Under the Ordinance, protected trees include all native oaks having a trunk diameter of at least six inches or greater and any tree species other than a native oak having a trunk diameter of at least 12 inches or greater on nonresidential property, or any tree planted as a requirement tree for site development, tree permit condition, landscape plan removal replacement, or other designated condition by the public works director or planning director. A tree permit is required for any ground disturbance within the dripline (defined as the longest measurement from the trunk to the edge of the canopy), major trimming, or other activities that may damage, kill, or remove any protected tree. Mitigation for the removal of, or significant impacts to, protected trees is required in the form of on− or off−site replanting on an inch−for−inch basis, payment of in−lieu fees, preservation credit, or a combination of these. At the discretion of the public works director, trees in poor condition that pose a danger to public safety require only a single replacement tree. A survey of all trees located within the planted median areas of the project site with a diameter−at−breast−height (dbh) of six inches or greater will be conducted. The tree survey will be conducted by International Society of Arboriculture Certified Arborist(s). A report will be prepared to document the methods and results of the tree survey.
