Guild Security. During the term of this Agreement, the Company will maintain in its employ as Directors, Associate Directors or Stage Managers only such persons who are members of the Directors Guild of America, Inc. in good standing or who shall make application for membership in the Directors Guild of America, Inc. within the time permitted by law. Subject to the provisions of this Article and to the extent that it shall be lawful so to do, the Employer agrees that in every future employment agreement it enters into with an Employee, the Employee shall promise to be or become a member of the Guild in good standing, as herein provided, and shall remain so for the duration of the employment agreement; that subject to the provisions of this Article and to the extent that it may be lawful so to do, the Employer shall require such person to agree that if he or she shall fail or refuse to so become or remain a member of the Guild in good standing, as herein provided, the Employer will terminate its further obligations under such employment agreement. The terms of this Agreement shall be part of such employment agreement. The term "member of the Guild in good standing" means a person who offers to pay (and, if the Guild accepts the offer, pays) Union initiation fees and dues as financial obligations in accordance with the requirements of applicable law. Before termination of any employment becomes effective, the Guild shall give written notice to the Employee of the initiation, reinstatement or upgrade fee and/or delinquent dues payable. If the Employee fails to pay such fees and dues, the Guild shall give written notice to the Employer of such failure and the amount of fees and/or dues payable. If such amount is paid within five (5) days after such notice to the Employer, the Employee's dismissal shall not be required by reason of non-payment of such fees or dues. The term "dues," as used in this Article 4, shall not include fines, penalties, assessments or initiation fees.
Guild Security. 4.1 1) Membership or non-membership in the Guild shall be wholly voluntary and the individual choice of employees covered by this Agreement. Any employee who is a member of the Guild or who has applied for membership shall sign and deliver to the Guild, who shall forward to the County, an original assignment authorizing and consenting to the deduction of dues, fees, costs, charges, and assessments for membership in the Guild. In furtherance of this goal, the Guild shall have up to a sixty (60) minute orientation with new employees during the employees’ work hours at which time the Guild shall explain and do the following:
a) It is the designated exclusive representative for all employees covered under the Collective Bargaining Agreement;
b) Membership in the Guild is voluntary and only when an employee clearly and affirmatively consents to joining the Guild will it collect fees;
c) The rights and benefits that the employee would forgo by being a non-member; and
d) Provide the employee with all necessary paperwork to inform the Guild of its decisions—member or non-membership.
Guild Security. 3.1 Payroll Deduction of Guild Dues — The Employer shall deduct monthly dues from Employees in the bargaining unit who voluntarily execute a wage assignment authorization form. The Employer will deposit such dues with the Treasurer of the Bainbridge Island Police Officers' Guild. Upon issuance and transmission of such dues and initiation fees to the Guild, the Employer's responsibility shall cease with respect to such deductions. The Guild and each Employee authorizing the assignment of wages for payment of Guild dues hereby undertake to indemnify and hold the Employer harmless from all claims, demands, suits or other forms of liability that may arise against the Employer for or on account of any deduction made from the wages of such Employee.
Guild Security. Notwithstanding the Guild Shop provisions set forth in Article 4 of the FLTTA, an individual engaged as the Director of an Original New Media Production shall not be required to become a “member of the Guild in good standing” until he or she completes production of 120 total minutes of programming, as edited for exhibition. The 120 minutes of programming applies per Director, regardless of the number of Companies for which the Director works. The above provision applies only to Directors who are not, and have not previously been, members of the Guild and only to work performed on covered New Media productions.
Guild Security. 2.1 It shall be a condition of employment that all Employees of the Police Department designated under this Agreement as Guild members shall continue to be members of the Guild and remain members in good standing. Those who are not members on the effective date of this Agreement shall on the 31st day following the beginning of such employment become and remain members in good standing of the Guild: PROVIDED THAT, if a public employee is a member of a church or religious body whose bona fide religious tenets or teachings forbid said public employee to be a member of a labor union, such public employee shall pay an amount of money equivalent to the regular Guild dues and initiation fees to a non-religious charity or to a another charitable organization mutually agreed upon by the City and the Guild. The City shall furnish written proof to the Guild that such payment has been made. If the City and the Guild do not reach an agreement on the choice of the non-religious charity to whom the Guild dues and initiation fees are to be paid or if the Guild does not agree that the employee has a bona fide basis for religious objection, the Washington State Public Employment Relations Commission shall designate the charitable organization; PROVIDED FURTHER THAT, if an employee for any reason does not wish to be a member of the Guild, that employee shall proportionally and fairly share in the cost of the collective bargaining unit to defray the cost of services rendered in negotiating and administering this Agreement. Payment of a maintenance fee in this amount shall be in lieu of any other obligation under this Article.
2.2 Any employee failing to comply with Article 2 will be terminated upon two weeks' notice to the City and the employee by the Guild. This section shall control over any conflicting Civil Service provision.
Guild Security. A. All employees recognized in Section 1 who are members of the Guild in good standing on the effective date of this Agreement, shall remain members in good standing during the term of this Agreement, and those who are not members on the effective date of the Agreement shall, on the 31st day following the effective date of this Agreement, become and remain members in good standing in the Guild. It shall be a condition of employment that all employees covered by this Agreement hired on or after its effective date shall, on the 31st day following the beginning of such employment, become and remain members in good standing in the Guild; Provided that, if a public employee is a member of a church or religious body whose bona fide religious tenets or teachings forbid such public employee to be a member of a labor Guild, such public employee shall pay an amount of money equivalent to the regular Guild dues, assessments and initiation fees of the Guild to a non-religious charity or to another charitable organization mutually agreed upon by the employee and the Guild. If the Employee and the Guild do not reach an agreement on the choice of the non-religious charity to which the Guild dues, assessments and initiation fee are to be paid, the Public Employment Relations Commission shall designate the charitable organization. This shall apply only to public employees as introduced in RCW 41.56.030(2).
B. The Employer shall notify the Guild monthly of any new employee coming under the terms of this Agreement.
C. The Guild agrees that membership in the Guild will not be denied or terminated for any reason other than failure of an employee covered by this Agreement to tender the periodic dues, assessments, and initiation fees uniformly required as a condition of acquiring or retaining membership in the Guild.
D. The Guild agrees that the Employer shall not terminate the employment of any employee under the security clause provisions of this Agreement until written notification is received from the Guild that an employee has failed to pay the required dues or fees, or provide proof of an alternative payment based on religious tenets as provided herein above.
E. The Guild shall provide thirty (30) days written notice to the employee with copy to Employer, that unless restitution for any dues or fees overdue are made, discharge action will be taken. Should the employee make total restitut...
Guild Security. 2.1 All employees shall become and remain members of the Guild in good standing as a condition of employment.
2.2 There shall be no interference or attempt to interfere with the operations of the Guild.
2.3 There shall be no dismissal except for just and reasonable cause.
Guild Security. 6.01 All Ferry Captains who are members of the guild at the time of signing of this Agreement shall remain members during the term of this Agreement, providing they continue to occupy a bargaining unit position.
6.02 All Ferry Captains hired after the signing date of this Agreement shall become and remain members of the Guild, provided they continue to hold a bargaining unit position.
6.03 All Ferry Captains shall upon commencing employment be provided with information in writing concerning duties and responsibilities, starting salary and classification, and terms and conditions of employment.
(a) No Ferry Captain shall be temporarily assigned outside the bargaining unit unless by consent. A Ferry Captain who is temporarily assigned outside the unit may return subject to giving the Employer two (2) week’s notice.
(b) A Ferry Captain temporarily assigned outside the bargaining unit shall continue to accumulate seniority and have access to the grievance procedure as if still covered by this Agreement
(c) Ferry Captains temporarily assigned outside the bargaining unit shall continue membership in the Guild.
