EMPLOYMENT OF TEACHERS. Initial Appointment to a Continuing Contract 1. All teachers, other than teachers-teaching-on-call, appointed by the Board to the teaching staff of the District shall be placed on continuing contracts of employment, except for temporary appointments: a. to replace a continuing contract teacher during that teacher's leave of absence, or b. to replace another teacher on temporary appointment, or c. to fill a position that is temporarily created by the Board, or d. to fill a position that has been vacated by another teacher during a school year, or e. to a teacher-teaching-on-call, retroactively, upon completion of a total of twenty (20) days or more in one call-out assignment. 2. The Board agrees to provide to the Union no later than six (6) weeks from the commencement of any school year and, whenever updated, a list of teachers hired on temporary and continuing contracts for that year with their FTE assignment, and a list of continuing contract teachers on leave of absence. Automatic Appointment to a Continuing Contract a. Effective September 1, 1994, temporary teachers who are appointed to the teaching staff of the District and who, at the time of such appointment, have accumulated fifteen (15) FTE months of temporary service within the preceding three (3) school years, shall receive a continuing appointment. b. The number of temporary contracts shall not exceed the number of positions temporarily existing and the number of full time equivalent teachers on leave.

EMPLOYMENT OF TEACHERS. 4-1 Subsequent to the effective date of this Agreement, all personnel hired as classroom teachers for other than vocational or technical courses shall be required to have at least a bachelor's degree from an accredited college or university. Teachers employed in specialist classification areas, such as remedial reading, special education, library, speech therapy, psychology, etc., shall hold a bachelor's degree and the appropriate special license granted by the State of Nevada Department of Education. 4-2 Teachers employed by the School District shall comply with the Nevada Teacher Licensure requirements for the position to which they are assigned, and such compliance must be completed no later than five (5) working days prior to any paycheck being issued. Teachers must maintain appropriate licensure to be paid on the Licensed Personnel Salary Schedule. Non-compliance may lead to payment at the substitute rate, non-payment and/or termination. 4-3 Teachers will be given letters of intent on or before May 1 unless modified by the state legislature. Teachers shall be given at least ten (10) days to examine their own contract or letter of intent before it must be signed and returned to their principal. In the event that contracts or letters of intent are issued prior to May 1st, the ten (10) days a teacher has to decide whether to accept or reject employment will begin on the date the teacher received such contract or letter of intent. Once a contract or letter of intent is signed accepting employment for the subsequent school year, the teacher shall not be released pending the District’s finding an adequate replacement.

The teacher shall provide written verification of those years of experience at a school not participating in the Indiana Public Retirement System.

EMPLOYMENT OF TEACHERS. At least one (1) full-time classroom teacher or two (2) part- time classroom teachers each working more than twelve (12) hours per week must be employed by the School. The full-time classroom teachers and part-time classroom teachers teaching more than twelve (12) hours per week shall be certified or licensed in accordance with R.C. 3319.22 to 3319.31, or other applicable sections of the Ohio Revised Code. Upon employment, the School shall forward teacher qualifications, including but not limited to, the grade level and content area being taught and the teacher’s licensure or certification granted by the Ohio Department of Education, to the Sponsor. The School may employ non-licensed persons to teach up to twelve (12) or forty (40) hours per week pursuant to R.C. 3319.301, to the extent permitted by ESSA or any subsequent legislation. There shall be no more than twenty-nine (29) students per classroom. If the School uses federal funds for the purpose of class size reduction by using Title 1 or Title II- A funds, the school wide students to full-time equivalent classroom teacher ratio shall be no more than 1 to 25. The School may also employ necessary non-teaching employees. Prior to opening day, the School will provide the Sponsor with proof of Ohio licensure/certification for a sufficient number of teachers to support the stated teacher/student ratio, as well as the credentials and background checks for all staff of the School. In addition, persons with only long-term substitute licenses may be employed only if their license is in the grade level and content area they are teaching. The School Governing Authority shall provide an organizational chart and a list of roles and responsibilities of all School staff that aligns to the organizational chart included as Attachment 8.1. 8.1.1 Each person employed by the School as a nurse, teacher, counselor, school psychologist or administrator shall complete at least four (4) hours of in-service training in the prevention of child abuse, violence and substance abuse and the promotion of positive youth development within two (2) years of commencing employment with the School, and every five (5) years thereafter.
