PERSONNEL EMPLOYMENT. The CONSULTANT warrants that it has not employed or retained any company or person, other than a bona fide employee working solely for the CONSULTANT, to solicit or secure this agreement, and that he has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the CONSULTANT, any fee, commission, percentage, brokerage fee, gifts, or any other considerations, contingent upon or resulting from the award of making of this Agreement. For breach or violation of this warranty, the OWNER shall have the right to annul this Agreement without liability or, in its discretion to deduct from the agreement price or consideration, or otherwise recover, the full amount of such fees, commission, percentage, brokerage fee, gift or contingent fee.

PERSONNEL EMPLOYMENT. A. 1. All new teachers will be placed on the proper step of the salary schedule according to their certification, experience, and education, but not to exceed Step 18 of the appropriate lane. PERSONNEL EMPLOYMENT. A. 1. With the exception of rehired retired teachers, all new teachers or reinstated teachers will be placed on the proper step of the salary schedule according to their certification status, experience, and education. a. In calculating experience, newly hired teachers who have worked one-half (1/2) year or more of a work year for their prior employer, will be given credit for a full year. The one-half (1/2) year cutoff date for experience credit will be the first day of the second semester. b. All currently hired teachers who work one-half (1/2) year or more of the work year shall be given credit for a full year. c. All teachers hired to fill vacancies which they have served in for one-half (1/2) year or more of a work year shall be given experience credit for a full year and paid a pro- rated salary for the actual period worked. d. The Private Partner shall, at its own discretion and at its own expense, take all appropriate measures to ensure employment and remuneration of labor of the personnel in accordance with the Legislation. 8.1.2. Prior to the Commissioning Date the Private Partner may (but shall not be required to) evaluate and select personnel from the staff of the Public Partner. The transfer of the Public Partner’s personnel to the Private Partner shall be carried out in accordance with the Legislation subject to the written consent of the personnel and at the discretion of the Private Partner. New employees shall be given full credit for previous teaching experiences acquired while they were under contract in an accredited program, EXCEPT THAT THE SALARY PAID TO A NEWLY HIRED, EXPERIENCED EDUCATOR WILL NOT EXCEED THE SALARY OF A CCPS EDUCATOR WITH EQUAL, CONTINUOUS EXPERIENCE.  In any reduction in force as a result of budgetary actions or curriculum and/or administrative reorganization, teachers EDUCATORS shall be laid off solely on inverse order of seniority by date of employment based on certification for said positions. If two unit members share the same date of contract, the lottery shall determine whose position is reduced. Subject to certification endorsement, normal attrition (teachers EDUCATORS who resign or retire will not be replaced) will be used to reduce positions, if possible. EDUCATORS Teachers on layoff shall be "recalled" when vacancies become available in reverse order of their seniority. While a layoff continues no new teachers EDUCATORS will be hired for employment except in the unique circumstances where; (a) there are no EDUCATORS teachers on layoff qualified to fill a vacant teaching position; or (b) all qualified EDUCATORS teachers on layoff decline the offer to fill the vacancy. Teachers EDUCATORS shall; (a) receive written notice a reasonable period in advance of the deadline for determining whether to exercise recall rights; and (b) retain recall rights for a period of four (4) years. Teachers EDUCATORS on layoff shall have priority when a vacancy exists in serving as long-term substitutes in their certificated area if the certification(s) remain valid, as long as delivery of instruction remains consistent.   TUITION/LICENSE/CERTIFICATION FEE & REIMBURSEMENT:  ALL LAID OFF EDUCATORS SHALL BE EXEMPT FROM HAVING TO REPAY ANY TUITION REIMBURSEMENT AND/OR LICENSE-CERTIFICATION FEES.  EDUCATORS THAT HAVE BEEN LAID OFF ARE NOT ELIGIBLE FOR TUITION REIMBURSEMENT AND/OR LICENSE CERTIFICATION FEES B...
