave Bank. A. Application of Need
1. Written application by the teacher or a member of his/her family accompanied by a physician’s certificate, or other approved medical documentation as determined by the committee, stating the nature, length of disability, and prognosis of the person’s condition shall be submitted to the Chairman of the Sick Leave Bank Committee. All medical information concerning an applicant shall be held in strict confidence by the Committee.
2. The Sick Leave Bank shall not be used for maternity unless said maternity results in a medical condition, which prohibits the person from returning to work due to medical reasons.
3. The committee may request the teacher to provide a renewed physician statement, or other approved medical documentation as determined by the committee, as to the nature of the illness or incapacity and a prognosis report for returning to work.
Use of the Sick Leave Bank. After a member has exhausted all of his/her own yearly and accumulated sick leave, he/she may apply to the Committee of the Sick Leave Bank for additional sick leave, to be drawn against the Bank.

Use of the Sick Leave Bank. Said participating licensed personnel members who join the bank for the current school year and have depleted their chargeable leave and accumulated sick leave may draw upon the bank as provided:
Use of the Sick Leave Bank a. A maximum of two hundred (200) days may be borrowed by an employee in a five (5) year period. There shall be a lifetime cap of four hundred (400) days. This maximum lifetime cap will not include days used by employees under the old sick bank system.
b. An employee must use all available sick leave, vacation time and personal business leave prior to receiving days from the sick bank. An employee who suffers a qualifying event beyond their available sick leave, may apply for a grant from the Sick Leave Bank on the appropriate form. If the leave is granted by the Sick Leave Bank Committee, benefits will be retroactive from the first day of need.
c. Notice of exhaustion of accumulated sick leave shall be provided. If, however, such notice is not provided prior to exhaustion, the employee may borrow without written notice of intent until such time that notice is given.
d. If an employee does not use all of the days granted from the Sick Bank, the unused Sick Leave Bank days will be returned to the Sick Bank.
e. With approval from the committee and the Superintendent, Sick Bank Leave may be used for Family Sick.
f. The Sick Leave Bank may only be used for the employee’s own personal illness.
g. Sick leave from the Sick Leave Bank may not be used for disabilities that qualify the employee for Workers’ Compensation Benefits. (Sick Leave Bank participants receiving sick leave in lieu of Workers’ Compensation due to a contested claim will be responsible for reimbursing the Sick Bank should they be awarded Workers’ Compensation.)
h. Each separate application for a grant from the bank must include a new physician’s statement and application on the appropriate Sick Leave form.
i. All requests to draw on the Bank must be made upon a Sick Leave Bank Request Form and be submitted to the committee unless extenuating circumstances do not allow for an application be completed.
j. All requests to draw upon the bank must be accompanied by Physician’s Statement confirming the cause of illness or confinement and certifying the existence of a disability to perform assigned duties. The employee’s physician must personally sign the form.
k. The Sick Leave Bank Committee shall have the right to request additional medical information if it deems such information necessary. A physician’s report is to be sent directly to the Superintendent to be submitted to the Committee for action.

Use of the Sick Leave Bank a. Eligible teachers shall make application for use of Sick Leave Bank days in writing to the Chairman of the Committee.
b. All applications for use of Sick Leave Bank days shall be accompanied by a statement from the teacher’s attending physician who shall (1) certify and describe the nature of the disability or illness, (2) state the treatment being provided, and (3) state the prognosis for return to performance of assigned duties and responsibilities.
c. A teacher may, upon recommendation of the Committee, use up to a maximum of thirty days (30) from the Sick Leave Bank during any one regular school year.
d. In all cases, the Board reserves the right to require a statement from the teacher’s attending physician attesting to the teacher’s fitness to return to employment and resume the full performance of the duties and responsibilities to which he may be assigned.
Use of the Sick Leave Bank. An employee shall not be able to utilize days from the bank until after his/her own accumulated sick leave and personal leave days have been depleted. The employee or Association designee must request use of the Sick Leave Bank by notifying the Sick Leave Bank Committee in writing including a note from the doctor verifying the need for additional leave.
Use of the Sick Leave Bank. A. Application for use of days from the Sick Leave Bank will be in writing on forms designed by the Sick Leave Bank Committee.
B. Five (5) days of absence must occur following the exhaustion of all accumulated leave time before the teacher shall be eligible to draw upon days from the Bank.
C. Disabilities covered by Workmen's Compensation are excluded from application.
D. To draw from the Sick Leave Bank, teachers must:
1. Have made a contribution to the Sick Leave Bank from their own available sick leave days.
2. Have utilized all current and accumulated leave time available to them.
3. Submit a request for use of Sick Leave Bank to Sick Leave Committee.
4. Provide such medical evidence as may be required at such intervals deemed appropriate by the Sick Leave Bank Committee in order to verify the need of the requested days.
Use of the Sick Leave Bank days in the case of pregnancy related disability will be limited to cover the actual period of disability as certified by the attending physician.
