Break after Overtime. (a) Where overtime is necessary, an employee must have at least 10 consecutive hours off duty between work on successive days, if reasonably practicable. (b) Where an employee works overtime and does not have 10 consecutive hours off duty between the end of one period of duty and the start of ordinary duty on the next day, the employee: (i) will be paid at the overtime rate until released from duty; and (ii) is entitled to be absent from ordinary duty the next day without loss of pay until a 10 hour break has been taken. (c) Where a shift worker works overtime for the purpose of changing shift rosters or does not report for duty and a day worker replaces the shift worker, the arrangements provided for at subclauses 27.4(a) and (b) will apply as if eight (8) hours were substituted for 10 hours.

(ii) must be paid for ordinary working time occurring during the 10 consecutive hours off duty. (c) If an employee is directed by the supervisor to resume or continue work without having 10 consecutive hours off, the employee: (i) must be paid at the overtime rate until he/she is released from duty. (ii) is entitled to be absent for 10 consecutive hours without loss of pay for work occurring in that absence. (d) If a shift worker works overtime for the purpose of changing shift rosters or does not report for duty and a day worker replaces him/her, then subclauses 11.7.4(a), (b) and (c) apply as if 8 hours were substituted for 10 hours.
Break after Overtime. When overtime is worked, there shall be an elapsed time of eight (8) hours between the end of overtime and the time the employee reports for duty on the next regular shift, with no shortfall out of his/her regular shift. If eight (8) clear hours are not provided, overtime rates shall apply to hours worked on the regular shift. The eight (8) hour break commences when the employee arrives at his/her residence upon proceeding directly home after the overtime.

If, on the instructions of their employer, such an employee resumes or continues work without having had 10 consecutive hours off duty, they shall be paid double rates until they are released from duty for such period, and such employee shall then be entitled to be absent until they have had 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.

With the exception of employees rostered to work following a ten hour shift, the provisions of this subclause shall apply in the case of shift workers who rotate form one shift to another as if eight hours were substituted for ten hours when overtime is worked:– (a) to satisfy operating theatre staffing requirements; or (b) to permit changes of shift rosters; or (c) by agreement between the employer and the employee in circumstances where they are of the opinion the employee will not be unduly fatigued and the employee's professional competence will not be adversely affected.

Break after Overtime. (a) Where an Employee is required by UNSW to work overtime, the Employee will be given a minimum break of 10 hours between the end of one period of duty and the beginning of the next, if reasonably practicable. (b) Where an Employee works overtime and does not have 10 consecutive hours off duty between the end of one period of duty and the start of ordinary hours duty, the Employee: (i) will continue to be paid at the overtime rate until released from duty; and (ii) is entitled to delay starting their ordinary hours duty until a 10 hour break has been taken without any loss of pay or having to extend the ordinary hours duty. (c) Where an Employee (other than a an Employee employed by UNSW to work shifts) is required to replace an Employee employed by UNSW to work shifts, the arrangements provided for at subclauses 28.3(a) and 28.3(b) will apply as if 8 hours were substituted for 10 hours.

Break after Overtime. If, at the completion of a period of overtime, there is a break of less than 10 hours plus reasonable travel time until an employee’s ordinary hours are scheduled to start, the University will either: 16.12.1 provide the employee with a break of 10 hours plus reasonable travel time (being the time normally taken to travel between the workplace and their residence and back), without any loss of pay for the employee’s scheduled ordinary hours; or 16.12.2 pay the employee at their Ordinary Salary plus 100% for all time worked until the employee is given a break of at least 10 hours plus reasonable travel time.
