GUILD SHOP. 1. The Employer shall require as a condition of employment of each employee that the employee be and remain a member of the Guild in good standing no later than the 30th day following either (1) the date of the first Guild Shop contract legally enforceable under the Labor Management Relations Act, or (2) the date of hiring, whichever is later. 2. There shall be no interference or attempt to interfere with the operations of the Guild.

GUILD SHOP. E. If, during any time that a writer is employed by the Company under a contract of employment, such writer is or becomes a member of the Guild in good standing and if such writer shall subsequently and before his/her employment under such contract terminates, cease to be a member of the Guild in good standing then: 1. If such writer has ceased or shall cease to be a member for any reason other than his/her failure to pay dues, such writer shall, for the purposes of this Basic Agreement, be deemed to remain a member of the Guild in good standing throughout the writer's employment under said contract of employment as the same may be extended or renewed pursuant to any provisions or options therein contained. 2. If he/she has ceased or shall cease to be a member in good standing by reason of his/her failure to pay dues, and if the Guild gives the Company written notice of that fact within three (3) business days after such writer is first named on the weekly list provided for in Article 3.A.1. of this Basic Agreement (in the case in which he/she has ceased to be a member in good standing prior to such employment), such writer shall, for the purposes of this Basic Agreement, be deemed to remain a member in good standing for a period of fifteen (15) days after written notice from the Guild to such writer and to the Company that he/she has ceased to be a member in good standing for failure to pay dues. If, prior to the expiration of said fifteen (15) day period, payment of said dues in fact due and owing and specified in said notice shall be made by the writer or the Company, then, for the purposes of this Basic Agreement, such writer shall not lose his/her status as a member in good standing. To the extent that it may be lawful for the Company to do so, the Company may require, as a condition of employment, that any writer become and/or remain a member of the Guild in good standing, and may also require such written consent or consents as may be necessary so that, if the Company elects, it may pay to the Guild any dues of any writer and the Company shall have the right, insofar as its obligations to the Guild and to any writer under the terms and provisions of this Basic Agreement are concerned, if it elects, to deduct the amount of such dues from any compensation then or thereafter due or to become due to the writer. GUILD SHOP. To a writer whom the Company is required to employ as a condition of the sale, license or option of material, provided that within fifteen (15) days after written notice from the Guild to the Company that such writer is not a member of the Guild in good standing, the Company shall either terminate such employment, or shall pay or cause to be paid the initiation fees and dues that the writer would otherwise be required to pay hereunder during such employment, in the manner, within the time, and subject to the provisions of subparagraph E.2. hereof relating to the payment of dues. However, the writers employed by the Company within the exception provided for in this subparagraph 2. shall not exceed ten percent (10%) of the total number of writers in the employ of the Company. For the purpose of such computation, if the Company has in its employ at any time less than ten (10) writers, then one (1) of such writers so employed may fall within this exception. Promptly following the employment of any writer claimed by the Company to be within this exception, the Company will notify the Guild in writing of the name of the writer employed, the date of the employment agreement and the fact that the Company claims that such writer is an exception hereunder. For the purpose of such computation, a writer who is employed under an exclusive contract by a Company shall be regarded as being employed by the Company at all times during the term of such contract, including periods during which the writer may be on layoff and periods during which such contract may be suspended by reason of illness or default of the writer or otherwise. The writer shall be regarded as continuing in the employ of the Company by which he/she is employed regardless of the fact that his/her services may be loaned to another Company.
GUILD SHOP. (a) All Employees shall apply for membership in the Guild. In the event of failure to become a member no later than thirty (30) days from the start of his/her employment, or thirty (30) days from the effective date of the Agreement in effect at the time of the start of his/her employment and providing for Union membership as a condition of employment, whichever is later, the Employee shall upon formal notice from the Guild be discharged. All Employees who as of such date are or become members of the Guild shall remain members in good standing during the term of this Agreement, and for failure to do so shall be discharged upon formal notice from the Guild. This provision does not apply to Employees hired before January 1, 1963, and who have not subsequently become members of the Guild. (b) The Guild will indemnify and hold the Employer harmless against any claims made by or on behalf of any Employee who the Employer discharges pursuant to paragraph (a) above.
GUILD SHOP a) All employees of the Company covered under the terms of this Contract, except as set forth below and in Article III, who are, or who may become, members of the Guild shall remain members in good standing during the life of the Contract. In addition, the Company shall have the option of designating one (1) out of seventy-five (75) employees in the bargaining unit as exempt from the provisions of this Section. All other employees in the bargaining unit not otherwise exempt from the provisions of this Section shall be required to become and remain members of the Guild. In the event of failure to become a member within thirty (30) days of the start of his/her employment, the employee shall, upon formal notice from the Guild, be discharged. b) This article shall be effective only to the extent permitted by law. c) If any Guild member shall lose good standing by falling thirty (30) days in arrears in Guild dues, the Company shall, upon formal notice from the Guild, lay off said employee without pay until such obligations are paid. If obligations are not paid within thirty (30) days, the employee shall be considered automatically discharged. (See Memorandum of Agreement dated December 20, 1961.) 1. To the full extent permitted by law, the Guild shall defend, indemnify and hold the Company, its current or former officers, agents, employees, and contractors harmless against any and all claims and against any and all liabilities, demands, suits, costs, losses or damages, including legal costs and attorneys’ fees, arising from any claims, demands, suits or judgments for wrongful discharge, discrimination, harassment, or any other claims, demands, suits or judgments against the Company or any of its current or former officers, agents, employees, and contractors arising out of an employee being discharged pursuant to this section. 2. If the Guild discovers within thirty (30) days after an employee has been automatically discharged as provided in section (c)1 above, that the discharge was in error, the Guild shall so advise the Company that the termination demand was in error, and the Company shall then reinstate the employee with full seniority within three working days after being so notified by the Guild in writing. The Company, however, shall not under any circumstance be liable for any backpay liability if it reinstates an employee pursuant to this section.

Within thirty days of hire, the Guild president, or his/her designee, shall be allotted up to one hour of company time with a new bargaining unit employee for the purpose of explaining the role of the Guild at the Chieftain. 2. An employee shall have a 15-day option period prior to his/her first employment Anniversary and each anniversary thereafter during which time he/she may serve notice and resign from the Guild and/or cease paying dues or fees to the Guild and retain his/her employment. 3. Upon an employee's voluntary written assignment, the Publisher shall deduct from the earnings of such employee and pay to the Guild no later than the tenth (10th) day of the month following the month of such deductions, all Guild membership dues. Such membership dues shall be deducted from the employee's earnings in accordance with the Guild's schedule of dues furnished the Publisher by the Guild. Such schedule may be changed by the Guild at any time, on at least thirty (30) days’ notice. An employee's voluntary written assignment shall remain effective in accordance with the terms of such assignment. 4. The dues deduction shall be made upon the following form:

The Management recognizes the Guild as the sole collective bargaining agency for the employees covered by this Agreement and hereby consents and agrees to negotiate with the Guild or any Committee thereof in any and all matters affecting the relationship between the Management and employees under the jurisdiction of the Guild. 2. The Guild recognizes that matters of Management and direction of staff are vested exclusively in the Management and agrees not to abridge this right. a) Correspondence to the Guild will be addressed to and sent to the Guild President. b) All letters of dissatisfaction (including suspensions and terminations) shall be copied and sent to the Guild President. c) No Guild member shall suffer a loss of pay while attending a meeting agreed to by Management. 4. The Management shall require as a condition of employment (including temporary employment) within the certified bargaining unit that every person shall, immediately upon commencing work within the certified bargaining unit, become and remain a member of the Guild in good standing during the term of his/her employment.
