Promotions Outside Bargaining Unit. When an employee is transferred or promoted to a position outside the bargaining unit, he will retain his seniority and continue to accumulate seniority for a period not to exceed 180 calendar days from the date of such transfer or promotion. After such 180 calendar day period, the employee shall not have any seniority under this Agreement. Should the employee return to the bargaining unit within a period of 180 calendar days, and there is then no vacancy which, by reason of his seniority, he is entitled to fill, he may displace the employee with the least seniority, provided he has the skill and ability to do the work of the junior employee. In the event of such displacement, the senior employee will be reclassified into the job classification of the junior employee and be paid the rate of such job. Any employee returned to the bargaining unit following a transfer pursuant to this Article 12.08 shall qualify for benefits under this Agreement, based on his total continuous service with the Company. This shall be done once during the term of the employee’s employment.

Should the employee elect to return to the bargaining unit within a period of one hundred and eighty (180) calendar days, and there is then no vacancy which, by reason of his seniority, he is entitled to fill, he may displace the employee with the least plant wide seniority, provided he has the skill and ability to do the work of the junior employee. In the event of such displacement, the senior employee will be reclassified into the job classification of the junior employee and be paid the rate of such job. Any employee returned to the bargaining unit following a transfer pursuant to this Article 15.04 shall qualify for benefits under this Collective Agreement, based on his total continuous service with the Employer. Promotions Outside Bargaining Unit a) When an employee within the bargaining unit covered by this Agreement receives a leave of absence, in writing, with a copy to the Union, to take a position within the Company which is beyond the sphere of the bargaining unit, he may retain his seniority for a maximum of ninety (90) calendar days within the former unit. The starting date of such an appointment shall be posted in the Terminal. During this leave of absence such employee shall continue to be covered by the Health and Welfare and the Pension Plan as provided in this Agreement. b) At the end of this period of ninety (90) calendar days, the employee must exercise his seniority rights by returning to his former unit or relinquish all such seniority rights. Should the employee return or be returned to the bargaining unit for any reason, he must remain within the unit for a minimum period of one hundred and twenty (120) calendar days prior to exercising that privilege again.

No more than five (5) employees at any one time will be covered by this provision and no employee can be covered by this provision more than once. Ten (10) working days notice will be given to the Union before a selected employee becomes a trainee. a. During the training program, the trainee may work at jobs both within and out of the scope of the bargaining unit and while working in scope will be subject to the provisions of the agreement. b. The trainee will maintain their status in the bargaining unit for the duration of the training period unless the Employer transfers the trainee outside of the bargaining unit under the provisions of 23.01 above. c. Trainees and students involved in training will not discipline any employee in the bargaining unit.
Promotions Outside Bargaining Unit. An Employee shall receive a six (6) month trial period if promoted to a position outside the Bargaining Unit, except that the trial period shall be extended to twelve (12) months if the Employee is promoted into sales. The affected Employee shall maintain seniority during such trial period. The six (6) month period may be extended by a further six (6) month period on request of the Employee and approval of the Company, and if granted seniority shall be maintained during such extension. The extension will not be approved where it adversely affects the Employee filling the promoted Employee’s position.
Promotions Outside Bargaining Unit. In the event that an employee covered by this Agreement is promoted to a position outside of the bargaining unit, and such employee is subsequently transferred back into his/her classification within the bargaining unit, he/she shall be credited with the amount of seniority that he/she had acquired before his/her transfer. He/she shall not be eligible to replace any employee other than the one with the least seniority in the department to which he/she returned. After an employee has been transferred out of the bargaining unit for a period in excess of six (6) months, he shall not have any seniority rights under Article VII, unless the COMPANY and the UNION in writing mutually agree to such.
