Scope of Agreement and Limitations of Authority. 1.1. Purpose: The Independent Contractor is hereby contracted to perform the services that NCISD specifies below on an as-needed basis, including but not limited to the following: 1.2. The Independent Contractor has no authority to act for, or on behalf of, NCISD except as provided for in this Agreement. No other authority or power is granted or implied. 1.3. The Independent Contractor may not incur any debt, obligation, expense, or liability of any kind against NCISD without NCISD’s express written authorization. 1.4. The Independent Contractor has no rights or benefits other than those set forth in this Agreement. 1.5. The Independent Contractor agrees that NCISD is not responsible or liable for any damages, injuries, deaths, or any other form of loss or harm arising from any of the Independent Contractor’s negligent or intentional acts or omissions during the term of this Agreement. 1.6. The Independent Contractor will be responsible for the Independent Contractor’s own negligent or intentional acts or omissions in connection with the performance of services under this Agreement.

Employee is entitled to the rights and privileges detailed in this Agreement and to no other privileges. Scope of Agreement and Limitations of Authority. The parties agree as follows: Governance-- The ECHS will: Be governed by Killeen ISD and subject to Killeen ISD's policies and applicable state and federal laws; and Have the autonomy to operate as a separate Killeen ISD campus within the rules and guidelines established by the Texas Education Agency ("TEA") and the Killeen ISD; and Operate within the normal operating hours of the college and/or Killeen ISD as mutually agreed upon by the parties. The Program Director ("Director") Shall be an employee of Killeen ISD and will serve as the principal of ECHS. Within the rules and guidelines established by TEA and Killeen ISD, will have the authority to make decisions, subject to the approval of Killeen ISD central administration, regarding Killeen ISD’s: Governance of the ECHS; Staffing; Budget; Student assessment, curriculum and scheduling; Professional development; Access to school and student data for ECHS college students with permission of CTC and the student in accordance with the Family Educational Rights and Privacy Act (FERPA). Parent and community involvement consistent with the mission and needs of the school. Establishing a mentoring program for students. Will report to Xxxxxxx ISD's Superintendent or his/her designee through the established Killeen ISD governance structure; Will be the primary contact of and spokesman for the ECHS with the community and college partners. Early College Partnership Council ("Council"): Serves as an advisory committee to the Director in establishing policies for the ECHS and developing a coherent and rigorous instructional program across institutions. Membership on the Council will include, but not be limited to, representatives of the Killeen ISD and CTC. The specific membership of the Council shall be decided by joint decision of Xxxxxxx ISD's Superintendent and the Chancellor of CTC. The Council will be composed of no more than 15 members. This Council will hold responsibility for providing recommendations to the Director with regard to the mission statement and public relations plan for the ECHS. ECHS Campus Improvement Team ("Improvement Team"). The ECHS Campus Improvement Team is a site based advisory committee, with members selected by the Director. Scope of Agreement and Limitations of Authority. To collaborate in the establishment of the Transfer Academy for Tomorrow’s Engineers, hereinafter referred to as the "XXXX." The following agreement between the XXX and Xxxxx College defines a co- enrollment program for the students selected by UTSA and will guarantee admission to UTSA XXX for the students who successfully complete the program requirements. The XXXX is an innovative program that offers students the opportunity to be co-enrolled at both schools. Students admitted to the XXXX are UTSA engineering students who will be enrolled in XXX courses taught by UTSA faculty, while simultaneously enrolled at Xxxxx College to complete their math, science and core curriculum courses. Engineering students in this program have the ability to remain co-enrolled for two years. In addition, the program will provide an opportunity for both Parties to work collaboratively to improve reverse transfer processes (Appendix A. 12) that could enhance the number of associate degrees awarded by BlinnColege. Parties agree the terms of the Articulation Agreement apply to this Agreement and in the case of any conflict; the terms of the Articulation Agreement will prevail. Designate a District personnel contact(s) at central administration as the administrative authority able to make district decisions for the Pathways partnership. 3. Designate a District contact(s) to act as Pathways liaison(s) at participating campuses. The liaison supports communication regarding potential participants, program planning, and related event coordination to ensure sustainable infrastructure for the Pathways partnership. 4. Dual enrollment structures education, training, and career exploration to enable students to build academic and technical skills, acquire industry credentials, enter a profession, and advance in higher education. College and High School will approve Students who are qualified to enroll in courses enumerated in this Agreement. Courses enumerated under this Agreement (see Attachment B) will be offered at both High School and College. Faculty from College and High School will conduct these courses.
