Use of Alcohol and Drugs. Employees must not possess, sell, or use alcohol or illegal drugs, nor abuse prescribed controlled substances while on the job or on Township property. Employees must not work or report to work under the influence of alcohol or illegal drugs, nor under the influence of controlled substances except as provided in subparagraph 3 below. Employees must report to their supervisors when they are experiencing or may experience a reaction to a prescription or over-the-counter drug, which may affect their ability to do their job.
Use of Alcohol and Drugs a. Employees shall not possess, while on duty, any unsealed receptacle containing an alcoholic beverage nor shall any employee sell or use an alcoholic beverage while on duty, except that police officers may do so in the performance of police duty.
b. Employees shall not possess, sell or use illegal drugs nor abuse prescription drugs at any time, provided that members of the Police Department may be in the possession of illegal drugs while on duty if such possession is incidental to their official duty.
c. Employees shall not work or report to work under the influence of alcohol or illegal drugs, nor under the influence of prescription drugs except as provided in Item 1(d) below.
d. Employees must report in writing to their supervisors when they are experiencing a reaction to a prescription or over-the-counter drug which may affect their ability to do their job. The purpose of this report is to protect workers while taking medication from being wrongfully suspected of using illegal prescription drugs.
e. Possession of drugs and/or open containers of alcohol in the workplace by an employee, outside the scope of their employment, or being under the influence of alcohol as defined in Item 3 (I), or under the influence of an illegal drug during working hours constitutes grounds for immediate disciplinary action.
Use of Alcohol and Drugs. A. Employees shall not possess, sell or use alcohol or controlled substances while on the job, including mealperiods.
B. Employees shall not work or report to work under the influence of alcohol or controlled substances, except as provided in subparagraph C or D below.
C. Employees must report to their supervisors when they are experiencing a reaction to a prescription or over-the-counter drug which may affect their ability to do their job. Regardless if prescribed as medical marijuana or not, medical marijuana is prohibited from consumption or absorption in any form for all employees.
D. Employees called back to work will report to the supervisor any off duty use of alcohol or a reaction to a prescription or over-the counter drug and shall not report to work.
E. If an employee is called into work after consuming alcohol or is reporting to work when experiencing a reaction to a prescription or over-the-counter drug which may affect his ability to do his job, the on-duty supervisor will make a determination as to fitness for duty. No alcohol or drug test will be administered if subparagraph C or D applies. The on-duty supervisor will fill out and retain a form documenting his determination, with a copy to be filed with the Chief. Any employee who has been prescribed medical marijuana and has consumed or absorbed it in any form shall be sent home immediately and said employee shall be required to use sicktime.
F. Due to the changing federal and state regulation ensuring safety and reporting accidents and that all of the employees are in safety sensitive positions for the equipment they operate and the services they perform, all employees shall be subject to the same drug testing policy, i.e. random drug tests, as those who maintain a CDL.
Use of Alcohol and Drugs. 35.1 The Department and Union jointly recognize that drug or alcohol misuse by an employee would be a threat to the public welfare and the safety of Department personnel. It is the policy of the Department to prevent drug and alcohol misuse by providing education and assistance to all employees. Prohibited conduct is outlined below and may be further defined in Department policy.
a. The use of, or being under the influence of, alcohol shall not be permitted at the work site and/or while on duty or standby.
b. The manufacturing, distribution, use of, or being under the influence of controlled substances as defined by the federal Controlled Substance Act (21 X.X.X §000) is prohibited on and off duty. As used in this policy, controlled substances do not include medications lawfully prescribed for the employee’s use when taken as prescribed and where its use does not present a safety hazard or otherwise impact an employee’s performance or Department Operations. Marijuana is defined as a controlled substance for the purpose of this Agreement, regardless of whether or not the marijuana was prescribed, manufactured, or distributed for medical or recreational purposes.
1) Employees who are considering the use of medical marijuana in connection with a disability should discuss with their Supervisor other means of accommodating the disability in the workplace, as the Department will not agree to allow an employee to use medical marijuana as an accommodation.
2) Employees must inform their supervisor about any prescription or over-the-counter drugs they are using which could adversely affect their physical or mental faculties to any perceptible degree.
3) Employees must inform their supervisor if a controlled substance is ingested unintentionally so that appropriate medical steps may be taken to ensure the employees’ health and safety. Employees should follow Department policy for reporting the exposure.
35.2 All employees will be fully informed of the Department's drug and alcohol testing policy and procedures before testing is administered. Newly hired employees will be provided with this information as part of their orientation. No employee shall be tested until this information is provided to him/her. Employees will also be provided with information concerning the impact of alcohol and/or drugs on job performance.

Use of Alcohol and Drugs. While rendering services under this Agreement, the PERFORMANCE shall not be under the influence of alcohol or drugs (other than as lawfully prescribed by a physician).
Use of Alcohol and Drugs.
37.1 Statement of Principle: The District and the Association jointly recognize that the use of drugs and alcohol which adversely affects job performance may constitute a serious threat to the health and safety of the public, to the safety of fellow employees and to efficient operation of the organization.
37.2 The District’s “Use of Alcohol and Drugs” administrative policy is incorporated into this Agreement by reference. Changes to this policy are considered a mandatory subject of bargaining.
Use of Alcohol and Drugs. CAs are expected to abide by state law regarding the legal age to consume alcohol. Underage staff members who consume alcohol on or off campus will be released from their CA contract immediately. Staff members of legal drinking age who abuse or misuse alcohol, or whose behavior when using alcohol contradicts the expectations and status of the CA position may be released from their CA contract. The use of illegal drugs is strictly prohibited and will also result in the release of a staff member from their CA contract.

Battalion Chief Bargaining Unit Members will be subject to their employer’s applicable policies regarding prohibited conduct and substance abuse.
33.2. The larger IAFF 851 Contract expires June 30, 2015. The Department and IAFF 851 intend to bargain a successor agreement starting in early 2015. The Department and the Union agree that the Use of Alcohol and Drugs article ratified in that successor agreement will replace this article for this Battalion Chief Bargaining Unit upon ratification of the larger IAFF 851 collective bargaining agreement.
