CULTURAL/CEREMONIAL LEAVE. (1) Cultural/ceremonial leave shall be available to all employees. (2) Such leave shall include leave to meet the employee’s customs, traditional law and to participate in cultural and ceremonial activities. (3) Employees are entitled to time off without loss of pay for cultural /ceremonial purposes, subject to agreement between the Employer and employee and sufficient leave credits being available. (4) The Employer will assess each application for ceremonial /cultural leave on its merits and give consideration to the personal circumstances of the employee seeking the leave. (5) The Employer may request reasonable evidence of the legitimate need for the employee to be allowed time off.

CULTURAL/CEREMONIAL LEAVE. Cultural leave means paid or unpaid leave for an employee to participate in their customs, traditional law, and to participate in ceremonial, cultural or religious activities. This includes ceremonial leave for Aboriginal and Xxxxxx Xxxxxx Islanders. An employee may request time off work for cultural purposes. The leave maybe taken as paid annual leave or as unpaid leave up to a maximum of 10 days in one year. Anglicare WA may request the employee provide evidence to support an application for unpaid cultural leave. Anglicare WA will assess each application for leave for ceremonial or cultural purposes on its merits and give consideration to the personal circumstances of the employee seeking the leave.
CULTURAL/CEREMONIAL LEAVE. 30.1 The employer may approve attendance during working hours by an employee of Aboriginal or Xxxxxx Xxxxxx Islander descent at any Aboriginal community meetings, except the Annual General Meetings of Aboriginal community organisations at which the election of office bearers will occur. 30.2 The Employer may grant an Employee of Aboriginal or Xxxxxx Xxxxxx Islander descent accrued recreation or other leave to attend Annual General Meetings of Aboriginal community organisations at which the election of office bearers will occur. 30.3 Ceremonial leave without pay may be granted to an Employee of Aboriginal or Xxxxxx Xxxxxx Islander descent for ceremonial purposes: (a) connected with the death of a member of the immediate family or extended family (provided that no Employee shall have an existing entitlement reduced as a result of this Clause); or (b) for other ceremonial obligations under Aboriginal and Xxxxxx Xxxxxx Islander law. 30.4 Ceremonial leave granted under this Clause 30 is in addition to compassionate leave granted under Xxxxxx 27.

Cultural/Ceremonial leave does not provide employee’s with additional leave entitlements, the leave is taken from the employees annual leave, long service leave or accrued time off. Leave can be taken and deducted from long service leave but this is limited to full days only.

(3) Time off without pay may be only be granted by Agreement between the Employer and Caregiver. (4) The Employer may request reasonable evidence of the need of the legitimate cultural obligation for time off.
