PAYMENT FOR ABSENCES. 1. STUDENT ABSENCE: SCUSD shall not be responsible for the payment of services when a student is absent.
PAYMENT FOR ABSENCES. (a) An instructional day from which a child is absent is payable if the child’s absence is excused. If a child’s absence is unexcused, the absence is payable, not to exceed three unexcused absences per calendar month. (b) A child’s absence is excused if the child does not attend the VPK program on an instructional day due to one of the following reasons: 1. Illness or injury of the child or the child’s family member which requires hospitalization or bed rest; 2. Physician or dentist appointment; 3. Infectious disease or parasitic infestation; 4. Funeral service, memorial service, or bereavement upon the death of the child’s family member; 5. Life-threatening illness or injury of the child’s family member; 6. Compliance with a court order (e.g., visitation, subpoena); 7. Special education or related services as defined in 20 U.S.C. § 1401 (2004) for the child’s disability; 8. Observance of a religious holiday or service, or because the child’s or parent’s religion forbids secular activity on the instructional day; 9. Family vacation, not to exceed five excused absences per program year; or 10. Extraordinary circumstances beyond the control of the child and the child’s parent. (c) An excused absence is not payable unless the reason for the absence is documented in writing and submitted to the VPK provider. A VPK provider must keep the documentation for at least 1 year, allow the Agency for Workforce Innovation or the coalition to inspect the documentation during normal hours of operation, and submit a copy of the documenation to the coalition upon request. 1. A child’s parent may document (e.g., parent’s note) seven or fewer excused absences per calendar month. 2. Beyond seven excused absences, a person other than the child’s parent must document the excused absence, the person must be unrelated to the child or the child’s parent, and the documentation must show that the person has personal knowledge of the reason for the child’s absence (e.g., letter from a physician). (d) An absence is not payable for an instructional day before a child’s first day of attendance or after the child’s last day of attendance. (e) Payment for a child shall be suspended if the child does not attend at least 1 instructional day during a calendar month. Payment for the child, including payment for absences accruing while payment is suspended, shall resume when the child subsequently attends the program. PAYMENT FOR ABSENCES. NONPUBLIC SCHOOL STAFF ABSENCE Whenever a classroom teacher employed by CONTRACTOR is absent, CONTRACTOR shall provide an appropriately credentialed substitute teacher in the absent teacher’s classroom in accordance with California Education Code section 56061. CONTRACTOR shall provide to Shasta SELPA/District of Residence documentation of substitute coverage pursuant to the Shasta SELPA/District of Residence Procedures. Substitute teachers shall remain with their assigned class during all instructional time. Shasta SELPA/District of Residence will not pay for instruction and/or services unless said instruction or service is provided by an appropriately credentialed substitute teacher. Whenever a related service provider is absent, CONTRACTOR shall provide a qualified (as defined in Section Seven (7) of this agreement and as determined by XXX) substitute. Shasta SELPA/District of Residence will not pay for services unless a qualified substitute is provided and/or CONTRACTOR provides documentation evidencing the provision of “make-up” services by a qualified service provider within thirty (30) calendar days from the date on which the services should have been provided unless otherwise agreed in student’s IEP. NONPUBLIC SCHOOL STUDENT ABSENCE If CONTRACTOR is a nonpublic school, no later than the tenth (10th) cumulative day of a student’s unexcused absence, CONTRACTOR shall notify the Shasta SELPA/District of Residence of such absence as specified in the Shasta SELPA/District of Residence Procedures. Criteria for a billable day for payment purposes is one day of attendance as defined in California Education Code, sections 46010, 46010.3 and 46307. Shasta SELPA/District of Residence shall not pay for services provided on days that a student’s attendance does not qualify for Average Daily Attendance (ADA) reimbursement under state law. Per Diem rates for students whose IEPs authorize less than a full instructional day may be adjusted on a pro rata basis in accordance with the actual proportion of the school day the student was served. Shasta SELPA/District of Residence shall not be responsible for payment of DIS or related services for days on which a student’s attendance does not qualify for Average Daily Attendance (ADA) reimbursement under state law, nor shall student be eligible for make-up services. PAYMENT FOR ABSENCES. STAFF ABSENCE When CONTRACTOR is a nonpublic agency and CONTRACTOR’s service provider is absent, CONTRACTOR shall provide a qualified (as defined in section seven (7) of this agreement and as determined by LEA) substitute, unless XXX provides appropriate coverage in lieu of CONTRACTOR’s service providers. XXX shall not pay for services unless a qualified substitute is provided and/or CONTRACTOR provides documentation evidencing the provision of “make- up” services by a qualified service provider within thirty (30) calendar days from the date on which the services should have been provided. CONTRACTOR shall not “bank” or “carry over” make up service hours under any circumstances, unless otherwise agreed to in writing by CONTRACTOR and XXX. In the event services were not provided, reasons for why the services were not provided shall be included.

PAYMENT FOR ABSENCES. Employees shall accrue prorated each pay period equivalent to twelve (12) days annually. The maximum accrued but unused paid leave which may be carried over from one calendar year to the next will not exceed 1040 hours. With the approval of the employee's immediate supervisor, paid leave may be used as either sick leave or paid absence for personal business. The maximum amount of accrued but unused paid leave that can be used for paid absence for personal business in any one year is twenty-four (24) hours. Permission for Personal Business Absence must be obtained in advance and will be granted for business requiring the employee's personal presence (such as: closing on a real estate transaction, renewing a driver’s license or car registration, closing an estate, appointments with lawyers to consult about personal legal matters, delivery of major appliances and utility connections).

PAYMENT FOR ABSENCES. The District and the parent/guardian, if required to pay a percentage of the child care cost as a fee, shall pay for the child in care whether the child is present or absent from the program. Providers will receive payment for up to eight absences a month (excused or unexcused) (Appendix B OSSE’s Subsidized Child Care Attendance Policy). The District shall pay the applicable daily rate less the parent co-payment for Level I providers.
