WORKPLACE SAFETY AND INSURANCE. 41.1 Where an employee is absent by reason of an injury or an occupational disease for which a claim is made under the Workplace Safety and Insurance Act, his or her salary shall continue to be paid for a period not exceeding thirty (30) days. If an award is not made, any payments made under the foregoing provisions in excess of that to which he or she is entitled under Articles 44.1 and 44.6 (Short Term Sickness Plan) shall be an amount owing by the employee to the Employer.
41.2 Where an employee is absent by reason of an injury or an occupational disease for which an award is made under the Workplace Safety and Insurance Act, his or her salary shall continue to be paid for a period not exceeding three (3) consecutive months or a total of sixty-five (65) working days where such absences are intermittent, following the date of the first absence because of the injury or occupational disease, and any absence in respect of the injury or occupational disease shall not be charged against his or her credits.
41.3 Where an award is made under the Workplace Safety and Insurance Act to an employee that is less than the regular salary of the employee and the award applies for longer than the period set out in Article 41.2 and the employee has accumulated credits, his or her regular salary may be paid and the difference between the regular salary paid after the period set out in Article 41.2 and the compensation awarded shall be converted to its equivalent time and deducted from his or her accumulated credits.
41.4 Where an employee receives an award under the Workplace Safety and Insurance Act, and the award applies for longer than the period set out in Article 41.2 (i.e. three (3) months), the Employer will continue subsidies for Basic Life, Long Term Income Protection, Supplementary Health and Hospital and the Dental Plans for the period during which the employee is receiving the award. The Employer shall continue to make the Employer’s pension contributions unless the employee gives the Employer a written notice that the employee does not intend to pay the employee’s pension contributions.
41.5 Where an employee is absent by reason of an injury or an occupational disease for which an award is made under the Workplace Safety and Insurance Act, the employee shall not be entitled to a leave of absence with pay under Article 44 (Short Term Sickness Plan) as an option following the expiry of the application of Article 41.2.
WORKPLACE SAFETY AND INSURANCE. Board (WSIB)
WORKPLACE SAFETY AND INSURANCE. Service shall accumulate for up to twelve (12) months of absence while in receipt of Workplace Safety and Insurance benefits.
WORKPLACE SAFETY AND INSURANCE. Under the Workplace Safety and Insurance Act this Board provides protection for its employees for loss of salary due to injury sustained in the course of duty. Absence of one working day or less will be charged to sick leave credit. Absences in excess of one day will not be charged to sick leave credit.
WORKPLACE SAFETY AND INSURANCE. 8.1 Every employee w ho is absent from duty as a result of illness or injury arising from his/her employment w ithin the meaning of the Workplace Safety and Insurance Act (WSIA), w ill be provided w ith medical care and treatment as provided in the WSIA and shall comply w ith Clause 7.2.1 (h) of this Agreement.
8.2 Every probationary employee w ho is absent from duty as a result of illness or injury arising out of and in the course of his/her employment (w ithin the meaning of the Workplace Safety and Insurance Act), shall receive compensation from this Employer to the level provided under the WSIA effective from the date of disability. Where a claim has been disallow ed by the Workplace Safety and Insurance Board (WSIB) all payments made by the Employer w ill be recovered from the employee' s Income Protection Plan, subject to Article 7.2.
8.3 Every employee w ho has completed his/her probationary period, and w ho is absent from duty as a result of illness or injury arising out of and in the course of his/her employment (w ithin the meaning of the WSIA) shall be entitled to the follow ing:
(a) Payment of salary or earnings by the Employer to the maximum allow able under the WSIA and the Employer w ill also pay to the employee, w here applicable, the difference betw een the maximum allow able under the WSIA and the actual amount equal to the employee' s salary or regular w age. It is recognized that: The combined effect of the employee’ s entitlement under the WSIA and the top-up payment shall not exceed the employee’ s pre-injury net pay after tax and legislat ed deductions.
(b) In addition, the Employer w ill pay on behalf of the employee the total payment of premiums for the follow ing plans:
(i) pension,
(ii) medical plans as specified in the Agreement,
(iii) life insurance,
(iv) long term disability,
(v) dental plan provided that in any calendar month the employee is absent ten (10) w orking days.
(c) When the employee returns to full and regular duties, he/she shall be returned to a position equal to the one w hich he/she held prior to his/her compensable injury and the benefits specified in (a) and (b) above shall cease. When the employee is able to return to modified duties the benefits specified in (a) and (b) above shall cease.
8.4 Should an employee be off w ork in excess of ten (10) consecutive months w ithout any regular pay for w ork done, the employee shall not accumulate leave credits for this period of time.

WORKPLACE SAFETY AND INSURANCE. The Supplier warrants and agrees that it has complied and will comply with all applicable workplace safety and insurance laws and regulations and, if applicable will provide proof of valid coverage by means of a current clearance certificate to the City upon request. The Supplier covenants and agrees to pay when due, and to ensure that each of its subcontractors pays when due, all amounts required to be paid by it and its subcontractors under all applicable workplace safety and insurance laws and regulations during the Term. The Supplier further agrees to indemnify the City for any and all liability, loss, costs, damages and expenses (including legal fees) or other charges in connection with the Supplier’s failure to comply with any applicable workplace safety and insurance laws or related to the Supplier’s status with any workplace safety and insurance board or body.
WORKPLACE SAFETY AND INSURANCE. 13.01 When a Member is eligible for, and receives approval of, a claim by the Workplace Safety and Insurance Board of Ontario:
a) the Workplace Safety and Insurance payment shall be remitted to the Board;
b) the Member shall receive full pay from the Board;
c) there shall be no deduction of Sick Leave Credits from the Member.
WORKPLACE SAFETY AND INSURANCE. 38.01 The Employer will provide workplace insurance coverage for employees in the bargaining unit in accordance with the Workplace Safety and Insurance Act (Ontario).
WORKPLACE SAFETY AND INSURANCE. 24.01 All employees shall be covered by the Workplace Safety and Insurance Act. An employee prevented from performing their regular work with the Employer, due to an occupational accident that is covered by the Workplace Safety and Insurance Act and which occurred while employed by the Employer, shall receive from the Employer the difference between the amount payable by the Workplace Safety and Insurance Board and their regular salary. The eligibility of an employee for receipt of full salary will be determined only by the employee’s eligibility for Workplace Safety and Insurance benefits and will not be prejudiced by any previous accidents which occurred while not employed by the Employer. The employee will continue to receive full pay for a period not to exceed six (6) months at which time the Employer will review the claim and determine if the employee is to continue on full salary or receive the Workplace Safety and Insurance Board benefits only.
24.02 An employee shall not be required to draw on their sick leave credits while eligible for Workplace Safety and Insurance benefits.
24.03 The employer will notify the Union of the names of any members of the bargaining unit who are off work as a result of a work-related injury.
24.04 The employer will provide the employee with a copy of the Workplace Safety and Insurance Board Form 7 at the same time as it is sent to the WSIB.
24.05 The University will provide the Union with a monthly summary of Form 7s.
WORKPLACE SAFETY AND INSURANCE. Workplace Safety and Insurance benefits payable to union members will be paid directly from the WSIB office in Toronto. Workplace Safety and Insurance Board benefits may be topped off using the employee's accumulated sick leave credits. Two (2) hours of the employee's accumulated sick leave credits will be used each day Workplace Safety and Insurance benefits are paid until the employee's sick leave credits have been completely exhausted and thereafter the employee shall only be entitled to the Workplace Safety and Insurance Benefits. This top up provision will only apply until the sooner of:
a) age 65;
b) the date Ontario legislation provides prescription drug coverage (provided the employee is at least age 65 years of age); or
c) the age at which the employee can retire and receive an OMERS pension plan without penalty (provided the employee is at least 65 years of age); or
d) having reached at least age 65, the employee can no longer contribute to the OMERS pension plan; or
e) recovery.
