ADMINISTRATIVE RIGHTS. 2.01 The Association acknowledges that, subject to The Police Services Act, R.S.0. 1990, as amended, it is the function of the Board to:
(a) Establish the complement of the Service, which shall consist of a Chief of Police and such other police officers and such constables, assistants and civilian employees as the Board considers adequate, and further to deploy and assign such members of the Service in a manner the Board deems necessary for the effective, efficient and economical carrying out of the operation and administration of the Police Service;
(b) Maintain order, discipline, and efficiency;
(c) Hire, discharge, classify, transfer, promote, demote, and suspend or otherwise discipline any member of the Service covered by this Agreement, provided that claim of discriminatory promotion, classification, demotion, or transfer, or a claim that any such member of the Service has been discharged or disciplined without just cause, may be the subject of either a grievance or follow the provisions of The Police Services Act and dealt with as provided;
(d) Generally to manage the operations and undertakings of the Police Service in a manner the Board deems necessary for the efficient and economical carrying out of the operations of the Police Service.
ADMINISTRATIVE RIGHTS. SECTION 1 Except as limited herein, all of the rights to manage and direct the Police Force, which have not been specifically abridged by the Agreement, shall remain the exclusive right of the City of Xxxxxx and the Chief of Police. Such rights include, but are not limited to:
(A) To determine the Police Department and/or City Policy, including the exclusive right to manage the affairs of the Police Department, in all respects. Except in cases of emergency, any amendments to policy will be announced ten (10) calendar days in advance of its implementation.
(B) To assign working hours.
(C) To direct the members of the Police Department, including the right to hire, lay-off, promote, transfer, and, for just cause and subject to grievance procedure, to discipline any employee covered by this Agreement; including, but not limited to, suspension, demotions, and terminations. Promotions shall be subject to a six (6) month promotional probationary period, during which time the promoted employee will be evaluated. At the conclusion of this promotional probationary period, the employee will either be confirmed in their new position, or will be returned to their previous position at the discretion of the Chief of Police. Any non-confirmation will not be considered an act of discipline.
(D) To determine the table of organization of the Police Department, including the right to organize, and reorganize, the Police Department, to determine the size of the department, and the determination of job classifications and ranks based upon duties assigned.
(E) To determine the safety, health, and property protection measures for the Police Department. The City agrees to meet with Lodge regarding any safety and/or health concerns the Lodge may have so as to promote the most efficient exercise of this management right by the City.
(F) To allocate and assign work within the regular scope of employee's duties.
(G) To be the sole judge of Qualifications of employees.
(H) To schedule operations and to determine the number, and duration, of hours of assigned duty per week.
(I) To establish & enforce the Police Department rules, regulations, & orders.
(J) To introduce new, improved, or different methods and techniques of operation of the Police Department, or change existing methods or techniques.
(K) To determine the amount of supervision necessary;
(L) To control the department budget;
(M) To take whatever actions necessary to carry out the mission of the City in situations of emerge...
ADMINISTRATIVE RIGHTS. Nothing contained herein shall limit the right of the Administration to evaluate a teacher's performance of assigned duties during the regular school day.
ADMINISTRATIVE RIGHTS. 4.1 The Association recognizes the right of the Board to administer its business operations, schools and staff members as limited by the stipulations of the current collective agreement, without dismissing the employment requirements of Catholic, separate schools as guaranteed by Article 93 of the British North America Act and the laws and regulations of Ontario and Canada.
ADMINISTRATIVE RIGHTS. All matters not specifically and expressly treated by the language of this Agreement may be administered for its duration by the Employer in accordance with such policy or procedures as the Employer from time to time may determine.
ADMINISTRATIVE RIGHTS. A. The Board, on its own behalf and on behalf of the electors of the District, hereby retains and reserves unto itself, without limitation except as expressly provided in this Agreement, all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws of the Constitution of the State of Michigan and of the United States, including, and without limiting the generality of the foregoing, the right:
1. To the executive management and administrative control of the school system and its properties and facilities, and the professional activities of its employees.
2. To hire all employees and, subject to the provisions of law, to determine their qualifications and the conditions for their continued employment, or their dismissal, or demotion; and to promote and transfer all such employees;
3. To establish grades and courses of instruction, including special programs, and to provide for athletic, recreational, and social events for students, all as deemed necessary or advisable by the Board;
4. To decide upon the means and methods of instruction, the selection of textbooks and other teaching materials, and the use of teaching aids of every kind and nature; and
5. To determine class schedules, hours of instruction, duties, responsibilities, assignments, and the terms and conditions of employment of teachers and other employees with respect to administrative and non-teaching activities.

The Employer, for and on behalf of the electors of the school district, hereby retains and reserves unto itself, without limitations, all powers, rights, and authority conferred upon and vested in it by the laws and the Constitution of the State of Michigan and the United States, including, but without limiting, the generality of the foregoing, the right:
1. To the executive management and administrative control of the school system and its properties and facilities, and the duty assignments of its employees. The Board also has the right to determine the size of the work force and to lay off employees according to the terms of this contract.
2. To hire all employees, subject to the provisions of law; to determine their qualifications and the condition of their continued employment, their dismissal or demotion; and to promote and transfer all such employees.
3. The Board shall have the right to prescribe the number and duration of class hours during the teaching day.

ADMINISTRATIVE RIGHTS. The Portal will include a restricted-access administrative interface component (“Administrative Interface”) to allow employees or specific independent contractors designated by Customer (“Administrative Users”) to access the configuration and settings components of the Portal to manage, configure and monitor the Portal for Customer’s benefit, which such configuration may include enabling the Portal to interact with a mobile application (“Mobile App”) separately made available to Users by SIM. Each Administrative User will be provided access to and use of the Administrative Interface (“Admin User Access”). Customer shall be responsible for ensuring the security and confidentiality of all Admin User Access. Customer acknowledges that it will be solely and fully responsible for all liabilities incurred through use (permitted or unpermitted) of any Admin User Access.
ADMINISTRATIVE RIGHTS. The Solution will include a restricted-access administrative interface component (“Administrative Interface”) to allow employees or specific independent contractors designated by Customer (“Administrative Users”) to access the configuration and settings components of the Solution to manage, configure and monitor the Solution for Customer’s benefit. Each Administrative User will be provided access to and use of the Administrative Interface (“Admin User Access”). Customer shall be responsible for ensuring the security and confidentiality of all Admin User Access. Customer acknowledges that it will be solely and fully responsible for all liabilities incurred through use (permitted or unpermitted) of any Admin User Access.
