PROTECTION OF TEACHERS, STUDENTS AND PROPERTY. A. When in the judgment of a teacher, a student requires the attention of a counselor, pupil personnel services employee, school nurse, or other specialist; he will so inform his Principal. The Principal will arrange as soon as possible for a conference among himself, the teacher, and the specialist to discuss the problem and to decide upon appropriate steps for its resolution.
B. Physical force may be used by a teacher to protect himself or another teacher and/or student from possible injury, or in an extraordinary breach of discipline, to restrain a disruptive pupil, provided the force used is reasonable under the circumstances.
C. Teachers will immediately report all such instances, as well as any cases of assault on themselves in connection with their employment, to their Principal or immediate supervisor in writing, giving in detail the circumstances thereof.
D. This report will be forwarded to the Superintendent. The Superintendent will transmit such report to the Board forthwith. The Board and the Superintendent will comply with any request from such teacher for information in their possession relating to the incident or the persons involved and will otherwise cooperate with the teacher in the event of a civil or criminal proceeding.
PROTECTION OF TEACHERS, STUDENTS AND PROPERTY. A teacher may use and apply such amounts of force as reasonable and necessary as provided for in Title 18- A.
1. To quell a disturbance threatening physical injury to others.
2. To obtain possession of weapons or other dangerous objects upon the person or within the control of a pupil.
3. For the purpose of self-defense.
4. For the protection of personsor property. Teachers shall immediately report cases of assault suffered by them in connection with their employment to their principal or other immediate superior followed by a full written report of the incident. PROTECTION OF TEACHERS, STUDENTS AND PROPERTY. It is primarily the responsibility of the classroom teacher to maintain the discipline of students assigned to each teacher's class. Every reasonable effort shall be made by the teacher to administer discipline and maintain control of students without the intervention of the administration. Problems of student discipline beyond the ability of the teacher shall be referred to the principal after consultation with the principal, except in those extraordinary circumstances warranting prompt and immediate administrative intervention.
PROTECTION OF TEACHERS, STUDENTS AND PROPERTY. To the extent feasible in existing buildings (provided that no substantial capital investment is necessary) and in designing new buildings and rehabilitating existing buildings, the Board will provide in each school building working conditions which are safe, healthful, and reasonably hazard free.

Teachers shall not be required to work under unsafe or hazardous conditions or perform tasks which endanger their health, safety, or well-being, except that the decision that it so endangers shall be in the sole discretion of the principal. If in the sole discretion of the principal any such condition exists or may arise following any disorders or disruptions in the regular school program the Association shall meet with the Superintendent as soon as possible under the circumstances to develop mutually acceptable programs to guarantee the safety of students, teachers, and property.
B. Teachers of the Passaic County Technical and Vocational Education Association are covered by N.J.S.A. 18A: 6-6.1 in their use of force or corporal punishment.
1. The Board will offer support by reimbursing all reasonable legal fees should a teacher be charged with a criminal offense in connection with employment and found not guilty. If the teacher desires to retain counsel, prior to doing so or incurring any other such cost, the teacher shall apprise the Superintendent of the anticipated fee or cost to be charged and if, in the opinion of the Board such fees or charges are unreasonable or excessive, the Board shall not be obligated for any part thereof without its consent. This decision shall not be subject to grievance procedures.
2. When an absence arises out of some such assault or injury, the teacher shall be entitled to all the benefits as set forth in N.J.S. 18A:30-2.1, provided he furnishes the Superintendent, as soon as reasonably possible after such incident, with a doctor’s certificate attesting to such disability and to his inability to attend his normal duties. The doctor’s certificate of release is to specify whether the absence was worker’s compensation related. The teacher shall be entitled to such benefits and privilege as are available pursuant to New Jersey Statutes concerning Worker’s Compensation Insurance. The Superintendent may however at any time any benefits are paid hereunder, require said teacher to be examined by the Board Physician or physicians selected by the Board. The absence herein referred to shall not compel the teacher to forfeit any sick or personal leave. During the period the teacher is receiving his full salary, all Workmen’s Compensation benefits to which the teacher is entitled shall be endorsed over to the Board so that at all times the teacher will receive no more than his full salary.

PROTECTION OF TEACHERS, STUDENTS AND PROPERTY. 1. Teachers will not be asked to work under unsafe or hazardous conditions or to perform tasks which endanger their health or safety.
2. The right of the individual to protect himself/herself and others consistent with the law will not be denied to any teacher.
a. Teachers will immediately report in writing to their principals or immediate supervisors all incidents involving physical force toward themselves or any individual occurring on school premises or during school-sponsored activities elsewhere.
b. This report will be forwarded to the Superintendent or his/her designee who will act in appropriate ways as liaison between the offended party, the policy, and the courts.
4. When it can be demonstrated that an absence of a teacher arises out of, or from an assault or injury which occurred on school premises during the performance of professional duties, and is not the result of the negligence of the teacher, the teacher will not forfeit any general leave related to the injury for the remainder of the school year.
5. A.R.S.§ 15-507 makes it a class three misdemeanor to strike or use abusive language to a teacher on school premises.

The Association shall have the right to meet with the Administration immediately to develop mutually acceptable programs to guarantee the safety of students, teachers and property.
B. The Committee agrees that the Worker’s Compensation provisions of Chapter 152, Section 69 General Laws of the Commonwealth of Massachusetts and as established by the Town of Marblehead providing for benefits to employees or their dependents in the event of incapacity or death arising out of employment shall be accepted and applied to members as so provided.
C. The Committee agrees that the teachers are indemnified by the Town of Marblehead to the extent required by law as provided in Chapter 41, Section 100c of the General Laws of the Commonwealth of Massachusetts and as established by the Town of Marblehead.
D. The Association shall have the right to designate a member of the bargaining unit to each of the respective school’s Indoor Air Quality Team.
