Return to Work after Parental Leave. (a) A teacher shall be entitled to the position which the teacher held immediately before proceeding on parental leave or, in the case of a teacher who was transferred to a safe job pursuant to subclause (4) of this clause, to the position which the teacher held immediately before such transfer. Where such position no longer exists but there are other positions available for which the teacher is qualified and the duties of which the teacher is capable of performing, the teacher shall be entitled to a position as nearly comparable in status and salary or wage to that of the teacher’s former position.
(b) The teacher will notify the employer in writing not less than six (6) weeks prior to the presumed dated of return, when the teacher requests to return to work under different arrangements from those which the teacher held immediately prior to the commencement of Parental leave.
Return to Work after Parental Leave. F.4.13.1 An employee must confirm the employee’s intention to return to work by notice in writing to the employer given at least four weeks before the end of the period of parental leave.
F.4.13.2 On returning to work after parental leave an employee is entitled :
1. to the position which the employee held immediately before commencing parental leave; or
2. in the case of an employee who was transferred to a safe job, to the position which she held immediately before the transfer.
F.4.13.3 If the employee’s previous position no longer exists but there are other positions available which the employee is qualified for and is capable of performing, the employee is entitled to a position as nearly as comparable in status and pay to that of the employee’s former position.
Return to Work after Parental Leave. At the end of a period of parental leave, a staff member is entitled to resume work on the same substantive classification, fraction of employment, and salary and with commensurate duties as applied prior to the commencement of leave, subject to the provision by the staff member of at least 4 weeks’ prior confirmation of return to work after the date of delivery. With at least 6 weeks’ notice prior to return to work, a staff member who has completed at least 12 months’ continuous service with the University immediately prior to making the request, who is returning from parental leave and who has responsibility for the care of the child may request a reduced working year arrangement in accordance with clause 30, or a reduced fraction for a specified period of time or any other flexible working arrangement. The request must be in writing and must set out the details of the change sought and the reasons for the change. The University will provide a written response to the staff member granting or refusing the request within 21 days of the request being made. Where a staff member does return from parental leave on a reduced fraction and commences a subsequent period of paid parental leave, the fraction applied for determining paid parental leave entitlements of the staff member during that subsequent period of paid parental leave will be:

Where such position no longer exists but there are other positions available for which the officer is qualified and the duties of which the officer is capable of performing, the officer shall be entitled to a position as nearly comparable in status and salary or wage to that of the officer’s former position.
(b) The officer will notify the employer in writing not less than six (6) weeks prior to the presumed date of return, when the officer requests to return to work under different arrangements from those which the officer held immediately prior to the commencement of parental leave.
Return to Work after Parental Leave. (1) Upon finishing parental leave an employee will be entitled to the position which the employee held immediately before proceeding on parental leave or, in the case of an employee who was transferred to a safe job pursuant to 19.4, to the position which the employee held immediately before such transfer.
(2) If the position referred to in 19.10(1) no longer exists but there are other positions available for which the employee is qualified and the duties of which the employee is capable of performing, the employee will be entitled to the position most comparable in status and pay to that of the employee’s former position.
(3) Where, immediately before starting parental leave, an employee was acting in, or performing on a temporary basis the duties of, the position referred to in 19.10(1), that subclause applies only in respect of the position held by the employee immediately before taking the acting or temporary position.
Return to Work after Parental Leave. (a) On finishing parental leave, an employee is entitled to resume work in the position he/she held immediately before commencing parental leave except that:
(i) if the employee was transferred to a safe job because of her pregnancy, the relevant position is the position held immediately before the transfer;
(ii) if the employee began working part-time because of the pregnancy, the relevant position is the position held immediately before the employee began working part-time;
(iii) if immediately before starting parental leave the employee was acting in or temporarily performing the duties of a position for a period equal to or less than the parental leave, then the relevant position is the position held by the employee immediately before taking the acting or temporary position.
(b) The employee may apply to return to part-time employment for a defined period following the parental leave, before resuming his/her previous full-time employment.
(c) An employee may apply to return to work from maternity leave earlier than the leave dates indicated if:
(i) the pregnancy terminates otherwise than by the birth of a living child; or
(ii) the employee gives birth to a living child but the child later dies. The employee will resume work at a date advised in writing by the University, but that date must be no later than 4 weeks after the University received the employee’s application to return to work.
Return to Work after Parental Leave. (a) A staff member is entitled to return to the position that he or she held immediately before taking parental leave, except that if a female staff member:
(i) was transferred to a safe job because of her pregnancy, the relevant position is the position held immediately before the transfer;
(ii) began working part-time because of the pregnancy, the relevant position is the position held immediately before the staff member began working part-time; and/or
(iii) immediately before starting maternity leave, was acting in, or temporarily performing the duties of, a position for a period equal to or less than the period of leave, the relevant position is the position held by the staff member immediately before taking the acting or temporary position.
(b) A staff member may apply to work part-time after return from parental leave. Any part-time work arrangement that is agreed will be recorded as a variation to the staff member’s contract of employment and will specify whether and when the staff member will return to full-time employment.
(c) A female staff member may apply to return to work from maternity leave earlier than the leave dates agreed if the pregnancy terminates without the birth of a living child or the staff member gives birth to a living child but the child later dies.
(d) A staff member may apply to extend their period of approved parental leave no later than four weeks before the end of their existing period of approved leave. Extended leave may be granted subject to operational needs and subject to the total period of leave not exceeding 52 weeks from the date of commencing leave.
Return to Work after Parental Leave. 11.1 An employee returning to work after a period of parental leave is entitled to be in:
11.1.1 the position held by the employee immediately before proceeding on that leave, or
11.1.2 if the employee worked part-time or on a less regular casual basis because of the pregnancy before proceeding on maternity leave – the position held immediately before commencing part-time work or less regular casual work, or
11.1.3 if the employee was transferred to a safe job under clause 14 of this Appendix before proceeding on maternity leave the position held immediately before the transfer.
11.2 If the position no longer exists but there are other positions available that the employee is qualified for and is capable of performing, the employee is entitled to be employed in a position as nearly as possible comparable in status and pay to that of the employee’s former position.
11.3 Clause 11 hereof extends to a female employee returning to work after a period of leave under clause 15 (Special Maternity Leave and Sick Leave) of this Appendix.
11.4 It is a breach of this Agreement to fail to comply with the terms of clause 11 hereof.
11.5 In this clause, a reference to employment in a position includes, in the case of a casual employee, a reference to work for Scenic World on a regular and systematic basis.
