Bidding on Vacancies. Any employee interested in bidding for a posted position may so indicate in writing to the Assistant Superintendent of Administrative and Business Services or his/her designee before the close of the posting period (not less than five (5) days). A. Transfer of any employee shall be based upon all of the following factors: qualifications, amount of experience in the particular classification, amount of experience in closely related classifications and seniority. B. The promotion of any employee shall be based upon qualifications, training and previous work record. Seniority shall be considered only when two or more employees have substantially equal qualifications, training and previous work record. Promotion shall be defined as movement to a position with a higher rate of pay. Each employee transferred under this provision shall receive a forty-five (45) day trial period in the new position. Each employee receiving a promotion shall receive a sixty (60) day trial period in the new position. During the trial period the employee shall receive the rate for the job s/he is performing. Prior to the end of the trial period, the BOARD shall have the right to revert an employee back to their former position if such employee’s work is unsatisfactory. In such cases, written notice of unsatisfactory conditions will be given to the employee. The member shall have the right to return to his/her former position prior to the end of the trial period. A meeting with the Assistant Superintendent of Administrative and Business Services , the immediate supervisor and Union President (or their designee) shall take place prior to the employee being transferred to their former position.

Bidding on Vacancies. Employees shall have ten (10) work days to bid on a vacancy, through a vacancy bidding form. If the Superintendent determines that two (2) current employees have equal qualifications, the senior employee will be chosen to fill the vacancy. Applicants meeting the minimum qualifications for the vacant position will be considered based upon program needs, work experience, training, and position knowledge, skills and abilities. If the Superintendent determines that a current employee and an applicant from the outside have equal qualifications, the current employee will be chosen to fill the vacancy. When the City seeks to fill a regular full-time or a regular part-time vacancy, the City will make Unit Members aware of those vacancies through the posting of vacancies, including shift, hours, position, assignments, days off and work location, to be posted for at least two (2) weeks, unless mutually agreed otherwise, in the Department’s office, on official bulletin boards, and at other mutually agreed upon locations. The City will provide 48 hours notification to the Union of the intent to open a concurrent internal/external recruitment process. 2. Bidding for shifts or work locations for all Unit Members shall continue by current practice. Upon the written request of the Union, the City or any Department shall negotiate with the Union to establish or revise a bidding procedure. The determination of the bidding procedure shall be by mutual agreement. Such procedure shall be in compliance with all state and federal laws. 3. The issues of requirements and processes for career advancement of Unit Members shall be considered by the Labor-Management Committees established under Section 2-1.

The District will interview all inside candidates who apply for and meet the posted qualifications. The District will consider having the replacement trained by the current employee. All candidates shall be notified in writing of the hiring decision. Employees who apply for and are awarded the position for which they have applied shall be evaluated annually per Article XXVII.

The issues of requirements and processes for career advancement of Unit Members shall be considered by established Labor-Management Committees.

The Parties acknowledge that the Fire Department has historically utilized a procedure whereby employees bid on work locations based upon the employee’s length of service since date of hire as a firefighter with the City. Although this process oftentimes meets the needs of both the Department and the Employee, the Parties agree that this process in no way limits the authority of the Fire Chief, or his designee, to make assignments to meet the operational needs of the Department. This process will also be used in the event of any layoffs within the Fire Department.

The Association and the City agree that no later than August 2013, the City will identify all work areas in the City where multiple shifts and/or work locations exist. For areas where shift bidding does not occur, supervisors shall provide justification for the current practice in place. The Association may solicit feedback from employees in that work area regarding any interest in changing the current practice. Requests to change current practice may be reviewed at the Citywide Labor Management Committee meeting. The determination of revising or establishing any bidding procedure shall be by mutual agreement between the Association and the impacted Department. The City Manager shall render final decisions in any situation where mutual agreement cannot be reached. Requests for a change to current practice that are denied may be resubmitted after one (1) year. Any bidding procedures shall be in compliance with all state and federal laws. 3. The issues of requirements and processes for career advancement of Unit Members shall be considered by the Labor-Management Committees established under Section 2-1.
