Section 9.7. Leave of Absence. 40 Upon recommendation of the immediate supervisor through administrative channels to the 41 Superintendent, and upon approval of the Board of Directors, an employee may be granted a leave of 42 absence for a period not to exceed one (1) year; provided, however, if such leave is granted due to 43 extended illness, one (1) additional year may be granted. Such leave may be granted without pay at the 44 discretion of the Superintendent and/or Board of Directors. 45

Section 9.7. Leave of Absence. 8 An employee may request a leave of absence or leave without pay for personal or professional reasons 9 by written request to the employee’s immediate supervisor. 11 Upon recommendation of the immediate supervisor, through administrative channels to the 12 superintendent, and upon approval of the Board of Directors, an employee may be granted an extended 13 leave of absence without pay, for up to one (1) year. The returning employee will be assigned to the 14 position occupied before the leave of absence. If the position is no longer available, due to budget, 15 student or staffing needs the returning employee will be assigned to a like position in which they are 16 qualified for with equal number of hours, and shall suffer no loss of wages or benefits. Employees 17 hired to fill positions of employees on leave of absence will be hired for a specific period of time, 18 during which they shall be subject to all provisions of this Agreement. It shall be the responsibility of 19 the District to inform replacement employees of these provisions. 21 An employee on leave of absence must confirm his/her intent to return to the District for the next 22 succeeding year. The District will send the employee a certified letter forty-five (45) calendar days 23 before the date of approved leave expires, reminding the employee of his/her rights and responsibilities 24 to this section of the CBA and request them to inform the District in writing forty-five (45) days prior 25 to the date he/she intends to return to work. The employee will have fourteen (14) days of receipt of 26 the letter to inform the District the date he/she intends to return to work. If the employee fails to notify 27 the District of his/her intent to return to work, the District will consider the position vacated by the

When an employee is on a leave of absence 27 for a period of three (3) or more months, the Human Resources office will send him/her a letter via 28 registered mail within a month of the termination of that leave requesting whether or not the employee 29 plans to return, retire, or ask for an extension. It is expected that the employee return said questionnaire 30 within two (2) weeks of the request. If the employee does not return the questionnaire or contact the 31 Human Resources office with the answer to the questionnaire within the two-(2) week timeframe, it is 32 assumed that the employee is not planning on returning therefore forfeiting all seniority rights and a 33 letter to that effect will be sent to the employee.

However, vacation credits and sick leave shall not accrue while the employee is on leave of 21 absence.

An employee can 16 only be granted one leave during a part or portion of a single school year and will not include 17 parts or portions of any two (2) school years. At the conclusion of the leave, the employee shall 18 return to their assignment according to 9.8.2. The decision to grant or deny the leave by the 19 district shall be final and not subject to a grievance, unless the decision is made for arbitrary or 20 capricious reasons.
