Agency Employees. 1. The Agency shall provide full-time employee(s) or equivalent to be designated as Referral Specialists utilizing the qualifications and standards described herein.
2. The Agency shall maintain employee personnel files for each employee. Employee personnel files shall include complete background screenings, trainings, and credential documentation all of which shall be in compliance with the established standards for the associated position.
3. Agency employees shall have access to a computer, with internet connection, and a telephone line to allow employee(s) to complete their assigned job responsibilities in a timely and efficient manner.
4. The Agency shall be required to comply with the National Monitoring Universal Fiscal and Programmatic Standards, as well as local standards of care, as further described here: xxx.xxx.xxxx.xxx/xxxxxxxxxxxxxxx/Xxxxxxxxxxxxxxx.xxxx.
Agency Employees. Employees working at an overtime or premium rate of pay, unless receiving premium pay pursuant to Section 5.3.2.
Agency Employees. Except in cases of emergency, agency employees shall not be called in to work on units and shifts which the Hospital has identified as requiring a reduction of FTEs.
Agency Employees. Whenever practical, the University shall utilize University employees. However, the University may temporarily utilize the services of agencies for up to one (1) year. Such use of temporary agency employees shall not be considered subcontracting, subject to Section 1 above. Temporary Agency Employees may be used in the following situations:
A. For the performance of extra work required at workload peaks.
B. As replacements for employees on leaves of absence (including illness) or for employees who are replacing employees on leaves of absence for the duration of the leave of absence, (which may be longer than one (1) year) provided that if the period of replacement continues past one (1) year, the replaced employee has the right to return to the same position.
C. To hold a position vacant in anticipation of a job abolishment or other reorganization.
D. In the interim period while a vacant position is being filled.
E. Other circumstances of a temporary nature. If the Union disagrees with the University about the temporary nature of the circumstances, the matter may be grieved.
Agency Employees. 27.01 For the purpose of this Agreement, an agency employee is a worker performing bargaining unit work who is sourced by an agency that is contracted to do so by the Company and is on assignment with the Company from that agency.
27.02 The Company agrees regular employees are the primary resource throughout the year and, in accordance with this article, agency workers will only be used for temporary work. They shall be permitted to supplement the hours of work of regular employees, for fluctuations in business and will not be used to replace a bargaining unit member. They shall not be used while employees with the skill, ability and willingness to perform the remaining work are on layoff.
27.03 If an agency employee reaches five hundred and twenty (520) hours of work in the course of an assignment, the job performed by the agency employee shall be posted in accordance with Article 19 of the Agreement. If the agency employee applies for the job, they shall be given preference over any other candidate, save and except for any seniority employees.
27.04 An agency employee who is hired into a position with the Company will be credited with 200 hours upon the first day of their probationary period.
27.05 The amount of union dues which would otherwise be deducted from an agency worker’s wages in accordance with Article 4 of this Agreement will be paid by the Company.
27.06 In no circumstances shall the termination of an agency worker’s assignment be the subject of a Grievance.
27.07 Subject to Article 17.10, agency employees shall not work on weekends or statutory holidays and shall only be utilized in the following manner:
(A) Day Shift: Restricted to Packager, Sorter, Shipper/Receiver, Millwright, Electrician
(B) Afternoon Shift: Restricted to Packager, Sorter, Material Handler, Shipper / Receiver, Skilled Trades
(C) Night Shift: No Restrictions
27.08 The Company agrees that if the Union believes that the Company’s reliance on Agency Workers is excessive the Company will meet with the Union to discuss alternatives and/or provide rationales as to the present need for the volume of Agency Workers.
Agency Employees. 11.6.1 MCW may supplement its workforce by using Agency labour hire to meet fluctuating workload demands, one off projects and shorter-term needs.
Agency Employees. Producer agrees that during the term of this Agreement, and for a period of twelve (12) months following the termination of this Agreement, Producer shall not directly or indirectly solicit for employment, hire or cause any employee, independent contractor, or insurance solicitor to leave the employment of Agency because of Producer's offer, recommendation or referral to another agency or employer.
Agency Employees. The Company and Union agree that only Full Time Employees will be employed in the bargaining unit. However, when a need for overtime arises and there are either no volunteers or not enough volunteers, and / or when there are members on layoff who do not respond to a call in, then the Company may utilize “Agency Employees”. Agency Employees will be subject to the following:
Agency Employees. There is no authority for Committee employees.
Agency Employees. As a means to support ongoing recruitment efforts, full-time employees may be brought on through an agency for their probationary period (720 hour). The Company acknowledges and agrees that any employees working through an employment agency are not employees of Precision Stamping Group for the purposes of this Agreement. Upon successful completion of their probation, they will become employees of Precision Stamping Group and shall become members of the union. Union dues shall be deducted per Article 4.
