1 5.1 The employee refused or is delinquent in making payments required 2 as set forth herein;
4 5.2 District is given evidence and proof by Local 2121 that the employee: 5
6 5.2.1 Has been notified in writing that the employee is and has 7 been delinquent in tendering the required charitable 8 contributions, dues, service fees and/or fees for other 9 services provided by Local 2121; 10
11 5.2.2 Has been informed of the amount of such delinquency by 12 Local 2121;

ARTICLE 8 ACADEMIC FREEDOM, DUTIES, AND RESPONSIBILITIES 8.A – 8.C.3
1 A. General Principles 2
3 1. Community college faculty members, guided by a deep conviction of the 4 worth and dignity of the advancement of knowledge, recognize the special 5 responsibilities placed upon them in promoting the educational goals and 6 well being of students. To this end, faculty members demonstrate respect 7 for the student as an individual, and adhere to their proper roles as 8 intellectual guides and mentors. They avoid any exploitation of students 9 for private advantage and they promote educational achievement in a 10 supportive and safe environment. 11
12 2. The District and AFT will work cooperatively to promote and maintain a 13 climate of free, impartial, and responsible inquiry and discussion. In order 14 to realize the educational advantages offered by this climate, the District 15 and AFT will actively seek to maintain a teaching and learning environment 16 that is free of sexual harassment, discrimination, or abusive conduct. 17
18 3. Faculty accept the obligation to exercise critical self-discipline and 19 judgment in using, extending and transmitting knowledge. Faculty shall 20 abide by the duties and responsibilities set forth herein. 21
22 B. Faculty Responsibilities Under District Policies, Rules, and Regulations 23 24 Faculty shall abide by applicable provisions of the Faculty Handbook, District Policy 25 Manual, and District Rules and Regulations except as modified herein. This 26 paragraph shall not be read as waiving AFT’s or a faculty member’s statutory 27 right(s) or right(s) under this Agreement. 28 29 If a faculty member is disciplined pursuant to this Article, Article 10 of the Agreement 30 will govern.
32 C. Academic Freedom 33
34 1. The District and AFT are unequivocally and unalterably committed to the 35 principle of academic freedom in its true sense which includes freedom to 36 study, freedom to learn and freedom to teach and provide educational 37 professional services to students. 38
39 2. Academic freedom encompasses the right of an instructor to discuss in the 40 classroom relevant and controversial subjects consistent with the course 41 outline, and for counselors, librarians and other academic employees to 42 provide relevant and appropriate student services. 43
