Community Services Leave. 33.1 The Parties recognise and agree that support for community services provides employees with the opportunity to achieve positive outcomes in their local rural communities.
33.2 The Employer will support employees who commit their personal time outside of work to legitimate emergency organisations whose role is to service and protect the community, by permitting the employee to take up to one full day’s unpaid leave and by consultation (if possible) additional unpaid leave of absence each time they have been officially called in to attend an emergency.
33.3 Approval for unpaid leave will be considered for an employee attending an emergency during working hours provided:
a) the employee substantiates they are a current member of the emergency organisation, (i.e. Country Fire Service, St. Xxxxx Ambulance Service, State Emergency Service);
b) the employee is obliged to attend the emergency situation or the emergency organisation specifically requests the employee to attend;
c) the emergency situation is within the local jurisdiction of the emergency organisation and not for example volunteering to fight bushfires in New South Wales;
d) the employee must notify Management prior to their absence of the reason and the likely length of their absence;
e) employees may be requested to produce evidence of their attendance at the emergency situation.
33.4 Where an employee has been absent from the workplace for more than one day (or their normal shift) due to the emergency, and the emergency situation has not abated, the employee must contact Management (if possible) who in consultation will decide whether or not to grant permission to extend the unpaid leave of absence. Such extension will not be unreasonably withheld.
33.5 The responsibility for Workers Compensation where an employee is injured whilst attending an emergency situation is the responsibility of the relevant emergency organisation.
Community Services Leave. An Employee is not entitled to any payment for community services leave in relation to activities the Employee engages in while taking parental leave.
Community Services Leave.
7.8.1 Each of the following is a community service activity: • jury service (including attendance for the purposes of jury selection) that is required by or under a law of the Commonwealth or a State or Territory; or • carrying out voluntary emergency management activity (within the meaning of the FW Act).
7.8.2 An Employee who engages in an eligible community service activity is entitled to be absent from their employment for a period if the period consists of one or more of the following: • time when the Employee engages in the activity; • reasonable travelling time associated with the activity; • reasonable rest time immediately following the activity; and • unless the activity is jury service – the Employee’s absence is reasonable in all the circumstances.
7.8.3 An Employee who wants an absence for community service leave must provide the Company with a notice of absence, which must: • be given to the Company as soon as reasonably practicable (which may be a time after the absence has started); and • advise the Company of the period or expected period of such leave.
7.8.4 An Employee who has given the Company notice of an absence under this clause must, if required by the Company, provide evidence that would satisfy a reasonable person that the absence is because the Employee has been or will be engaging in an eligible community service activity as defined in clause 7.8.1.
7.8.5 An Employee’s absence from their employment is not covered by this clause unless the Employee complies with this clause.
Community Services Leave. 49.1. Employees are entitled to leave for the purposes of engaging in eligible community service activities (as defined by the FW Act). This leave may be granted with or without pay for emergency services activities including training, emergency service responses, reasonable recovery time and ceremonial duties.
Community Services Leave. 8.6.1 Employees are entitled to be absent from work in order to engage in an eligible community service activity. Reasonable periods of travelling and rest time relating to these activities are also allowable.
8.6.2 Eligible community service activities are:
a) Jury Service (including attendance for Jury selection);or
Community Services Leave. 5.17.1 Community Services Leave is provided for in the NES.
Community Services Leave. 19.2.1 Employees carrying out of a voluntary emergency management activity shall be permitted to take unpaid leave, or paid leave using accrued annual or long service leave entitlements, where the absence is reasonable having regard to all the circumstances.
19.2.2 The provisions of Division 8 of Part 2-2 of the Act shall be used in interpreting the provisions of this sub-clause.
Community Services Leave. 35.1 Employees shall be entitled to community services leave for eligible community services activities in accordance with the provisions of the NES.
35.2 Eligible community service activities:
a) Entitle an employee, acting reasonably, to be absent from employment for periods including:
(i) Time when the employee engages in the activity;
(ii) Reasonable travelling time associated with the activity;
(iii) Reasonable rest time immediately following the activity
b) Include:
(i) Jury service (including attendance for jury selection) that is required by or under a law of the Commonwealth, a State or a Territory; or
(ii) A voluntary emergency management activity; or
(iii) An activity prescribed in regulations made for the purpose of subsection (4).
Community Services Leave. Employees are entitled to up to 2 weeks paid leave to take Military Reserve training or for any emergency requirement to assist with the Fire Services or Emergency Services, subject to agreement by the CEO. Any payment made by these services must be paid to Plantic.
Community Services Leave. (a) An employee who engages in an eligible community service activity is entitled to be absent from his or her employment for a period if the period consists of one or more of the following:
(i) time when the employee engages in the activity;
(ii) reasonable travelling time associated with the activity;
(iii) reasonable rest time immediately following the activity; and unless the activity is jury service—the employee’s absence is reasonable in all the circumstances.
(b) Meaning of eligible community service activity
(i) Each of the following is an eligible community service activity:
(1) jury service (including attendance for jury selection) that is required by or under a law of the Commonwealth, a State or a Territory; or
(2) a voluntary emergency management activity (see subclause (b)(ii)); or
(3) an activity prescribed in regulations made for the purpose of subclause (b)(iii).
(ii) Voluntary emergency management activities
(1) An employee engages in a voluntary emergency management activity if, and only if:
(A) the employee engages in an activity that involves dealing with an emergency or natural disaster; and
(B) the employee engages in the activity on a voluntary basis (whether or not the employee directly or indirectly takes or agrees to take an honorarium, gratuity or similar payment wholly or partly for engaging in the activity); and
(C) the employee is a member of, or has a member-like association with, a recognised emergency management body; and
(D) either:
(i) the employee was requested by or on behalf of the body to engage in the activity; or
(ii) no such request was made, but it would be reasonable to expect that, if the circumstances had permitted the making of such a request, it is likely that such a request would have been made.
(iii) A recognised emergency management body is:
(1) a body, or part of a body, that has a role or function under a plan that:
(A) is for coping with emergencies and/or disasters; and
(B) is prepared by the Commonwealth, a State or a Territory; or
(2) a fire-fighting, civil defence or rescue body, or part of such a body; or
(3) any other body, or part of a body, a substantial purpose of which involves:
(A) securing the safety of persons or animals in an emergency or natural disaster; or
(B) protecting property in an emergency or natural disaster; or
(C) otherwise responding to an emergency or natural disaster; or
(4) a body, or part of a body, prescribed by the regulations; but does not include a body that was estab...
